Casey Anthony: Are things looking up in jury selection?

The 10th day of jury selection in the Casey Anthony case was the top story on noon newscasts.

“It’s looking good for a jury of 12,” Kathi Belich of WFTV-Channel 9 reported. She noted that 14 jurors had been seated but not sworn and that Chief Judge Belvin Perry would try to get through questioning of remaining potential jurors.

“There’s a renewed sense of purpose and optimism,” WESH-Channel 2’s Bob Kealing said, because Perry wanted to swear in the 14 retained on Friday afternoon.

WKMG-Channel 6’s Mike DeForest said that Perry seemed to “partially side” with Anthony’s defense team after the attorneys complained about jury selection yesterday. “Instead of picking the first 12 jurors, swearing them in and then picking alternates, looks like the judge is going to allow the pool to grow a little bit larger before swearing them all in tomorrow,” DeForest reported.

DeForest noted that defense attorney Jose Baez never discussed the reason for his mysterious absence from court on Wednesday in Clearwater. DeForest said that Baez gave no indication of being ill.

Kealing said that Baez would not discuss “his so-called private matter that ended court abruptly” on Wednesday. Kealing highlighted that Anthony “greeted him [Baez] with a smile and asked ‘how ya doing?’ ” and a member of the prosecution team said, “I’m glad you’re better.”

Judge O.H. Eaton Jr., WESH’s legal analyst, said it wasn’t a good idea for Perry to swear in jurors before the alternates are chosen. “He’s going to be skating on thin ice if he does that,” Eaton said of Perry. “The Florida Supreme Court requires the lawyers to be able to see who’s going to be on the 12-person jury and who are going to be the alternates before they’re all sworn in. The reason for that is that the lawyers have the right to back-strike in the original 12 until the entire panel is sworn.”

But Eaton added, “I’m sure Judge Perry understands that and he’s not going to swear in the jury until he gets all his alternates.”

Perry said he wants opening statements to start Monday in Orlando. Anthony is charged with first-degree murder in the death of her daughter, Caylee.
