ORANGE COUNTY, Fla. (WOFL FOX 35) - A judge in the case against Casey Anthony has denied a request by the defense to exclude evidence gathered in the investigation into the death of her daughter, Caylee Marie.
Circuit Judge Belvin Perry, Jr. ruled Thursday against a defense motion to exclude any mention of a stain found in the trunk of Casey's Pontiac Sunfire during her murder trial next month. In addition to the staining, Casey's attorneys had asked Judge Perry to throw out some of the state's evidence against her, including tests done on air samples collected from the car.
In his order denying the motion to exclude irrelevant evidence, Judge Belvin Perry, Jr. wrote that Anthony, "bears the burden of proving the facts alleged in her motion and justifying the relief requested." Judge Perry continues that Anthony, "did not present any factual evidence at the hearing in support of the grounds alleged in the motion, and therefore failed to meet her burden of proof."
