Re: Trial Coverage and Discussion Only - Jury Selection Day 10 - May 19, 2011
Judge Perry wants the attorneys to consider we have 11 PJs remaining. There are other jurors in the jury room. Their summons runs out tomorrow. Pinellas Co. does not bring in jurors on Friday. Think about that.
Ashton for the State questions that number, 11. He believes 12 remain.
Judge Perry lists 11 by seat/juror number. Those are the retained PJs. Agreed.
12 PJ remain to be questioned. A juror who has been ill has returned.

#3131 - Female - has London vaca & house sch for 7/14 (HHJP "we'll be done by then); works for school board, equipment dept mgr; will be pd for only 15 days, needs super. apprvl for add'l time. Asked to check with school board about job and pay
Believes she is guilty. Made snap judgement. Maybe she didn't act alone, but her actions did not portray an innocent mother distraught for her child.
Judge asking if she can lay that opinion aside and render a verdict solely on the evidence and the law.
Juror cannot. She feels very strongly about this.
State and Defense: No inquiry.
Juror excused for cause; pre-conceived notion of guilt.

No notion of guilt or innocence.
No opinion on DP. Necessary option. With proof beyond a doubt or he couldn't vote for it.
Trained as a corrections officer, but never applied, no jobs available.
Defense has sidebar question for PJ.
No challenges. Juror is retained!! (12!)

Has heard about the case. Opinion of guilt from what he's read. Can set his opinion aside and judge her fairly.
Can't impose the death penalty. After questions from Judge says he could consider it, and not automatically say no. He could adapt, but it would be difficult to do.
Judge asks if he would automatically vote against DP without going through instructions and weighing process?
PJ: No
Would you let your views impair your ability to fairly judge the defendant's guilt or innocence in the first phase of guilt or innocence?
PJ: No
Had uncle in the FBI, retired 5 years ago. No adverse opinion of LE.
Retained! (13)

Re: Trial Coverage and Discussion Only - Jury Selection Day 10 - May 19, 2011
The judge reminds the attorneys he needs to tell the jury assembly people something by noon today.
At about 11:55 I need to let the jury room know something. All other judges do not need jurors. If we get jurors it will be done a bit differently. I will bring a panel up here for the purpose of alternates. I will ask right out of the box with everyone present if anyone will suffer a financial hardship. When the hands start going up it is like a self contained virus in an airplane. Every one gets it. We can cull out everyone who has a cold and get rid of them right away. I will let them go home. Think about that – I would have done it separately but time does not permit that. I will probably conclude questioning as close to 5:00 or shortly thereafter unless you all want to forge ahead. Based upon that, tomorrow morning I eill have those that remain all brought in and I will proceed to swear the jury. I will swear 12 first. The first 12. Prior to that as you know you have the right to exercise backstrikes. What would currently be the last juror now that we talked to 3016 is currently in alternate 1 position if you knock someone off the 12. I will make a determination before COB today as to the number of alternates. If I say 5 or 6 or 8 that means you get that number of challenges. Once you exceed whatever number I have indicated you will have those challenges for cause. Think about those things – that’s where we are headed. You will have a chance to give your input at noon.

The 14 are going to be going home to get ready for transport on Sunday.
Judge will decide on target number for alternates before they leave today
Lunch recess until 1:30.

Judge asking for guidance. He will read the preliminary instructions he gives. Do you want it abbreviated?
Charging statement? Not reasonable doubt at this point in time.
Defense would like charges abbreviated and reasonable doubt emphasized. Mason points out that Judge said "unfortunately, that's not the law" when referring to the DP.
Judge says OK, then we're going to bring them in. We'll do it row by row.
Court in recess until potential jurors are brought in.

Judge Perry addressing new PJs. Introducing attorneys, asking if they are known to the jurors.
Bozo introduces Casey as "Casey Marie Anthony".
Judge introducing other Court personnel, giving instruction.
Now reading charging document. Casey seems much more composed today than during previous readings.
Following more instruction to the new PJs, Court is in recess.

