DAKOTA LANE - 4 yo/ Home Invasion -(2010) Muskogee OK
A four-year-old boy died after he was stabbed 36 times with a pair of scissors during a home invasion in Muskogee, Oklahoma.
Dakota Lane and his six-year-old brother were sleeping when the attack took place.The boy's mother Stephanie Lane, who is eight months pregnant, tried tofend off the attacker, but her son Dakota died later in hospital.

Aaron Michael Laconsello, 18, was arrested soon after the incident on the campus of nearby Bacone College, on suspicion of first-degree murder, first-degree burglary and assault with a deadly weapon.
According to Corporal Pedro Zardeneta of Muskogee Police, officers were sent to the mother's home on Tuesday night to investigate a report of a mother and small child being assaulted.

He said Muskogee Police officers performed CPR on the child until paramedics arrived.
The boy was first taken to Muskogee Regional Medical Center and then was flown to Tulsa, where he was pronounced dead. Mrs Lane was treated and released by medical personnel at the scene. Dakota's year-old brother was unhurt.Family members said Mrs Lane, who works in the cafeteria at Sadler Arts Academy in Muskogee, did not know the suspect and so far there appears to be no motive for the attack.

Laconsello, who is from Tahlequah, had been living in a house on the Lanes' street in Muskogee for the past few weeks.
'In a criminal action, you usually have some answers. It may not be something that someone likes, but you usually have some answers. We don't have any answers to that,' said Muskogee County District Attorney Larry Moore.
'It's a horrible, horrible tragic incident.'
Pedro Zardeneta said, 'In my entire career, I've never seen anything like this.'
Neighbors say Laconsello and friends often drank at a house near to the Lanes' home, and he had been drinking earlier that evening.
Laconsello's cousin, Colt Hooper, 19, said Laconsello had been staying with him in a house a few doors down from the Lanes.
Cooper added that his cousin had recently been kicked out of his mother's house in nearby Tahlequah.Neighbours and friends have been leaving teddy bears and flowers at the house in Dakota's memory.
Jack Bumgarner, Dakota's grandfather, said: 'It's just so senseless, that a four year old defenseless little boy has to be brutally murdered like he was.'

Holding a picture of her “sweet angel baby,” Tina Lane and others in the packed courtroom watched Aaron Laconsello’s every move as he appeared on camera to answer charges against him.
Laconsello, 18, also known as Aaron Michael Hooper, was formally charged Friday with:
• First-degree murder in the stabbing death of Dakota Lane, 4, in his home. Lane was stabbed multiple times with a pair of scissors.
• Assault and battery with a deadly weapon in an attack on Dakota’s mother, Stephanie Lane.
• First-degree burglary for having entered the Lane home at 705 N. N St., without permission and while it was occupied.
Laconsello said he could not afford an attorney, and Special District Judge Robin Adair said he will ask the state’s capital case indigent defense team to represent Laconsello. Adair set the case for a sounding docket at 9 a.m. Nov. 29. At that time, a date will be set for a preliminary hearing for testimony to be given. Adair ordered that Laconsello continue to be held without bond.
Friday was Laconsello’s second video appearance before Adair this week.
Dozens of Dakota Lane’s family members and friends filled the small courtroom and spilled into the hallway. Many of them wore buttons with Dakota’s picture.
Tina Lane, who asked to be identified, as “Mimi” because that’s what Dakota Lane called her, couldn’t find a seat on a courtroom bench, so she sat in the floor, holding a picture of Dakota. In it, he had a big smile on his face and his hand was alongside his face, as if he had just been told something funny.
It was taken during a trip to a park with his Aunt Dot, Tina Lane said, lovingly touching the little boy’s face in the photograph.
It was not unusual that Dakota was smiling in the photo, she said.
“It didn’t take much to make him smile,” said Peggy Andrews, his great-aunt.
Jack Bumgarner, Dakota’s maternal grandfather, said he and other family members will be in court in support of his grandson every time Laconsello has a court appearance scheduled.
“I will not miss anything, even if there is a change of venue,” he said. “I’ll turn off my truck key and park it if I have to.”
He said he thinks Laconsello deserves the death penalty for his crimes. “I’m an eye-for-an-eye kind of guy.”
District Attorney Larry Moore said the information he has received in the case indicates it meets the criteria for the death penalty but he has not yet filed a bill of particulars seeking it.
Bumgarner said the community’s support of Dakota’s family has been overwhelming. They are holding up pretty well under the circumstances, he said. What the family needs most is prayer.
Stephanie and Chris Lane likely will move from the house because of the nightmarish memories it holds for them.
Wearing a jail-issued orange jump suit, Laconsello showed little emotion as he appeared on jail cameras during Friday’s court proceeding. He wiped his finger across his upper lip two or three times and mostly looked down. He raised his chin only when Adair asked him if could afford an attorney.

