EDWARD & BRADLEY GARCIA - 1 yo and 3 yo (2011)/ Convicted: Father; Elvis Noe Garcia-Nelasco - Atlanta GA
LAWRENCEVILLE, Ga. -- Two young children were either stabbed or shot to
death and a 4-year-old boy was in the hospital Wednesday night after an
attack at their home in an Atlanta suburb, police said.
A man who is either their father or stepfather also was wounded and in
serious condition at a hospital, police said. Police found the bodies of
the 1-year-old and 4-year-old in the home and the wounded child was
flown to Children's Healthcare of Atlanta at Egleston, Gwinnett County
police Cpl. Jake Smith told reporters near the scene.
He says the wounded child was flown to Children's Healthcare of Atlanta at Egleston.
Police have identified suspects, but no one was in custody, Smith said. He declined to elaborate.
The children's mother was not home and has been found unhurt, he said. Police did not release any names.
The subdivision is in an unincorporated part of Gwinnett County across
from the fairgrounds. Two families live in the home, and the bodies were
found on the bottom floor, he said.
Neighbors said they feel safe in the subdivision, partly because they
pay fees to their neighborhood association for extra police patrols.
"My God, this is crazy," eight-year resident Jimmy Holland told the Atlanta Journal-Constitution.

A
week before the brutal attack on his family, a Lawrenceville man told
police that his ex-girlfriend’s boyfriend threatened to kill him.
Gwinnett County Police
believe that same man stabbed Mr. Elvis Garcia, killed two of his
children and critically wounded another Wednesday inside their home at
1110 Bridle Patch Drive.
Mr. Antonio Cardenas-Rico, 23, is being held without bond in the Gwinnett County Jail on two counts of murder in the deaths of Edward and Bradley Garcia, 1 and 3 years old, respectively, police spokesman Cpl. Jake Smith said.
Still, the name of the accused is listed in the police reports as Mr. Patrick Cardenas.
“We believe it’s the same person and we are working to confirm that,” spokesman Cpl. Edwin Ritter said.
On Feb. 2, Mr. Garcia told police his ex-girlfriend’s boyfriend called and threatened him.
Mr. Garcia and his ex-girlfriend were feuding over the children
because Mr. Garcia, concerned about drug activity, did not want them
around Mr. Cardenas.
After the voice on the other end said, “’I will kill you,’” Mr.
Garcia packed up his children and went to his sister’s house, according
to the police report. He then reported the call to police.
But there were no recording or a witness to the threat. And there
were no further calls to police until about 6:30 p.m. when Mr. Garcia
called to report that someone had killed his children.
It’s still unclear how the attacker entered the home and the chain of events that night.
And police don’t know what the family members were doing when they were attacked.
Three-year-old Bradley’s twin brother was in critical but stable
condition at an Atlanta children’s hospital. Mr. Garcia, 23, was in
stable condition at Gwinnett Medical Center, Cpl. Smith said.
Police anticipate there will be more arrests in the case, but provided no further details.

LAWRENCEVILLE, GA -- Gwinnett County Police have arrested the father
who claimed that another man stabbed and killed two of his sons on
Wednesday night inside their Gwinnett County home.
Elvis Garcia-Nelasko was booked into the Gwinnett County jail on
Saturday morning and charged with two counts of murder and one count of aggravated assault.
At the same time, police dropped murder charges against
Antonio Cardenas-Rico, 28, the boyfriend of the children's mother.
Garcia initially told police that he was also wounded in the violent
attack that left two of his sons dead and another son critically wounded.
One-year-old Edward Garcia and 3-year-old Bradley Garcia were killed.
Bradley's twin brother was flown to a children's hospital in Atlanta in
critical condition. Garcia was taken to Gwinnett Medical Center in serious condition.
Earlier this week police chaged Cardenas-Rico with the murders at
1110 Bridle Path Drive in Lawrenceville. The murder chargers against
Cardenas-Rico have now been dropped, but he remains in jail on drug and immigration charges.
Neighbors told 11Alive News the children's father ran across the street
to a neighbor's house to call 911 at around 6:30 p.m.
Police said he told 911 there were two children dead in his home.
When police arrived, they found all three kids in the basement. Their
mother and sister were not home during the attack and were not hurt.
Investigators said Rico, the first man arrested, reportedly
threatened to kill the children's father just eight days earlier.
On February 2, Garcia told Gwinnett County police that he got a phone
call from a man investigators now identify as Antonio Cardenas-Rico.
According to police reports, Garcia talked to police twice that day,
in fear for his life. Over the phone, "Mr. Garcia stated that the
suspect said 'I will kill you'," according to the police report narrative.
The February 2 report goes on: "Mr. Garcia stated the suspect is
upset because Mr. Garcia and ex-girlfriend are feuding over the children."
Garcia's attorney, Christopher Taylor, issued a statement on Friday:
"Our hearts are forever broken, and we are left without words to
describe the horrible tragedy that has entered our lives. We loved
Bradley and Edward with all our hearts and we are trying our best to
cope with this situation. We still cannot understand or explain this
tragedy. Our prayers are with Joshua, who is fighting for his life, and
we ask everyone to remember him in your prayers. His life is in God's
hands now and we trust in God's will."
Garcia's attorney said he plans to comment on his client's arrest sometime Saturday afternoon.

