A former Marine with ties to Tea Parties and militias who talked
openly about using his training “to become a domestic terrorist” has
been charged in separate complaints with raping a child and possessing
an unregistered grenade launcher. His arrest may signal that a wing of
the Tea Parties is heading in a more militant direction.
Charles Allan Dyer, 29, of Marlow, Oklahoma was arrested on January 12
at his home by Stephens County Sheriff’s deputies on the rape charge.
The arrest occurred after a 7-year-old girl told sexual-abuse experts
about a January 2nd incident at Dyer’s home.


While sheriff's deputies were at Dyer's home, they found several
firearms and a Colt M-203, 40-millimeter grenade launcher, according to
court documents. When they searched a national crime database, the
deputies discovered that the grenade launcher was one of three stolen
from a military base at Fort Irwin, California, in 2006. According to
an affidavit, Dyer told law enforcement that he had received the
grenade launcher "from his best friend who gave it to him while Dyer
was stationed in California with the Marine Corps" (United
States District Court for the Western District of Oklahoma, Criminal
Complaint, Case No. M-10-36-BA, January 14, 2010, pp. 2-3).

Dyer left the Marines last year after being brought up on charges of
uttering "disloyal” statements, including his starring in several
inflammatory YouTube videos which called for armed resistance against
the U.S. government. In one video, Dyer exclaimed, "With DHS blatantly
calling patriots, veterans, and constitutionalists a threat, all that I
have to say is you’re damn right we're a threat. We're a threat to
anyone that endangers our rights and the Constitution of this
republic." He invited viewers to join him at his makeshift training
area—"I'm sure the DHS will call it a terrorist training camp.”

In an online interview, when asked about “honorable organizations to
get a patriots feet wet with and take the fight to the man, and to the
streets,” Dyer stated, “Oathkeepers, American Resistance Movement,
Local tea parties, Appleseed, and I'm sure many other organizations near
your area that you would have to search a little for. It depends a lot
on how far you are willing to take the fight to preserve your freedom.
If you are willing to give your life to preserve freedom for your
children and grandchildren, I would suggest any of the above mentioned
groups. If you are only willing to write on forums and protest on the
streets, but will ultimately live under tyranny if it means not being
killed, then I suggest joining the 9/12 project or something else a

Jury trials begin


Panel selected in case of Charles Dyer

In January 2010, Charles Alan Dyer of Marlow, was charged with child sexual abuse.

More than a year later, the State of Oklahoma’s case began Monday, with the first witness called to the stand at 3 p.m.

The day began with numerous Stephens County residents filling the
courtroom of Judge Joe Enos for the felony trial. After extensive
questioning of the jurors, both as panels and in some cases,
individually, around 15 were excused from duty and a jury of 12 and two
alternates were seated by 2:15 p.m.

Questioning included asking the jurors if they were connected with
anyone involved on the case, including the defendant, and if they could
remain impartial because of the sensitive nature of the case.

The alleged victim at the time the charges were filed was 7-years-old. Some of the jurors dismissed said they knew the Dyers.

The remaining jurors on the red panel were dismissed with instructions to return later in the week for another trial.

Enos instructed the paneled jurors to avoid the Internet and to avoid
discussion with everyone until the case was over. Additionally, numerous
security measures were taken at the Stephens County Courthouse. Those
included several law enforcement officers and the Oklahoma Highway
Patrol stationed at strategic locations around the courthouse, including
up to a block away. Anyone entering the courthouse Monday had to go
through the security scanners and cellphones or other communication
devices were prohibited from being inside the courtroom.

Dyer was also charged in 2010 with a federal crime, but acquitted.

Representing the District 6 Stephens County District Attorney’s office
are First Assistant District Attorney James Walters and Assistant DA
Carrie Hixon.

Dyer is represented by local attorney David Hammond. His mother, Jan
Dyer, his girlfriend Amanda Monsalvo, and his sister were all present.
His family was named during Monday’s proceedings as being on the witness
list and exited the courtroom before the first witness took the stand.

Hixon gave the opening statement, telling the jury how Valerie Dyer believed her daughter to have been molested.

“She (Valerie) went to Department of Human Services, who sent her away,
then to Women’s Haven, and then to Duncan Police Department, who told
her it was out of their jurisdiction. She finally went to the Sheriff’s
Office where they listened to her,” Hixon said.

Valerie Dyer made the allegations in January 2010 against her husband.
The accusations cover a time period from July 2009 through Jan. 4, 2010.

Hammond also presented his opening statement, detailing to the jury
everything from the marital problems between the Dyers to the video of
their child being interviewed at the Abbot House. Hammond told the jury
he would have Monsalvo testify and tell them exactly what happened on
Jan. 2 and that at no time were Dyer and the victim alone together as
alleged.

The Dyers are separated and court records indicate they have filed a petition for dissolution of marriage.