Suspect’s mom may face charges

The mother of a man charged with murder could face charges of obstruction of justice after allegedly giving false information to police.
Muskogee County District Attorney Larry Moore said Charity Holmes of Tahlequah, the mother of first-degree murder defendant Aaron Michael Laconsello, allegedly gave false information to a police officer.
Laconsello, 18, was charged in November with the stabbing death of 4-year-old Dakota Lane.
Because of the alleged false information given by Holmes in regard to her son’s part in the killing, a preliminary hearing date for this week had to be postponed.
Police also spent time and money investigating the alleged false information given, Moore said.
He said prosecutors are going over the police report before deciding whether to charge Holmes with either:
• Giving false information to a police officer.
• Obstruction of justice.
• Obstructing an officer.
Meanwhile, Special District Judge Robin Adair has asked for a competency evaluation of Laconsello, Moore said.
“There has already been a determination he is not insane,” Moore said. “A person is assumed to be competent unless proven otherwise.”
He said the competency evaluation would ensure Laconsello has the ability to make decisions.
Laconsello will be back in Muskogee County District Court at 10 a.m. May 31 for a preliminary hearing. At the end of the preliminary hearing, Adair will determine whether Laconsello should stand trial.

MUSKOGEE, Okla. - The man accused of stabbing a 4-year-old to death with scissors pleaded guilty to charges of murder, burglary, and assault with a deadly weapon.
Aaron Michael Laconsello pleaded guilty to 1st degree murder, assault and battery with a deadly weapon, and 1st degree burglary.
Security was tight for the preliminary hearing at the Muskogee County Courthouse Tuesday. It was standing room only as friends and family packed into the courtroom to show support to the Lane family; many of them wearing picture buttons of Dakota and t-shirts with his name and "Justice for Dakota" written across the back.
According to the Muskogee District Attorney, Dakota Lane was stabbed 36 times.
The preliminary hearing began around 11 a.m. Victim testimony and evidence was presented.
Dakota Lane's mother, Stephanie, read an emotional statement to Laconsello.
"There was no reason for what you (Aaron Laconsello) did and we should have never had to go through it. He (Dakota) should still be in preschool being ornery... but he's not and it's all your fault." said Stephanie.
Dakota's grandmother, Tina Lane, yelled at Laconsello for taking away her grandbaby.
"Don't waste your breath by saying you're sorry because Dakota can't hear you!" screamed Tina in the courtroom.
When asked by the judge why he did it, Laconsello simply answered "no idea".
Laconsello has been sentenced to life in prison without the possibility of parole. Dakota's family was hoping for this sentence instead of the death penalty.
"I hope he dies soon in prison... the death penalty was too easy anyone can take a needle." said Lori Bumgarner, Dakota's grandmother.
Laconsello's defense attorney says that they did not have a real defense. To avoid a jury trial and possibly the death penalty, Laconsello pleaded guilty to all 3 charges.
Before sending the defendent back behind bars for good, Judge Robin Adair had one final thought for Laconsello.
"May God have some mercy on you because you will not find any in this life on this side of heaven." said Judge Adair.
Laconsello has 90 days to appeal.