Re: EDWARD & BRADLEY GARCIA - 1 yo and 3 yo (2011)/ Convicted: Father; Elvis Noe Garcia-Nelasco - Atlanta GA
Officials had an early inkling that Elvis Garcia — the Lawrenceville man now in custody for the
alleged murder of two of his young children — may not have been telling the truth.
Noe-Garcia told police that the man they originally
arrested, 28-year-old Antonio Cardenas-Rico, had attacked him and his
three boys Wednesday evening, stabbing all of them at their home near
the Gwinnett County Fairgrounds.
Two of the children, ages 1 and 3, died at the scene,
and another remains in critical condition. The stab wounds on the chest
of Garcia himself, though, raised the eyebrows of medical examiners
early on, District Attorney Danny Porter said Monday.
“As early on as Thursday morning,
there was some suspicion by medical personnel ... that gave some
indication that the wounds may possibly be self-inflicted,” Porter said.
Following a press conference regarding an unrelated
matter Monday, Porter and Gwinnett County Police Chief Charles Walters
discussed the Garcia case, detailing the events that led to
Cardenas-Rico’s arrest and exoneration, as well as the ultimate
incarceration of who they believe to be a murderous father.
Initially, Cardenas-Rico was arrested on a variety of
evidence, including the statement of the “victim” (Garcia) and cell
phone information that put him near the murder scene, Porter said.
“Based on the initial information, (Cardenas-Rico)
had motivation,” Porter said. “When he was arrested he was not nearly as
truthful as he wants you to believe today.”
With Porter along as a legal consultant, police
executed a second search warrant at the home on Bridle Path Drive on
Friday night. It was then they say they found evidence disproving
Garcia’s telling of the events that night, facts having to do with
“point of entry and the locations of the victims,” Porter said.
While cell phone records did pinpoint Cardenas-Rico’s
rough location accurately, surveillance videos showed him at “several
different locations” in the nearby area of Ga. Highway 124 and Sugarloaf
Parkway that night, including stores, gas stations and an ATM, officials said.
One video tape captured him at a different location
during the approximate time of the murder, which occurred at about 6:30 p.m. Wednesday.
“We didn’t make a mistake here,” Walters said. “We
acted on the best information available at the time, and we corrected it
when we found that there was evidence to the contrary.”
Cardenas-Rico, who remains in custody on charges of
possession of marijuana with intent to distribute, told WSB-TV in a
jailhouse interview that he believed he was intentionally framed.
“I would never hurt a child,” he said. “Why would he
do that to his own family, his own kids, his own self? Why was he trying to set me up?”
When Garcia was confronted with all this information
Saturday, Porter said, he made a statement and was placed under arrest.
The father now faces felony charges of murder and aggravated assault.
Garcia had a history of several minor arrests in
Gwinnett, including one just three weeks before 287(g) — which has the
power to deport illegal immigrants after they have been arrested — went
into affect in the county in November 2009.
Garcia is believed to be an illegal immigrant.
The murder weapon, a kitchen knife, was recovered at the scene.
Few details have been confirmed about the supposed
relationship between Cardenas-Rico and the mother of the murdered
children, Garcia’s ex-wife. Porter said Monday that Garcia “at least
believed they were involved in a relationship.”
Garcia had filed a report with police the week prior
to the attack, claiming a man named Patrick Cardenas-Rico was out to kill his family.
Neither Porter nor Walters were able to confirm the
veracity of that specific report, but there was a history there, Porter said.
“I can’t say with certainty those threats occurred,
but they weren’t friends,” he said. “There had been threats going back
and forth across the Internet.”
Porter said Monday that, given the nature of the
crime, pursuing the death penalty against Garcia is something he would
consider. He defended the efforts of police officers and investigators,
calling accusations that Cardenas-Rico was arrested too hastily “simply wrong.”
“I think it would be wrong to characterize this as
‘arresting the wrong guy,’” Porter said. “The person who was initially
arrested did not commit the crime, but evidence at the time pointed to him.”
“We arrested the person the evidence led us to, until the evidence didn’t lead to him anymore.”

Man pleads guilty to stabbing three young sons
Posted: 11:49 a.m. Tuesday, May 14, 2013
By Andria Simmons,
The Atlanta Journal-Constitution
A Lawrenceville man accused of stabbing his three young sons, killing two, and then blaming the attack on his ex-girlfriend’s new boyfriend pleaded guilty to murder charges Tuesday in Gwinnett County.
Elvis Noe Garcia-Nelasco, 25, was sentenced by Chief Superior Court Judge Melodie Snell Conner to life in prison. Gwinnett County District Attorney Danny Porter said that Garcia-Nelasco would be eligible for parole in 30 years. And since the Honduras native who worked as a roofer is in the country illegally, he will likely face deportation if he is released.
Garcia-Nelasco called 911 on on Feb. 9, 2011 and said his children were stabbed and that he had been stabbed in the heart by the boyfriend of the boys’ mother.
In a grisly crime scene that startled even seasoned detectives, 3-year-old Bradley Garcia and 1-year-old Edward Garcia were found dead in the basement apartment of the house they shared with another family on Bridle Path Drive near Lawrenceville. Bradley’s twin brother, Joshua, was hospitalized in critical condition.
Cardenas was initially arrested and charged with murder after being pulled over and arrested in a traffic stop. However, he was exonerated and freed when financial records and surveillance footage from a local convenience store and a bank ATM proved he was elsewhere at the time of the stabbings.
The focus of the investigation turned to Garcia-Nelasco when detectives noticed inconsistencies in his statements and when a medical examiner determined that his stabbing wound may have been self-inflicted.
Detectives who interviewed Garcia-Nelasco at the hospital for over two hours finally obtained a confession.
In court Tuesday, Garcia-Nelasco apologized to three sisters who were seated side-by-side on a courtroom bench behind him and asked the ladies to care for his surviving son, who has fully recovered from his injuries. Garcia told told his sisters to tell his mother, who is in Honduras, that he loves her and assured them in Spanish “I will be fine.”
Garcia has been held in the Gwinnett County jail without bond since February 2011.
