Day 8 begins with 17 retained potential jurors:

1340 - Male - middle age, white married w/ 7 yr old; manager, seems to want to be on jury

1232- Male - works for St. Pete times delivery - married w/kids no health/religious issues. Some impact on family, but wife could handle it. Not a gadget guy.

1129 - Male - hardship for work - insurance compliant analyst - only paid for 15 days - could use vacation - single - 60's

1398 - Female - volunteer counselor - retired - married - allergic to fragrance, trip north 29th June planned (tentative) - does not like interstate driving - 70s

1312 - Female - no hardship closing for home, can be accommodated. In divorce proceedings. Wedding at end of June. Not important enough to attend. Nobody to take care of. Works at hospital, would be reimbursed for Jury Duty

1019 - male - African American, no hardship, no financial, medical, family, employed IT, employer won't hassle for time off, thinks he will be paid

1055 - female - 20s - no hardship, has family, no children, husband no objections, student on summer break until August

1319 - female - hardship. Doesn't want to judge. Feels religious beliefs prevent her from serving. No financial, medical, family issues prevent her from serving. (African American)

1407 - male - no hardship. Unemployed, lives at home. Goes to school.

1251 - Female - exp. hardship; is an elementary teacher - school ending but not at end of year yet; is a DROP retiree - needs to get paperwork done

1429 - Female - no hardship; has no computer!; retired; only med is diabetic

1119 - Male - no hardship; no financial hardship

1025 - Male - exp hardship; wife unemployed; 2 small kids; is a chef consultant; will be paid ; no medical concerns

1007 - Female - will experience hardship; will be paid from work; takes daily medication that affect her memory but not sure how they would affect her memory on a trial

1426 - Male - has no hrdshp; sounded young; will be paid by work; no medical concerns

1159 - White male in his 30's, married, wife employed, one child.

3397 - Male - exp hardship; is a trader for Raymond James; paid by work; had back surgery last fall needs to stand and walk frequently

Going into today the Defense had exercised two (2) peremptory strikes. State had used two (2).

#3308 - Male - city worker, will be paid; has vacation to grandma's and baseball tickets; married- instructed to call airline about refundable tickets - Delta will provide full refund and Judge Perry will get Brewers tickets

#3015 - Female - no hardship; no family or financial; medical, needs labwork done once for kidney transplant; HHJP asks about "any" lab and there's no problem; will be pd by work;

3185- Male - no financial, family, medical hardship, nephew getting married May 22 (?),

#3238 - Female - no hardship; no financial, family or medical concerns; does not care for any one ; no health issues,

#3190 - Female - business owner w/ 8 employees; could be done, finding someone to cover; Instructed to "free up" 8 weeks concerning business - will be given wide access for her to field calls for her business, will not be completely "cut off"

#3054 - Female - no hardship; has house sitter; lives w/ family in MIL apt; son was crime victim 15 yrs ago - armed robbery; will be paid by work (according to policy) but has not verified; is a therapist

Has letter from employer.

Only therapist to do the work she does in Pinellas county.

State recommends she be dismissed for hardship to patients.

Defense no objection.

Juror excused - hardship.

#3038 - Female - no hardship; no financial, family, medical hardship; will be pd by work;

Not arrived yet.

#3206 - - Female - no hardship; is unemployed & has no young kids; has been married for 42 years and NEVER stayed away from husband; lived sheltered life

Juror excused - pre-conceived notions of guilt.

Remaining 11 retained jurors are on their way. As soon as we have 12 Judge Perry will swear them in.

This afternoon's jurors are being brought in early.

Has found out her employer will only pay 1 week for jury duty.

State wanting to clarify record on PJ #1319. Asking for reconsideration of peremptory strike.

Burdick reading from court transcript. Faith prevents her from consideration of judging defendant/DP.

Judge wants original grounds.

Burdick replies inability to sit in judgement - with more detail from record.

Judge Perry says others gave answers and were rehabilitated. Go on.

If witness had not equivocated, then we would have sought a cause challenge. We believe this is a legitimate, race-neutral peremptory challenge. PJ stated hardship was to judge another individual. No argument from defense on behalf of PJ.

Bozo objects on procedure. Judge stated no challenges for cause today. Wants transcripts of 1129, 1011, 3119 and 3397, previous challenges for cause. Reiterate arguments. Believes PJ didn't want to judge based on gossip, answered she could determine guilt or innocence based on evidence. Decision lies with the Judge.

Nothing more from Ms. Burdick.

Judge Perry says record is clear. State did not claim concern about juror hanging the panel. Juror was never asked what changed her response. Baez has a point. Not going to be opened to be argued over and over again. Stands by prior ruling.

State's peremptory strike of #1319 remains denied.

After lengthy discussion by the State, Judge Perry asks for challenges.

3038 - Juror went to work instead of reporting.

She did not know who to speak to.

Judge mentions he was called last evening. Didn't speak of hardship.

Judge asks about payment.

PJ responds no, not through 90 days.

Judge says this will impose a financial hardship.

PJ answers yes.

No inquiries from Defense or state.

Judge moves to excuse fro cause - financial hardship.

Defense exercising peremptory strike 1251, seat 22.

Burdick for State replies she is a member of protected class, female , and opposes strike. Has case law from US Supreme Court.

Bozo recognizes she is female, offers gender-neutral reason. Juror has daughter 2 yr. old granddaughter. Could not consider mercy, age as well.

State asks for moment. Believes that is a pretext to strike, other jurors have children and other jurors have answered similarly as to mercy and age.

Judge allows peremptory challenge, 1251.

#3158 - Male - hardship; will be paid by work; is a little league umpire/coach; has sleep apnea/narcolepsy last episode was over a year ago

Juror can not presume her innocent.

Before the 12 are brought in for swearing Bozo for the Defense objecting to current procedure the Court is using. We have no idea what lies ahead. Miss Anthony cannot participate in the selection and listen to the questions and answers of the remaining panel.

Feels bad about it, the situation.  She's been praying for the mother, for mercy.  Doesn't want to be a part of it.

Bozo no challlenge.

State challenges for cause based on feelings for defendant, praying for her, and the statements that she can't listen to all the evidence.  She feels bad about the situation and it could inhibit her participating.

Defense cannot in good conscious object.

Excused for cause.
