Judge: accused child abuser's rights not violated

August 08, 2012 4:53 pm

BLOOMINGTON — Normal police detectives did not violate the rights of a 39-year-old man when he was questioned in November about an alleged criminal sexual assault, according to a ruling Wednesday by a McLean County judge.

Jason Mason, of Normal, is charged with predatory criminal sexual assault and aggravated criminal sexual abuse of a minor boy with whom he is acquainted. Normal police Detective Brian Larimore and Sgt. Nick Thacker questioned Mason on Nov. 17, hours after authorities received the report of alleged sexual abuse.

Judge James Souk rejected arguments from defense lawyer Ron Lewis that Mason invoked his right to have an attorney with him during the police interview.

A video of the nearly three-hour interview was played during Wednesday’s hearing on a defense motion to suppress Mason’s statements. The interview ended when Mason complained that he felt sick with symptoms from a kidney condition. He told officers to stop making accusations that he abused the child, or arrest him.

“When a person says arrest me or let me go home, that’s as clear as it gets” that he wants to end the interview, said Lewis.

Assistant State’s Attorney Karle Koritz challenged the defense position, saying suspects have no right to demand arrest or release.

“Those are not his decisions — those are the police officer’s decisions,” said Koritz.

In his ruling, Souk said the officers handled the questioning appropriately by asking the suspect if he wanted an ambulance and ending the session when Mason complained that he would not answer any more questions. Mason has pleaded not guilty to the charges.

Mason remains in jail in lieu of $15,000.

Jason Mason, 41, of Normal was charged in 2011 with predatory criminal sexual assault, aggravated criminal sexual abuse and distributing explicit material to a minor. The McLean County state’s attorney’s office is seeking to have Mason sent to the Illinois Department of Corrections for treatment as a sexually dangerous person. If a jury finds that Mason is sexually dangerous, the state may not proceed with the criminal charges. His trail is set for Nov. 18, 2013.

BLOOMINGTON — Jason Mason’s pattern of sexual abuse covers two generations of victims who ranged in age from preschool to early teen years, according to testimony Thursday from three young children and their mother at court proceedings to determine if he is a sexually dangerous person.

Two of the children, a girl and a boy both under 10 years old, promised to tell the truth before they answered questions Thursday afternoon via closed-circuit television — the first time the procedure has been used in a sexually dangerous person trial in Illinois.

If deemed sexually dangerous, Mason will be committed to a state program for sex offenders until he is rehabilitated.

The accusations involve Mason’s alleged sexual abuse of his two adopted children who also are grandchildren of his former wife, Debbie Brock. A third grandchild also allegedly was abused during visits to Mason’s home.

The first witness, a boy, had difficulty sitting in his chair but was able to confirm the abuse accusations leveled against his father.
Several times during the questions from Assistant State’s Attorney Adam Ghrist and defense lawyer Keith Davis, the child cried and hid his face. While he said he has lied in the past, he said he was telling the truth Thursday.

In her testimony, the boy’s younger sister described the alleged sexual abuse that occurred when she was 5 and incidents in which, she said, Mason showed pornography. The small, dark-haired girl fidgeted with a pink purse she brought with her to the conference room where the testimony was taken and relayed into the courtroom.

Before Mason allegedly abused three of his former wife’s grandchildren, he molested their mother, according to testimony she offered after her children’s closed-circuit appearance.

The woman, who has six children who all are living with other people because of her legal and drug problems, said Mason molested her multiple times starting when she was in the second grade and continuing until she was an adolescent.

When asked by Ghrist why she allowed her children to live with Mason and her mother after he had allegedly abused her, she said: “I didn’t think he would do it anymore. I honestly thought they were safe. I needed help and my mom was who I trusted.”

A third child, who is under 12, spent about 15 minutes on the witness stand in front of the jury Thursday morning. In short, quick bursts of words, he answered Ghrist’s questions before announcing “I’m just kinda mad because of all these questions.”

The boy said Mason showed him pornography multiple times. When asked to define pornography, the boy said, “It’s about sex.”

In other testimony, the jury watched about 90 minutes of an interview Mason gave to police after his arrest on predatory sexual assault charges in November 2011.

In that exchange with police, Mason said he may have had sexual contact with one of the boys while the child was in bed with him. The contact would have been unintentional, he said.

“If I thought anyone sexually assaulted my son, I would flat out kill them,” Mason told Normal police Officer Brian Larrimore in the interview.

The state has opted to pursue the sexually dangerous person designation in lieu of a criminal trial on predatory criminal sexual assault charges filed in 2011.

The trial will continue Monday with the state’s plans to show the jury interviews conducted with the children at the Children’s Advocacy Center.

What a stupid POS mother.  She's not fit to care for her kids yet she keeps breeding.

She knows her stepfather is a pedophile having lived through it, yet she sends her children into the same abuse!!!

Her mother knows she is married to a pedophile deviate and she allowed it to continue through two generations.

I hope these poor children can get the help they need and be kept away from these two women who put them in harms way.

She trusted her mother!  Yet her mother didn't stop her own abuse, nor the abuse of her children.

What a sick disgusting family.

Can't believe his bail is so low, much too low for what he has done for decades.

They all need to be locked up.