Holds no opinion of defendant's guilt, no issue with legal process, can follow instruction.
State no questions
Bozo for duhfense, what did she hear in 2008. Just that there would be a trial.
Bozo asks do you know child's name.
Is into sports, other ways to occupy time. History, craft shows.
Bozo asks about criminal case shows.
Maybe on History channel, Military channel,
PJ says she's a weaver and a spinner, spinning wheel, makes yarn. FB for cousins, casual user.
Aware of DP, no real opinion, a part of laws. No position.
PJ will not have problem with DP/LWOP.
State: NO questions.
Finnell for the duhfense questioning about second phase, DP issues, public opinion, mitigating factors, etc.
Continuing after recess with general voir dire.
Burdick questions for the State: 2 boys 22 and 25. Husband Boor's head distributor, previous butcher. She is a surgical tech(?). Started working in HS then College and got married. Medical field over 30 years. 25 yr old live with her. Works at American Eagle. 22 UCF grad, entering military. Served on jury in civil case. (Thanks J_A_M!)
No challenges. Juror retained! (15)

#3178 - Female - no hrdshp; no financial, family, medical concerns; is self emp but DH has a good job; no summer plans; grown children; 21 yo child can care for pet; against capital punishment
Some knowledge of case, 31 days, discovered the child, remembers hearing parent may have done something to her (Casey) as a child.
Basically she thinks she (Casey) did it. Says she can absolutely set aside her opinion.
She is against the death penalty. (Sounds determined) Can she set aside her feelings? Nothing would change her mind.
Would that view prevent her from finding the defendant guilty. No, not at all.
Would you automatically vote against the DP regardless of instruction? Yes, she would vote against it. Can't imagine a situation where she would, even in the case of her own children.
State and Defense: no questions.
State: challenge for cause; DP
Juror excused for cause - inability to impose DP.

4 remaining PJs plus maybe 8 new PJs to question tomorrow.
Mason having had experience, requesting supervisory ability that the State give us an order of witnesses to be called the next day.
Judge does not have that authority to do that.
Mason complaining about lack of resources.
Judge says he's seen more people on his side of the room. Judge says you need to have whatever files you need there. They (the State) may volunteer that info. Only requirement is that witness be on the witness list.
Mason aid not enough room for files. Speak to Mr. Digit
Bozo says more notice of group of 20?
Judge says you're speaking to the wrong person. I can try to find more space. Suggests digitizing.
Bozo: may need to delay based on who the State calls next.
Other issue is opening statements, demonstrative aids. Miss Burdick suggests asking Judge Perry.
Burdick asks if Judge Perry is opposed to visual aids.
Burdick says, photos, audio and video that would later be introduced.
Judge wants to know exactly what they are talking about. If you agree, then I doubt will not have a problem with it. If you disagree, I have to preview it. That will necessitate a hearing. Jury is walking in at 9:00.
Burdick wants to clarify that they may use evidence that will be ultimately introduces as evidence.
Judge can't rule, he doesn't write blank checks. If you agree, and stipulate to item, and Miss Anthony agrees I have no problem with it.
Burdick says we've talked but not shown each other.
Judge Perry will only be at the courthouse Sat. afternoon and Sunday afternoon around 4 or 5 o'clock.
Discuss it. If it's very short 8:00 Am Monday morning, 7 minutes each.
Anything else? Scheduling in back.
Court in recess til 8:30 tomorrow morning!

Casey Anthony Murder Trial: Jury Selection Day 10
Excerpt:
Casey Anthony entered the courtroom at 8:23 wearing a casual white top.
Jose Baez was seen flitting around the courtroom, conferring with people and Casey.
Then, Casey got busy, jotting down juror numbers from a paper that Dorothy Sims had nearby. It appeared that we were on for jury selection this morning.
As Judge Perry entered the courtroom, Casey straightened the neckline of her top so it looked closed.
Judge Perry discussed some details about the situation. There were 11 more jurors present and the defense had 1 strike left and the prosecution 3.
He asked the defense and the state whether 4 jurors with financial hardships should be called. They decided that jurors 3025, 3317, 3340, and 3309 would be excused for financial hardship.
3131 was the first juror to be called. She had been ill for the last couple of days.
Prior to this juror's voir dire, Perry pointed out that this is the last day that the jurors have been summoned. There will have to be action taken by noon today.
