Father charged in daughter's murder

SPRINGFIELD TWP, Ohio - Hamilton County prosecutors may seek the death penalty for a Springfield Township man accused of killing his 15-month-old daughter.
Officers arrested 45-five-year-old Thomas A. Huge on Friday. He was arraigned Saturday and is being held on a $1 million bond.
Hamilton County Prosecutor Joe Deters said they'll take the case to a grand jury to help determine if they'll pursue the death penalty.
Deters said Huge was getting ready to leave town.
"He emptied his bank accounts, he emptied his closets, everything was packed, he was ready to leave," said Deters.
Paramedics and police were called to Huge's residence in the 1400 block of Biloxi Drive on Sept. 7 after he called 911 to report the little girl was not breathing.
"There's a distinct pattern of abuse to this little baby and ultimately the baby was sufficated, manually, we believe," said Deters.
Huge's daughter was transported to Cincinnati Children's Hospital where she was pronounced dead.
Deters said the girl's name was Kaley. He said Huge also has a 3 1/2-year-old son who is staying with realtives. He said the children's mother is in prison.
Few neighbors knew Huge personally. One of his next door neighbors said he remembered seeing the little girl play outside in June.
Deters said they waited to arrest Huge to make sure their case was solid.
"We only get one chance at these guys and we have to make sure everything is in place before we go after them," he said.

SPRINGFIELD TOWNSHIP, Ohio -- A Springfield Township father held on $1 million bond in his daughter's death never had bonded with the girl, her grandfather said.
Prosecutors intend to ask for the death penalty for 45-year-old Thomas Huge, who is charged with murder in the death of his 15-month-old daughter, Kayli Bates.
Investigators said the girl had been suffocated before Huge called paramedics Sept. 7 to report the child was not breathing.
Franklin Bates, child's grandfather, called Huge a monster, saying that he abused the child because he did not think he was the father.
However, the grandfather said paternity tests proved otherwise.
The girl's mother had been in jail since March and had drug problems, the grandfather said, and family members had been asking Huge to let them raise Kayli and her sister, Karli, who was born on the same day a year earlier.
"There were several people in the family that wanted her, take her, raise her, love her (and) care for her, and somehow this animal ended up with her," Bates said.
Bates said Huge never bonded with Kayli, but he said family member did not know she was being abused.
But he did say that relatives became suspicious after one incident, which a family member photographed, but Bates said Huge explained the girl's injuries as an accident between two sisters.
Investigators said Huge was preparing to leave town, having packed his bags and emptied his bank accounts in the days before his arrest.
Huge remains in police custody at the Hamilton County Justice Center.
Karli Bates was staying with family members, her grandfather said.

The pictures were haunting.
One by one Monday, Assistant
Hamilton Count Prosecutor David Prem, slapped down photos of a naked
toddler on an autopsy table, bruises and other marks under her chin and
on her face.
The pictures were being shown to the jury that will
determine if Thomas Huge is guilty of murder in the Sept. 7, 2010,
strangulation or choking death of his 15-month-old daughter, Kayli Bates
– and, if so, if Huge should receive a death sentence.
“She died a horrible death,” Prem said, putting up the photos and saying “asphyxia” after each of the dozen or so pictures.
The
15-month-old girl was strangled or choked to death, Prem told jurors,
by Huge (pronounced Hu-ghee), her 46-year-old father. She died in the
Springfield Township home she shared with Huge and her 27-month-old
sister, Karli Bates.
Huge’s attorney, Perry Ancona, told jurors
they couldn’t convict his client because there was no solid proof. Then
he renewed his startling defense that the 15-month-old could have been
strangled to death by Karli, her 27-month-old sister, born exactly one
year earlier.
“This was a tragic accident in some fashion. Even if
(27-month-old) Karli laid on her in some fashion,” it wasn’t
intentional, Ancona told jurors.
That drew the ire of Prem, who
asked jurors how anyone, especially the 6-foot-2, 250-pound father,
could blame one daughter on the death of the other. Doctors testified,
Prem said, a 27-month-old child couldn’t cause the injuries that killed
Kayli.
“What kind of person would throw his two-year,
three-month-old daughter under the bus to save his soul? That man right
there,” Prem said pointing to Huge.
“Don’t let him do it.”
Huge
initially denied the 15-month-old was his. When DNA tests proved him
wrong, he mistreated her while doting on his older daughter, said Prem
and witnesses in the two-week-old trial.
Julie Bates, the girls’
mother, was in prison on drug charges when Kayli was killed. Jurors were
not allowed to hear that the mom told authorities she often argued with
Huge and he responded by choking her unconscious many times.
Common Pleas Court Judge Dennis Helmick ruled that information wasn’t relevant in this case.
Helmick
read jurors the law to use in the case, then sent them to deliberate.
Those deliberations ended after 5 p.m. without a verdict. Jurors were
sequestered, as they will be each night until there is a verdict.
If
they find Huge guilty of capital murder, the second phase of the trial
starts. Prosecutors will ask jurors to recommend a death sentence.
Huge’s attorneys will present evidence they hope instead will result in a
sentence of life in prison.
