Suspect:

connection to a deadly carjacking or a woman and her daughter

A
man previously charged with having child pornography cut an electronic
monitoring device off his ankle before carjacking a woman, fatally
stabbing her and raping her 10-year-old daughter.

J. Renz abducted the school librarian and her daughter as they left a
gymnastics class at a mall in the Syracuse suburb of Clay, about 150
miles west of Albany, on Thursday night.

Renz
bound both victims, raped the girl and drove a short distance to a spot
where the girl escaped and was found by a passing motorist, troopers
said.

The
motorist told 911 dispatchers he saw a man running away from the scene,
allowing police to quickly send in officers on the ground and a
sheriff's helicopter in the air. Renz was caught a short time later near
a wooded area.


They
believe Renz tied up the woman and the girl and then raped the
10-year-old in a deserted area of the mall parking lot shortly before
9pm on March 14.

It was unclear how the girl escaped or when her mother was killed, authorities said.

Police
are still piecing together the timeline of the crime, but their best
guess is that after assaulting the girl, Renz drove down a nearby rural
road.


That’s where they think the woman, 47, who worked at an elementary school, was stabbed to death.


The
girl managed to escape the scene and run down the road and was aided by
a passing driver. The child's name has not been released.


The girl sustained injuries from the attack and currently being treated at a hospital. Her mother died from multiple stab wounds.

of Renz, too, are being withheld for fear they could ‘pollute the
investigation,' New York State Police Captain Mark Lincoln said in a
Friday morning press conference.

‘It’ll be released down the road,’ Captain Lincoln said.

Police seem sure, however, that the suspect did not know the victims personally.


Renz fled the scene on foot, into nearby woods, where he was apprehended by police without a struggle.

The
suspect was arraigned Friday on murder, rape and kidnapping charges and
was held without bail. The lawyer assigned to his case, Ken Moynihan,
didn't return a call seeking comment.

Renz
appeared a his arraignment with a swollen face and a broken nose after
being assaulted by inmates at the Onondaga County Justice Center,CNY Central reported.

Following
his court appearance, the 29-year-old suspect was returned to jail, but
placed into protective custody. Renz is also being guarded for now, but
he will not be transfered to a different facility.


The
29-year-old had been charged in January with possession of child
pornography and allowed to remain free under terms that included staying
off the Internet and away from places including schools, parks and
arcades.


He
lost his job at a supermarket, moved in with his mother and hadn't been
able to find other work after his arrest, according to court documents.



According
to an FBI criminal complaint, agents who went to the North Syracuse
apartment where Renz was living in June found in his bedroom four
computers that he told them he used to view adult pornography.

Agent
Alix Skelton said Renz eventually admitted using the Internet for the
past six years to download child porn to a drive on one of the machines,
which he turned over to the agents. Technicians determined in November
that it had an encrypted hard drive, and Skelton said Renz provided the
encryption key.

Agents
reviewing the drive in December found about 100 gigabytes of child porn
comprising more than 500 videos and more than 3,000 images, according
to the complaint.

Among
the images were two showing sex acts involving prepubescent girls, said
Skelton, a member of a unit that targets people involved in online
exploitation of children.

Renz
was charged on Jan. 9 in federal court with possession of child
pornography. On Jan. 29, a judge granted a prosecutor's request for an
extension of the time required for grand jury action so investigators
could continue going over "numerous items of electric media" for
additional evidence.

Renz,
who authorities said had no prior police record, was released after
agreeing to stay at home at night with an electronic monitor and away
from any place he might encounter children.

But
Renz removed the monitor, Executive Assistant U.S. Attorney John Duncan
said. Federal probation officials were investigating what happened,
including whether Renz was able to get around an alert that is supposed
to go off if the ankle bracelet is removed, he said.

Late
Friday afternoon, state police turned Renz over to federal authorities,
who will hold him for violating the terms of his release, court
documents said.

Duncan said the cases against him will continue in federal and state courts.

In an interview with Syracuse.com Friday,
a former manager and trainer of David Renz described him as a courteous
and intelligent employee who had worked at the James Street Wegmans
since his teens.

The manager recalled that the 29-year-old was always willing to help customers and was 'trusted' by his superiors.

This is were the death penalty is needed badly. After castration by one million paper cuts that is. I know a girl that is ten and would be devastated if that happened to her. I would want to harm the person involved in so many ways. I know justice is right over vengence but sometimes it's hard for us to forgive. At least this girl and her mother will get some justice. New York State Police investigate a car involved in the fatal carjacking.

SYRACUSE, N.Y. — A 29-year-old central New York man accused of raping a
10-year-old girl and stabbing her mother to death during a carjacking is
facing new federal child pornography charges.

A grand jury on Thursday indicted David Renz of Cicero on one count of receiving and
five counts of possessing child pornography, the U.S. attorney’s office in Syracuse said.

The charges that he downloaded the pornography over the course of two years
and had five DVDs and CDs with the material stem from an FBI
investigation that led to Renz’ arrest on Jan. 9. He was released a
couple of days later under terms that included wearing an electronic
monitoring device and staying away from places where he might encounter
children.

Authorities said Renz was able to remove and quickly
reassemble the ankle bracelet so monitors didn’t immediately realize
he’d taken it off shortly before the March 14 carjacking.

Renz attacked the mother and child as they left an exercise class at a
suburban Syracuse mall, state police said. They said the child was able
to escape, apparently as her mother was being killed, and was found by a
passing motorist who called for help. Troopers said they caught Renz as
he was running from the scene.

He is facing murder, rape and kidnapping charges in state court.

A message seeking comment was left Thursday afternoon for the federal public defender representing Renz.

