Police say the abduction of two children from Chadwicks happened
around 7 p.m. Tuesday night at Timothy and Carmella Brown's home on
Church Street.They
say Christine Brown grabbed the kids and put them in a taxi. After that
she allegedly put the kids in another car with her boyfriend. At 10
p.m., three hours later an amber alert was sent out as police believed
Brown was headed back to Texas.
Around 3 a.m.
Wednesday morning, a state trooper in Virginia located her car. Brown
was taken into custody and is now been charged with custodial
interference.
But one question on the minds of many - why wasn't an Amber alert sent out sooner?
Especially since yesterday was the 16th anniversary of Sara Anne Wood disappearing.
"We did not have enough information to get the amber alert running," said Lt. Tim O'Neill of the New Hartford Police Department.
New Hartford Police say they worked around the clock once they learned the children had been allegedly snatched by their mother.
Police
say they needed more information from at least two people who they say
helped Brown abduct her kids, and that the witnesses weren't being
cooperative.
"The key here is - we knew who the
children were with we had a pretty good idea of where they were going,"
Lt. O'Neill said."But we had to get more info to make the amber alert
go."
Once a state coordinator sent out the alert,
police say they got a better idea of Brown's route and eventually
caught up with her in Virginia.
"Fortunately, in this
day and age and in this country, we're coordinated," Lt. O'Neill said.
"And I think last night was an example of how coordinated we are."
And not far from their minds - the disappearance of Sara Anne Wood 16 years ago on Tuesday.
"The
incident was on my mind," Lt. O'Neill said. "It certainly left a
burning desire to get these kids back as quickly and safely as
possible."
A happy ending for Timothy and Carmella, and a bit of hope that all missing children can come home.

Two days after his children were taken from the Mohawk Valley and later found in Virginia, their father still hasn't seen them.
Tim
Brown drove to Rockingham County Virginia hoping to pick his children
up from the Department of Social Services but says he has not been able
to do that. In fact, he hasn't been able to even see them.
County
Social Service director Donald Driver said his department assesses the
children's' safety and one of their first goals is to get them back
home as quickly as possible.
Marcia Marangi is the
aunt of Brown and his two children, Timothy and Carmella. She says the
entire episode has been a nightmare for the family.
"Very
upset more upset I'm glad they are safe and everything which is a
relief, but they just haven't seen their father yet and they are very,
very close to their father, I think they should at least be permitted a
visit," said Marangi.
According to New Hartford Police, Christin Brown remains in custody in Virginia and more charges are possible.
No further arrests have been made but there are two others who allegedly helped with the abduction that may face charges.
No word yet on when Brown could be extradited back to Oneida County.

TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas Empty Re: TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas

The future
of the two children-- taken into Harrisonburg-Rockingham County
custody-- was decided Wednesday in a Rockingham County courtroom, after
last weeks Amber AlertTIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas 2 was canceled in the county.
According to the father's girlfriend, a judge decided to hand custody of the
children over to Christin Brown's father and step-mother. They'll head
back to Texas.

');
The woman's estranged husband spoke "I was in shock, I couldn't even talk to anybody. My family members just held me and told me everything was going to be okay," said Timothy Brown.
Timothy Brown has been working to get his children, Timothy and Carmella Brown, back from
Harrisonburg-Rockingham Child Protective Services custody.
Last week, his estranged wife, Christin Brown allegedly kidnapped the kids
from New York and was eventually caught in the Valley.
As he sits with tears in his eyes, wringing his hands, Brown describes his kids as still in shock.
"It was really hard for me to tell them things, you know, a few questions
got asked, I couldn't answer them, by my son, I just couldn't. After
this they're going to have to go through counselingTIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas 2 again," Brown said.
Court documents, obtained by News 3, show a history of protective order
requests. Christin Brown is alleged to have abused Mr. Brown and his
children.
As the cars and trucks roar past mile marker 240 on Interstate-81 in Rockingham County,
it was 3:30 in the morning that Trooper Robert Lawson pulled Christin
Brown over, a good find, says first Sgt. Bryan Hutcheson.
The Amber Alert says Christin Brown could have been armed with a weapon.
State Police say, posing a threat to people in the Valley.
"You
never know with people like that. Someone like that who is gonna do
what she did, with her history being as it was, certainly a threat,
certainly a threat, you never know when something could trigger and she
could do something crazy or violent to someone else," said Virginia
State Police 1st Sgt. Bryan Hutcheson.
Harrisonburg-Rockingham County Child Protective Services officials tell News 3, a custody
hearing is typically held within five days to re-unite children with
family members.
CPS case facts will be presented, so the judge can determine if it's in the best
interest for the children to be returned to relatives.

The Texas woman accused of abducting her two children from a
Chadwicks apartment Aug. 18 waived her right to an extradition hearing
Wednesday in Virginia. As local officials await her return to Oneida
County, her children have been placed in the care of another relative,
New Hartford police said.
Virginia officials Wednesday awarded temporary custody of 5-year-old
Timothy Brown and 3-year-old Carmela Brown to their maternal
grandfather, who lives in Texas, Officer Peter Colburn said.TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas G113000817e56f91e9ff7694e8246b5bb6b31534e2f82a4
Their mother, 24-year-old Christin Brown, was taken into custody in
Virginia on Aug. 19 after local police issued an AMBER Alert for the
missing children. She is charged with felony custodial interference for
taking the children from the home of their father, Timothy Brown,
although it’s currently unclear which parent had legal custody at the
time.

