"Toddler John Doe" - 2 yo - Lakeland (E of Tampa) FL

Lakeland FL ---- Polk County deputies arrested a Lakeland man on a
charge of aggravated child abuse.
Deputies say Robert Pompo Smart, 26, was baby-sitting a family of
five children on Saturday night while the mother was visiting a friend.
Around 8:00 p.m., deputies say Smart called the mother to tell her
her smallest son, 2, was throwing up.
Deputies say when the mother came home, she told detectives she gave
the boy a breathing treatment and put him to bed.
Then at 5:00 a.m., he complained of pain, so she took the boy to
the Lakeland Regional Medical Center. where doctors say he had suffered a
broken elbow and scapula, along with a pancreas injury and bruised
thigh. Medical staff told her his injuries were consistent with recent
abuse.
The boy's siblings told detectives they had witnessed Robert
"slamming" the victim in the tub. During a post Miranda interview with
Smart, he denied hurting the child.
Smart stated he was at the house with the children when the boy and
two of his siblings were in the bathroom getting ready to take a bath
when, Smart said, he heard the victim crying. Smart told detectives he
went into the bathroom and the boy was not in the tub so he picked him
up and "placed" him into the tub. Smart stated the victim "only cried a
little" at that time.
Smart told detectives the children got out of the tub a short time
later and he and the boy went to the mother's room to get a diaper for
him. While the boy was in his mother's room, he vomited on the floor.
Smart said he picked the boy up and took him into the kitchen where he
forced him to stand over a potty chair because he was vomiting.
Smart told detectives he gave the boy some water and placed him into
his bed at approximately 8:30 p.m. He said the victim fell asleep and
the child's mother arrived home at 9:00 p.m.
Smart was placed under arrest and charged with Aggravated Child Abuse
and booked into the Polk County Jail without bond.
Smart was arrested back in March for drugs, public nuisance and
carrying a concealed weapon.