The Associated Press generally doesn’t publish information that could
identify potential sex crime victims and isn’t naming the slain woman to

SYRACUSE, N.Y. - David Renz had his sights on another woman and child on the same night he murdered a school librarian and raped a 10-year-old girl last year, according to a lawsuit filed today.

Renz followed the first woman and her daughter March 14, 2013, from a gymnastics class at CNY Gym Centre at Great Northern Mall in Clay, according to the lawsuit.

The woman and child left the mall in a poorly lit area of the parking lot, the lawsuit said. "Sensing the danger" of Renz behind them, they got into their car and quickly locked the doors before Renz could get to them, the lawsuit said.

It's apparently the first public revelation that Renz followed two other potential victims to their car before he abducted Liverpool school librarian Lori Bresnahan and a 10-year-old girl who was with her. He took Bresnahan and the girl to a remote area, where he stabbed Bresnahan to death and raped the child.

The lawsuit was filed in state Supreme Court on behalf of Sheila Ben, a lawyer who is the legal guardian of the child's property.

The suit was filed against Renz, Macerich Corp., the company that owns the mall; and BI Inc., a company that manufactured and monitored an electronic ankle bracelet through which Renz's probation officer was supposed to be keeping track of him.

Renz, 30, admitted that he dismantled the monitor at his mother's home in Cicero before going to the mall that night.

The lawsuit accuses Macerich of improperly designing and maintaining the area of the mall where CNY Gym Centre is located.

The gymnastics school has floor-to-ceiling windows and a wide-open entranceway "that allow all of those in the mall to have unfettered viewing of the young children within the CNY Gym Centre during all hours of operation," said the lawsuit, filed by lawyer John Cherundolo.

The 10-year-old girl who was with Bresnahan had attended gymnastics classes at CNY Gym Centre, the suit said.

Renz had positioned himself in the mall near a piano store, where he waited for women and children to leave the gymnastics school, the lawsuit said.

He followed the first woman and child starting around 7:45 p.m., the suit said. He had deactivated the ankle bracelet about 7 p.m., federal prosecutors have said.

After the first woman and child locked him out of their car, Renz went back into the mall through the entrance near the Sears store, the lawsuit said.

He followed Bresnahan and the 10-year-old girl around 9 p.m., prosecutors have said.

The mall had a security camera near the Sears entrance, but no one from mall security was monitoring video from the camera that night, and the camera did not have nighttime capability, the suit said.

"No activity could be seen through the camera during evening hours," the lawsuit said.

Renz pleaded guilty to murdering Bresnahan and raping the girl, who's now 11.

Renz was released from jail in January 2013 on the ankle bracelet to await prosecution on a federal child pornography charge.

Probation officials ignored 46 tamper alerts from Renz's electronic bracelet over six weeks before Renz murdered Bresnahan, according to an investigation by the Administrative Office of the United States Courts. Renz has since pleaded guilty to the charge of possessing child pornography and is scheduled to be sentenced next week.

Cherundolo filed a claim against the federal probation office last year, claiming its negligence in monitoring Renz on the ankle bracelet allowed him to commit his crimes.

Cherundolo expects to file a federal lawsuit against the probation office in the next two weeks.

SYRACUSE, N.Y. (AP) - A New York man was sentenced Friday to life in prison without parole for raping a girl and killing her mother after cutting off his ankle monitor and carjacking them last year.

David Renz, 30, of the Syracuse suburb of Cicero, was given the maximum possible penalty in Onondaga County Court by a judge who said he hoped the sentence would comfort the victims' family.

"One day, you will face another judge," Judge Thomas Miller told Renz. "One day when you pass from this earth, another judge will impose a harsher sentence for the absolute evil you committed."

Renz had no visible reaction to the sentence and declined an offer to speak.

Earlier, a relative of the victim choked up as he read a statement about the toll the crime took on the family.

Renz pleaded guilty to first-degree murder and sex charges in July, admitting that he carjacked the woman and her 10-year-old daughter as they left a gymnastics class at Great Northern Mall in Clay in March 2013. He had cut off the electronic monitoring bracelet he was wearing as a condition of pretrial release on federal pornography charges. He strangled and stabbed the mother as she fought to stop him from raping the girl.

The Associated Press generally does not identify victims of sex crimes and has not identified the woman to protect the identity of her daughter.

Renz was sentenced earlier this year to 30 years in federal prison for possessing more than 11,000 images and 1,100 videos of child pornography.

Federal authorities announced earlier this week that they would not prosecute Renz on a carjacking charge that could have brought the death penalty. If the U.S. Justice Department had decided to pursue the death penalty in its case, Renz could have withdrawn his guilty pleas on the state charges.

Relatives said they didn't want the death penalty case pursued because it would have required the girl to testify.

Kathleen Renz told the Syracuse Post-Standard after the sentencing that she prays daily for the victims and was relieved to learn there would be no death penalty. Her son was living with her at the time of the attack.

Reading from a statement in court last July, David Renz described the crimes and said he did not "fully understand" what led him to attack the mother and child.

Police said he used an air pistol to force the woman to drive her car to a remote section of the parking lot, where he bound both of them and raped the girl.

The girl escaped after her mother fought back and shouted at her to bolt from the car. She was rescued by a passing motorist. Renz was captured nearby a short while later.

Among items found on Renz's home computer were more than 500 video files and 3,000 images depicting young girls being raped, according to court documents.

Weeks after Renz's attack on the mother and child, a report by a federal judge found that probation officers failed to do monthly checks on Renz that would have included inspection of the bracelet. Federal probation officers in Syracuse who were monitoring Renz were fired or demoted.
