SAN ANTONIO — A 22-year-old man is now a
facing capital murder charge after police said he fatally abused his
3-week-old baby at their far West Side home earlier this week.

Justin C. Janosik was charged Thursday with capital murder of a child under age
6. He has been in Bexar County Jail since last Sunday on one count of
injury to a child — causing serious bodily injury with intent.

His total bail is now $850,000.

Police said officers found Kaleb Janosik dead when they were called last
Sunday to the home at the 10300 block of Appomattox Street, where the
man lives with the boy's mother.

EMS responders noted dark, deep bruising observed just above the child's
left eye, on the back of his neck and on his back, police said.

Janosik told investigators he often cared for the child while his mother was
out looking for a job and admitted he sometimes took out his frustration
on his son because he would not go to sleep.

He also told police he struck the baby with his hands on the head, neck and back.

An autopsy showed the baby died of brain injuries.

In a second interview, the man also admitted to biting the child and
picking his son up by grabbing him by the neck, police said.

Justin Janosik pleaded no contest
Wednesday to murdering his 22-day-old son, Kaleb. The 23-year-old
Janosik had been charged with capital murder. The San Antonio
Express-News reports prosecutors agreed to accept a no-contest plea to
murder so he’d be spared the death penalty and become eligible for
parole in 30 years.
According to court documents, Janosik told police that he didn’t mean to kill his son but was trying to get him to stop crying.
Prosecutors said they accepted the plea because the child’s mother had been uncooperative with the investigation.