Much of Valerie Dyer’s testimony, through questioning by the state’s
prosecution, Walters, covered the history of Valerie and Charles.

The couple began a juvenile relationship when she was 13 and he was 16.
She told the court they were married when she was 16 and he was 19, and
then they went to California after he joined the U.S. Marines. She was
18 when she became pregnant with their only child.

During her testimony Monday, Dyer admitted on stand there were marital
problems — from accusations by Charles about adultery and marijuana. She
admitted on stand she had smoked marijuana but never in the presence of
their daughter.

She also talked about how Charles sent her back to Oklahoma from
California to live with his parents, in hopes of them saving money. It
was later, she said, when she found out he was involved with her best
friend.

When the questioning centered on her daughter, she began crying.
Walters asked her to relate the details of the time when she discovered
something physically different with her daughter.

Valerie also told the jury she had left the bathroom while her daughter bathed so the little girl wouldn’t see her upset.

The trial is scheduled to resume at 9 a.m. today.

Enos told the jury he expects it to last through Wednesday afternoon.

The trial resulted in a hung jury and a mistrial. After 7-1/2 hours of
deliberation the judge declared the jury to be hopelessly deadlocked.

Dyer remains a fugitive

DUNCAN — Authorities continue investigating leads today in the hunt for fugitive Charles Alan Dyer

It is expected federal charges will be filed against Dyer for unlawful
flight from prosecution. Stephens County Sheriff Wayne McKinney said
once the federal charges are filed, they would eliminate the need for an
extradition hearing, if Dyer is found outside of Stephens County.

“If he crosses state lines, then extradition doesn’t come into play
with that warrant filed by federal officials. Then they can take him
into custody and bring him to wherever I say,” McKinney explained.

McKinney continues to have concerns about Dyer being a fugitive and for
the safety of law officers conducting the search. Members of Dyer’s
family have said he is frightened for his safety.

McKinney and Stephens County District Attorney Jason Hicks have said Dyer is considered dangerous and could be armed.

Anyone with information should call 580-255-3131 and ask for McKinney.
Anyone with information who lives outside of Stephens County can call
local law enforcement departments.

Just because one guy, no matter how despicable his crimes and actions are, is involved with a group, that has no reflection on the group as a whole.

Dyer found guilty, gets 30 years


DUNCAN —
After nearly three hours of deliberation, the jury in the felony trial
of Charles Alan Dyer found the man guilty on one count of child sexual
abuse Thursday evening in the Stephens County Courthouse.

The trial, presided over by Judge Joe Enos, was Dyer’s third, coming
after two prior mistrial. He was sentenced to 30 years in prison.

While Dyer sat in silence at the defense table as the verdict was read,
the mother of the child victim and Dyer’s estranged wife, Valerie Dyer,
sobbed from her seat. Family members seated around Valerie Dyer as
Charles Dyer was escorted from the courtroom by court officials.

“I don’t know how to explain it,” Charles Dyer had said earlier in the
day, during his testimony. “It’s a roller coaster of emotion.”

Cheers erupted on the courthouse steps minutes after the reading of the
verdict as Valerie Dyer and her group of supporters left the courtroom.

Stephens County Sheriff Wayne McKinney expressed relief at the
conclusion of the proceedings in a statement after the verdict was
read.

“I am proud of the investigation conducted by my office,” McKinney
said. “I stand by the evidence presented in court, and have accepted the
jury’s verdict.”

McKinney commented on the “circus-like sideshows” Charles Dyer brought
to the case. He specified Dyer’s political views and his claims that his
“prosecution was a federal government conspiracy” among those
sideshows.

“My goal is to protect the vulnerable, and we have accomplished that within the confines of the law,” McKinney said.

Earlier in the day, the third and final day of testimony in the trial
featured testimony by the defendant himself, followed by closing
arguments by both sides.

During those closing arguments, District 6 first assistant District
Attorney James Walters found a key phrase to support his argument.

“Hell hath no fury like a woman scorned,” Walters said several times in his closing.

The phrase arose from the questioning of Charles Dyer by his defense
attorney, Albert Hoch. Hoch asked Charles Dyer several questions
regarding the status of his relationship with Valerie Dyer, including
her alleged issues with prescription drugs and alcohol.

In his own closing, Hoch told the jury to the believability of Valerie
Dyer, giving as examples some difficulty she had had on the stand
recounting events, and indicating specifically a statement she had made
that she would do “anything” to keep her child safe, including lying and
perjury.

He also said that, by keeping the child isolated from Charles Dyer’s
side of the family, she had been able to reinforce the child’s
testimony.

“She’ll have to deal with false allegations against her dad,” Hoch said.

For final statements, assistant District Attorney Carrie Hixon closed
by reinforcing to the jury and the audience in the courtroom that the
victim, when asked who committed the crime, pointed at Charles Dyer.