The name of the grandfather who now has custody was not immediately available.
“There are still custody issues they’re going through down there and
this is the person they saw most fit to have custody at this time,”
Colburn said.
Christin Brown previously requested an extradition hearing and was
scheduled to appear in a Rockingham County, Va., court on Sept. 24
before she changed her mind Wednesday, Rockingham County Assistant
Commonwealth’s Attorney Chris Bean said.
“I think what happened is she just wanted to get it over with,” Bean said.
He estimated Brown’s return to New York would occur within 15 to 30
days. Local police said Brown may face additional charges upon her
return to Oneida County.

TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas Empty Custody Battle about to get underway

Post by TomTerrific0420 Thu Aug 27, 2009 1:46 am

According to New Hartford Police, the father of the two children
abducted last Wednesday from his Chadwicks home, is on his way to Texas
to fight for custody.

Police say Timothy Brown Sr. lost a custody battle over his kids in
Virginia, Wednesday, after a judge order the two stay with their
mother's father and stepmother in Texas. The custody hearing was held
in Virginia because that is where Christin Brown was caught after she
took her two kids from Chadwicks and fled New York State, said police.

New Hartford police officer Peter Colburn says he has been informed by
Timothy Brown Sr., that the disgruntled father left Virginia shortly
after the hearing, and drove to Texas where he will fight for custody
of his two children. Officer Colburn says Texas is the best place to
get the issue resolved because they would have the most background
information on the custody battles between the parents.
Colburn also said Wednesday, that Christin Brown will be facing more charges,
however he would not comment on what those charges will be. Colburn
says Brown waived her right to an extradition hearing so she will be
coming back to Oneida County sooner than later.

An Amber Alert was issued August 18th after 5 year-old Timothy Brown Jr.,
and 3 year-old Carmela Brown were taken from their Chadwicks home.
Christin Brown is charged with custodial interference in the first
degree, a felony.

The Texas woman who is accused of abducting her two children from
their father’s Chadwicks apartment Aug. 18 likely will return to Oneida
County by the end of the week, county District Attorney Scott McNamara
said.
After meeting with the New Hartford Police Department to discuss the
case Tuesday, McNamara said his understanding is that police will
arrange for the extradition of 24-year-old Christin Brown by the Friday
deadline set by officials in Rockingham County, Va.TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas G113000817e56f91e9ff7694e8246b5bb6b31534e2f82a4
The local charges against her could include custodial interference or criminal trespass, he said.
“We will prosecute her on the crimes that she committed that we think we can prove,” McNamara said Tuesday.

Details on the extradition plans were not immediately available from New Hartford police.
Brown’s removal of her 5-year-old son and 3-year-old daughter from
their apartment prompted an AMBER Alert that led to her apprehension in
Virginia the next morning.

Officials learned earlier this week that Christin Brown and the
children’s father, Timothy Brown of Chadwicks, never finalized their
divorce in Texas, and neither had been awarded custody of the children
by a court.

An order of protection that prevented Christin Brown from seeing her
children also had expired at the time of the abduction, but McNamara
previously called her actions “clearly inappropriate.”

The Texas woman who is accused of abducting her two children from
their father's Chadwicks apartment Aug. 18 was returned to Oneida
County this afternoon, New Hartford police Lt. Timothy O'Neill said.
TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas G113000534cf27743721860cac9b8d109b469e3b869e738
Christin Brown, 24, was brought back by representatives from the New
Hartford Police Department and the Oneida County District Attorney's
Office and appeared in New Hartford Town Court at about 4:30 p.m. today.

She was arraigned on four charges: first-degree custodial interference,
second-degree criminal trespass, criminal possession of a weapon and
endangering the welfare of a child. The first charge is a class E
felony, the others are misdemeanors, police said.
New Hartford police Investigator Steve Laymon and District
Attorney's Office Investigator Rebecca Beatty traveled to Rockingham
County, Va., Wednesday afternoon to retrieve Brown from the jail where
she had been held since an AMBER Alert led to her arrest Aug. 19.
"We got her back; we got her arraigned; she's off to jail," O'Neill said.
A new detail revealed by police Thursday is that Christin Brown was
armed with an electronic stun gun when she broke into the apartment of
her estranged husband, Timothy Brown, and took the children from a
babysitter.
Christin Brown's bail was set at $14,000 and she's scheduled to return to court at 1 p.m. on Friday, Sept. 11, police said.

The two children are in custody of their maternal grandfather in Texas
after it was discovered neither the mother nor the father had sole
custody at the time of the abduction.

TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas Empty Re: TIMOTHY and CARMELLA BROWN - 5 and 3 yo - New Hartford NY/Texas

The 24-year-old mother responsible for the county’s first ever Amber
Alert pleaded guilty to trespassing in Town Court this morning.

Christin Brown, of Texas, was sentenced to six months in county jail
after prosecutors dropped the felony charge of custodial interference,
court officials said. Brown pleaded guilty before Justice James
VanSlyke to one count each of second-degree trespass and endangering
the welfare of a child, officials said. The custodial interference was
dropped after it was discovered that neither Brown nor her estranged
husband Timothy Brown Sr. had sole custody of their two children,
3-year-old Carmela and 5-year-old Timothy Jr.

The abduction occurred at about 7 p.m. Aug. 18, while Timothy Brown
Sr. was at work, authorities said. Christin Brown drove up from her
home in Texas, and she went into the father’s home on Church Street,
grabbed the children and took them out to a waiting car, police stated.
The children were in the care of a baby-sitter. Police said Brown was
driving the children back to Texas when they were found and stopped in
Virginia early the next morning.

The Amber Alert was issued because law enforcers said they had
reason to believe the children were in danger. Following Brown’s
arrest, prosecutors had to dig through custody and divorce paperwork in
Texas before they discovered that an order granting Timothy Brown Sr.
sole custody had expired in the spring, giving Christin Brown partial
custody rights.
