Boy, 10, stabs young friend to death in San Diego

SAN DIEGO (KABC) --
A 10-year-old boy stabbed a young friend to death in San Diego on Monday afternoon.

Police said several boys were playing in the driveway of a home in the Lakeside district when neighbors heard screams.

The boy had stabbed his 12-year-old friend in the chest with a kitchen knife. The friend died at the hospital less than two hours later.

The 10-year-old was taken inside his home. It's unclear where he is now. "He didn't mean to do it. I heard that clearly. Then I heard them try to console him, and they took him back in the house," said witness Wayne King.

Friends of the 10-year-old said the boy had been in therapy for anger issues and took medication for ADHD.

-- A 10-year-old Southern California boy is in a juvenile detention
center after denying in court Thursday a charge that he murdered another
child, authorities said.

The mother of the alleged victim, Ryan
Carter, said on HLN's "Nancy Grace" show that the suspect was her
12-year-old son's "best friend." Lisa Carter, a registered nurse, said
that her son died after stepping in front of the 10-year-old as he was
trying to stab another child.

"The things we taught him cost him
his life," Carter said of her son. "We taught him don't start a fight,
don't run away from a fight (and) if you see a fight ... stop it."

The
San Diego County Sheriff's Department received a call shortly after 1
p.m. Monday about the stabbing in Lakeside, which is about 20 miles
northeast of San Diego.

Despite efforts by sheriff's deputies,
paramedics and hospital staff to save him, the boy was pronounced dead
around 2:30 p.m. Monday, the sheriff's department said in a statement.

The
San Diego County District Attorney's Office filed murder and felony
charges Wednesday against the 10-year-old suspect, said Steve Walker, a
spokesman for that office.

An attorney for the young suspect
"denied the charges" during his arraignment Thursday morning, according
to Walker. The boy -- whose name has not been made public, in accordance
with the district attorney's policies regarding juvenile suspects -- is
now being held in a juvenile detention center in the county, he added.

Lisa Carter said that the boy who stabbed her son was actually targeting another child.

"Ryan took the knife for that boy," she said, describing her son as intelligent, caring and "everything to me."

The victim's father, Glen Carter, called his son a "good ... boy with Christian values."

Since
he is a juvenile, the boy accused of killing Ryan Carter cannot be
found guilty but can be convicted on a "true finding of fact," explained
Walker.

In convicted, he would have to be released by the time
he turns 25 years old, if not earlier, the district attorney's spokesman
added.

The boy's next court date -- for a "readiness" hearing to
determine if all sides are prepared to move forward -- is scheduled for
February 23.

Boy accused in fatal stabbing ruled incompetent

SAN DIEGO — An 11-year-old East County boy accused in the stabbing death of a neighborhood playmate was found Tuesday to be mentally incompetent to stand trial, bringing the criminal case against him to a halt.

A Juvenile Court judge concluded the boy was not only immature, but suffered from mental health and developmental issues brought on by fetal alcohol syndrome. A combination of those factors has rendered him unable to understand the court proceedings or assist his lawyer in his defense.

Judge Cynthia Bashant based her conclusion on recommendations made by two medical experts who evaluated the boy and reviewed records relating to his medical and family history. He is expected to be sent to a secure residential treatment facility until his competency is restored.

“I will continue to monitor his progress,” Bashant said.

The boy, who for now remains held at Juvenile Hall in Kearny Mesa, was not in the courtroom during the Tuesday hearing.

Lawyers on both sides of the case said they agreed with the judge’s decision. The prosecutor said the boy remains a danger to others.

“The case is essentially put in hibernation for about a year while the minor works on efforts toward obtaining competency through treatment and, quite frankly, getting older,” said Deputy District Attorney Victor Barr after the hearing.

“Hopefully with age and treatment he will be competent in a year, maybe longer,” Barr said, noting the case would resume if that happens.

The Juvenile Court will retain jurisdiction over the boy until he turns 21.

Deputy Public Defender Marian Gaston said her client suffered “significant and long-standing” behavioral, emotional and cognitive delays as a result of several factors, including his birth mother’s drug use and alcohol consumption while pregnant.

The Public Defender’s Office worked to identify several residential treatment facilities where the boy could be housed, Gaston said. The list will be given to probation officials to be vetted. Another court hearing has been set for Sept. 18 to determine which facility would best suit the boy’s needs.

U-T San Diego is not releasing the boy’s name because he is a minor and is too young to be tried as an adult.

