Re: "Newborn Doe" - 3 Months - Albion (btwn Niagara Falls and Rochester) NY
ALBION — Bail has been reduced for the parents of a 3-month-old child
from Albion being treated at Women and Children's Hospital in Buffalo
for abuse-related injuries.Donald Labelle, 25, and Ciera Kimerly, 21, were charged last week with neglect, maltreatment and endangerment.
Police
told WGRZ that the child recently sustained a head injury that caused
bleeding in the brain. The child was also malnourished and had recently
suffered from a fractured rib.
Police arrested the parents
on Nov. 2, and both were arraigned in the Town of Albion Court. Both
appeared at a preliminary hearing Monday morning and pleaded not guilty
to the charges against them. The case will now move on to an Orleans
County grand jury.
Orleans County District Attorney Joseph Cardone is investigating this case.
"As
we move forward with the prosecution of this matter, it's certainly
going to be my position that they not have custody of this child until
such time the court, or someone of appropriate jurisdiction, makes a
determination that they're fit to have custody of this child," said
Cardone.
WGRZ also asked Cardone who will look after the infant after leaving the hospital.
"The
Department of Social Services is involved in this case. They will bring
this matter to family court. Likelihood is until this case can be
sorted out that the child will be in foster care," said Cardone.
Bail was originally set at $5,000 for Labelle and $2,500 for Kimerly.
