Hearing set in lawsuit over missing Indiana University student.

LOUISVILLE, Ky. (WDRB) -- A hearing has been set in the lawsuit over a missing Indiana University student.

On December 2nd, a federal judge at the federal courthouse in Indianapolis is expected to hear the motion to dismiss the lawsuit filed by the parents of Lauren Spierer.

It claims that fellow IU students gave Spierer alcohol, then failed to make sure the 20-year-old made it back to her Bloomington apartment safely after a night of partying in June 2011.

Lawyers for Corey Rossman, Michael Beth and Jason Rosenbaum say the Spierers have no evidence their daughter is dead, and that they weren't responsible for the safety of an adult.

The mother of an Indiana University student who vanished in 2011 says she's frustrated by a judge's decision to dismiss a civil lawsuit against one of three men who saw her daughter the night she disappeared.

Charlene Spierer (SPEER'-ur) tells The Indianapolis Star that she hopes Judge Tanya Walton Pratt rules differently in the cases of the other two men named in the lawsuit.

Lauren Spierer was 20 when she disappeared June 3, 2011, after partying with friends in Bloomington. Her parents argue the fellow IU students gave their daughter alcohol, then failed to make sure she got home safely.

No one has been charged in the Greenburgh, N.Y., native's disappearance.

Charlene Spierer says she hopes the cases against Corey Rossman and Jason Rosenbaum move forward.

Men deny responsibility in Lauren Spierer disappearance

Attorneys for two men who were with a 20-year-old Indiana University student before she went missing in 2011 contend in court filings the men were not responsible.

The parents of Lauren Spierer filed a lawsuit last June in U.S. District Court against former IU students Jason Rosenbaum and Corey Rossman, saying they owed her a "duty of care." The Indianapolis Star reports attorneys for Rosenbaum and Rossman deny the allegations in documents filed Monday.

Rossman and Rosenbaum point blame at Spierer and the bar where was seen drinking hours before she disappeared, although the bar is not a party to the Spierers' lawsuit.

Rossman said he "had no control or right of control" over Spierer, who disappeared June 3, 2011, after partying with friends in Bloomington.

Federal judge dismisses Lauren Spierer lawsuit

Despite another setback, Robert and Charlene Spierer say they will never give up seeking answers about what led to the disappearance of their daughter, Lauren, more than three years ago.

A federal judge on Tuesday dismissed the civil negligence lawsuit the parents filed against two men who were with Lauren the night she disappeared in Bloomington.

"Disappointment does not mean defeat," the parents wrote in a Facebook post after IndyStar.com reported the suit's dismissal. "We remain dedicated to finding the answers behind Lauren's disappearance and having justice served."

In a 20-page ruling issued Tuesday, U.S. District Judge Tanya Walton Pratt wrote that "although the Court has great sympathy for the Spierers," they have failed to present sufficient evidence that Corey Rossman and Jason Rosenbaum were at fault for their daughter's disappearance.

The decision comes more than a year after the Spierers filed the suit alleging the two men gave their daughter alcohol despite knowing she was intoxicated and owed her a "duty of care." Their attorneys have denied the allegations.

The two men have argued that the Spierers have no evidence of what happened to their daughter and whether her level of intoxication that night caused her alleged injury or death.

Rossman and Rosenbaum have pointed blame at Lauren Spierer and Kilroy's Sports Bar in Bloomington, where she was seen drinking hours before she disappeared. Kilroy's is not a party to the Spierers' suit.

Jason Barclay, the Spierers' attorney, said the plaintiffs will appeal the ruling.

"I am heartbroken that the defendants and their team of defense lawyers will not allow the Spierers to get a simple question answered: What happened to their daughter that night?" Barclay of Barnes & Thornburg LLP said in a statement. "We will appeal and continue our pursuit of answers to that important question."

The Indiana University fashion merchandise major from Greenburgh, N.Y., disappeared early June 3, 2011, after a night of partying with friends, including Rossman and Rosenbaum. Her disappearance remains under investigation.

The Spierers did not return a call seeking comment. Attorneys for Rossman and Rosenbaum also did not return calls.

The lawsuit was originally filed against Rossman, Rosenbaum and Mike Beth, all of whom were seen with Spierer at various times the night she disappeared. The judge dismissed the suit against Beth in December, saying he was not negligent toward Spierer.