Just 10 years old when the stabbing occurred, he faces charges of murder and felony assault with a deadly weapon in the death of Ryan Carter, a sixth-grader at Foothills Christian Elementary School in Lakeside.

Ryan, who was 12, was stabbed in his chest Jan. 16.

His parents, Lisa and Glen Carter, could not be reached for comment after the hearing. However, they have said the boy needs treatment but that someone at some point should be held responsible for their son’s death.

Neighbors have said the boy accused of killing Ryan started exhibiting trouble controlling his anger at an early age.

He was adopted by a special-education teacher who by several accounts took good care of her son and often sought medical help to address his needs.

Citing the boy’s competency evaluation, the judge said Tuesday that the boy’s birth mother was a diagnosed schizophrenic and reported a long family history of mental illness. The birth mother said she used methamphetamine and crack cocaine on a near-daily basis while pregnant and drank alcohol until she blacked out.

As the boy grew older, he became increasingly aggressive but also showed signs of regressive behavior, such as sucking his thumb, curling his body into a fetal position and throwing tantrums, the judge said.

One of the doctors who interviewed the boy said the child seemed to understand the seriousness of what he had done to Ryan, but could not understand the purpose of a juvenile court hearing, the roles of the people involved or the concept of a plea bargain.

Quoting another psychiatrist, Bashant said the boy hasn’t been able to “develop at the same rate” as other children his age.

Gaston, the defense attorney, said outside the courthouse that the boy’s adoptive mother was unable to attend the Tuesday hearing because of a “serious” conflict but agreed with doctors who recommended that her son be placed in residential care. An aunt attended the hearing.

Gaston said the boy misses Ryan, who he considered his closest friend.

“He believes that his best friend is in heaven,” Gaston said.

SAN DIEGO — A 12-year-old boy accused of fatally stabbing a playmate in East County last year was ordered Thursday to be released from Juvenile Hall and sent to a residential treatment facility until his mental competency
is restored.

Juvenile Court Judge Cynthia Bashant determined in August that the boy was not
competent to stand trial and suspended the criminal proceedings. The
judge had reviewed psychiatric evaluations that said the boy was not
only immature but also suffered from mental health and developmental
issues brought on by fetal alcohol syndrome.

The boy — who was 10 when he was charged with killing 12-year-old Ryan
Carter — has remained held in Juvenile Hall while authorities wrestled
over who would pay for his treatment and housing at a potential cost of
up to $160,000 a year.

In December, the boy’s defense attorney said a facility had been found
where he would receive daily psychiatric and psychological care, and be
seen by a social worker.

The staff is expected to meet the boy’s educational needs and teach him to
interact with others in appropriate ways, Deputy Public Defender Marian
Gaston has said.

The facility is not locked, but the boy is not considered to be a flight risk.

Lawyers said in court Thursday that an administrative law judge had ordered the
county Office of Education to pay for the boy’s treatment and education
until he is 21, unless his mental competency is restored before then
and criminal proceedings resume.

“Federal and state law basically says that a school district has to meet a
special education student’s educational needs,” said attorney Thomas
Nelson, who represented the boy in the administrative hearings.
The judge set a court date a year from now to determine his status.

Music Watson, spokeswoman for the county Office of Education, said room and
board at a residential facility can cost $100,000 annually. The
education component would add another $30,000 to $40,000 a year, and
mental health treatment could cost an additional $10,000 to $20,000 a year.

Authorities in the boy’s case have been ordered not to disclose the facility’s location.
The boy was not at Thursday’s hearing, but his mother was. She is a
special-education teacher and adopted her son when he was an infant.

U-T San Diego is not publishing the boy’s name because his case has been
handled in Juvenile Court, and he cannot be charged as an adult.

Deputy District Attorney Victor Barr said that he has been in contact with
Ryan Carter’s parents and kept them apprised of the developments. He
said the couple had remained strong and compassionate in the face of tragedy.

“I can’t tell you how much I respect the Carters for the way they’ve handled this entire situation,” Barr said.

The District Attorney’s Office charged the boy with murder and assault with
a deadly weapon in connection with the Jan. 16, 2012, stabbing outside
the younger boy’s home. Ryan, a sixth-grader and his parents’ only
child, lived in an adjacent mobile home park.

Ryan’s parents have said the boys were playing together when the younger one
grabbed a kitchen knife and threatened another playmate. Ryan intervened
and was stabbed in the chest.
