In Jeff Ashton’s Motion of Limine As to Testimony of Mental Health Experts he asks the Court to prohibit any reference to or mention of the finding or opinions of Dr. Jeffrey Danziger or Dr.William Weitz until their testimony has been proffered before the court.
1. Doctors Danziger and Weitz were first listed as witnesses in the defendants motion for leave to file additional witnesses file with the courts 21 March.
2. Reports of both the experts were provided to the State of FL on 25 March.
3. Both the above reports and motions reveal that the testimony does not relate to a legal defense to any of the charges contained in the indictment.
4. Reports indicate that the opinions of the experts are based entirely upon statements made to them by the defense.
5. These reports DID NOT diagnose the defendant as suffering from any clinical or personality disorder as recognized by the American Psychiatric Association.
He writes that it will be impossible for this court to fully litigate the issue of the admissibility of the proffered testimony pretrial. The admissibility of these opinions will be wholly dependent upon the testimony of the defendant. There exists substantial issues as to the admissibility of the opinion even if the defendant does choose to testify. READ the motion
