Casey Anthony’s attorneys will fight an order that she must go on probation in her check-fraud case, WKMG-Channel 6 reported tonight.
Cheney Mason said the defense team on Tuesday will file a motion that Judge Stan Strickland be disqualified from the case, WKMG’s Tony Pipitone reported. Anthony’s attorneys will seek an emergency motion to set aside Strickland’s order that Anthony must go on probation for a year, Pipitone added.
Pipitone had an edge on the story because Mason provided several insights into the defense strategy.
Strickland today clarified his sentence that he expected Anthony to serve a year’s probation after she left jail. Yet because Strickland’s intention hadn’t been clear, Anthony served the probation while awaiting her murder trial. She was acquitted last month of first-degree murder in the death of her daughter, Caylee.
Anthony left Orange County Jail on July 17 and hasn’t been seen since. But under Strickland’s new ruling, Anthony would be expected to show up for probation on Wednesday, Pipitone said.
In an interview with WOFL-Channel 35’s Holly Bristow, defense attorney Mason complained that Strickland had filed fraudulent paperwork. Strickland said in a document that he met in court today with Anthony and her attorneys — but none of that happened. Mason said that Anthony is in an undisclosed location outside Florida, Bristow reported.
Mason told Pipitone that Anthony’s attorneys are concerned about her security as well as the legality of Strickland’s changed order.
WFTV-Channel 9’s Kathi Belich looked into what could happen next after Strickland amended his ruling. WFTV legal analyst Bill Sheaffer predicted that the case could go to the Florida Supreme Court. Sheaffer told Belich that Strickland had lost jurisdiction because Anthony had served the probation.
On WFTV, Sheaffer and public defender Bob Wesley agreed that Anthony couldn’t be forced to serve more probation because that would be double jeopardy. Wesley made the same point on WKMG.
Yet attorney Diana Tennis, a legal analyst for WOFL, said Strickland was correcting a paperwork mistake and didn’t think Anthony’s attorneys could fight it.
Attorney Mark O’Mara, a legal analyst for WKMG, said Strickland’s order could very well stand.
In another Anthony update, WFTV reported that George and Cindy Anthony were spotted flying first class to Houston with their attorney, Mark Lippman.
