Mom, Boyfriend Arrested In Tot's Violent Death
2-Year-Old Not Breathing When Paramedics Responded

ALBUQUERQUE, N.M. -- Albuquerque police have arrested a mother and her boyfriend in the violent death of her 2-year-old son.
Elizabeth Martinez, 22, and Domenic Howe, 27, were charged with child abuse with great bodily harm resulting in death.
Neighbor Rick Thompson said he saw the child Wednesday night, and said the boy was lifeless.
"They tried to resuscitate him for 20 to 30 minutes, but you couldn't do nothing," Thompson said.
Police said Howe called 911 Wednesday night and said that the boy had drowned. But when paramedics arrived at 1000 Louisiana SE, they noticed that the child was dry and looked like he had been beaten, police said.
A criminal complaint said the boy had abrasions on the right side of his face, burns on his left ear, and cigarette burns on his hands.
Detectives said Howe told them he was wrestling with the boy on the bed when he jumped into the air and came down on the boy with his elbow.
Howe told them he hit the boy "harder than I should have," according to a police report.
Howe also told investigators that, while the 2-year-old was lying on the floor on his hands and knees, he kicked the boy so hard that he flew head over heels and then slid across the floor, police said.
Police said Howe also told them the boy knocked over a lamp while he was vacuuming, so Howe pressed the hot light bulb to the boy's chest and then ran the vacuum over the boy's stomach.
Investigators said Howe told them that he hit the child about 20 times since December.
New Mexico Children, Youth and Families Department Secretary Yolanda Deines said veteran investigators were calling the incident the worst case they've ever seen.
"It's just tragic, and it is horrific to imagine what that child may have gone through during the last four months," Deines said.

Howe and Martinez are being held on $100,000 bail.

An Albuquerque man was sentenced to life, plus 18 years, in prison for beating his girlfriend's 2-year-old son to death in April 2011.

Dominic Howe pleaded guilty Wednesday to child abuse resulting in death. He and his girlfriend, Elizabeth Martinez, were arrested in 2011 for the abuse. Martinez is accused of knowing of the abuse and not reporting it to officers. Her case is set for trial October 6.

Howe called 911 that April day and told dispatch the boy had drowned in the bathtub. The boy died later at UNM Hospital, but not from drowning. Investigators say the boy succumbed to injuries including multiple bruises, burns and internal injuries.

Howe admitted he threw the boy across the house, burnt him, ran over him with a vacuum and hit him multiple times, all while the boy's older brother and younger sister watched.

Howe will be forced to register as a sex offender as well.

The mother of a 2-year-old boy who died after the woman's boyfriend threw the boy across her house, burnt him, ran over him with a vacuum and struck him repeatedly did not enter a plea Thursday for multiple child abuse charges. Her case will go to trial October 6.

Elizabeth Martinez faces nine counts of 1st-degree felony child abuse, 15 counts of 3rd-degree felony child abuse, three counts of criminal sexual contact with a minor under the age of 13 and two counts of 1st degree felony kidnapping.

Martinez's boyfriend, Dominic Howe, pleaded guilty to similar charges Wednesday and was sentenced to life, plus 18 years, in prison for the April 2011 death.
