Casey Anthony: Judge’s rulings are setbacks for defense

“Three setbacks for Team Casey,” WESH-Channel 2 anchor Martha Sugalski said in introducing the headlines this afternoon.
WESH’s Bob Kealing listed Chief Judge Belvin Perry’s decisions in the Casey Anthony case: Perry will allow testimony about the single hair with the dead band in the car trunk, evidence and testimony about cadaver dogs that alerted on the car and the family’s yard, and evidence about heart-shaped sticker residue on duct tape found with the toddler’s remains.
Anthony is charged with first-degree murder int he death of her daughter, Caylee. Jury selection begins May 9.
WFTV-Channel 9’s Kathi Belich noted that Perry is the first Florida judge to allow the post-mortem hair-banding evidence in a criminal case.
“This is devastating because it puts Caylee’s dead body in the trunk of Casey’s car,” WFTV legal analyst Bill Sheaffer said.
On Central Florida News 13, Adam Longo ticked off that prosecutors will be able to use the heart-shaped sticker residue, K-9 alerts and the hair with signs of decomposition from the car trunk. Longo highlighted that Perry hasn’t ruled on the air samples from Anthony’s car or testimony from the prosecution’s plant expert.
“A bunch of different evidence ruled on today by the judge as far as what will be in in the case against Casey,” Longo summed up. “So far, everything that he’s ruled on has to been to deny the defense motions.”
Retired Circuit Judge O.H. Eaton Jr., WESH’s new legal analyst, cautioned that the state must establish a foundation for the evidence before it can be admitted.
WOFL-Channel 35 turned to attorney Hal Uhrig for analysis. He said Perry’s rulings weren’t surprising and that one wasn’t more important than another. “It’s the cumulative effect,” Uhrig said. “The state is going to have a parade of witnesses. … The hair and the canine — they support each other. What they now have is a better arsenal of weapons to use in their overall argument there was a dead body in the car.”
Uhrig said he didn’t expect more blockbuster rulings from Perry. “It’s now business as usual, let’s put a jury into place and let’s see what happens,” he told anchor Bob Frier.
