BRANDON WILSON - 4 Months (8/2011) Accused: Donald Wilson - Stockton CA
STOCKTON - An infant unexpectedly dies under his father's watch.
The child's medical history shows the 4-month-old had been plagued by
sicknesses, including a bout of pneumonia around the time of death.
But physicians' opinions indicate a more sinister cause of death.
Donald Wilson, 23, is accused of killing his
son, and doctors said the baby had sustained brain damage likely caused
by shaking or an impact.
A preliminary hearing began Tuesday for Wilson, who is charged with child abuse resulting in
death. He could face life in prison if convicted.
Brandon is the second child fatality of 2011 reported by San Joaquin County Child Protective Services.
The other was a 3-year-old named Noah Morgan, whose stepfather, Joe Anthony Correia of Escalon, has been charged with the death.
According to courtroom testimony, Donald Wilson called for emergency help Aug. 1,
when Brandon stopped breathing in a choking episode. The father had
been watching the baby that day while the mother worked.
The following day, the baby was transported out of San Joaquin General Hospital to a children's intensive care facility.
Brandon was comatose and was placed on a ventilator, said Dr. Angela Rosas, a
pediatric specialist in child abuse and neglect with Sacramento-based
Sutter Medical Group. He was completely unresponsive, Rosas said.
Doctors ran a battery of tests on Brandon and then determined he had bleeding
in the brain and had sustained abusive head trauma.
San Joaquin County medical examiners concluded the cause of death to be
diffused axonal injury, which indicates the damage spread throughout the brain.
Donald Wilson's lawyer, Pittsburg
defense attorney Carin Johnson, raises the question whether Brandon's
death was caused by ongoing illness.
San Joaquin County Superior Court Judge Elizabeth Humphreys is presiding
over the preliminary hearing, expected to last more than two days, and
will decide whether there is enough evidence to send Donald Wilson to trial.

STOCKTON - A 23-year-old man is to stand trial in
the death of his 4-month-old son, San Joaquin County Superior Court
Judge Elizabeth Humphreys has ruled.
Donald Lee Wilson is charged with child abuse resulting in death, child abuse,
corporal injury to a child and three enhancements of infliction of great
bodily injury.
Prosecutors say Wilson killed his infant son, Brandon Wilson, on Aug. 1
According to courtroom testimony, Donald Wilson
called for emergency help and said Brandon stopped breathing in a
choking episode.
The baby was transported out
of San Joaquin General Hospital to a children's intensive care facility
in Sacramento the following day.
Brandon was comatose and placed on a ventilator.
Medical examinations of the baby do not match Wilson's account of what occurred the day Brandon stopped breathing.
San Joaquin County's chief medical examiner, Dr. Bennet Omalu, concluded
that Brandon was hit on the head with great force. Physician opinions at
the hospital were consistent with Omalu's conclusion.
They agreed Brandon Wilson's death was caused by traumatic head injuries.
Donald Wilson is scheduled back in court March 13 for a bail hearing.

Re: BRANDON WILSON - 4 Months (8/2011) Accused: Donald Wilson - Stockton CA
The court has ordered the release of a father
charged with killing his infant child after attorneys reached a plea
deal Wednesday.Donald Lee Wilson, 23, had
been headed for trial in the death of his 4-month-old son, Brandon
Wilson, who medical doctors determined had traumatic brain injuries.
But in a sudden agreement at a pretrial hearing Wednesday, the prosecutor
and defense attorney made a deal that allowed Wilson to be released from
the San Joaquin County Jail immediately.
Wilson pleaded no contest to felony child abuse and an enhancement of infliction of great bodily injury.
The conviction is attached to a nine-year prison sentence, but that penalty
was replaced with probation time by San Joaquin County Superior Court
Judge Xapuri Villapudua who made the attorneys' agreement official.
"He would be allowed to return with his wife and stepchildren," Villapudua
said. Wilson will serve five years probation and is ordered to attend a
one-year child-abuser treatment program.
If Wilson violates the sentence terms, he may be ordered to serve the nine-year prison sentence.
San Joaquin County Deputy District Attorney Angela Hayes dropped charges of
child abuse resulting in death, corporal injury to a child and two
other great bodily injury enhancements.
On Aug. 1, 2011, Wilson called for emergency help after his son stopped
breathing, according to testimony in a preliminary hearing. He told
emergency responders Brandon had a choking episode.
The following day, the baby was transported to a children's intensive-care
facility in Sacramento, where he remained comatose and on a ventilator.
Physicians decided the child's injuries reflected child abuse.
San Joaquin County's chief medical examiner, Bennet Omalu, concluded that
Brandon was hit on the head with great force, and he said the baby's
death was caused by traumatic head injuries.
Private defense attorney Peter Johnson said Wilson withdrew his original plea
of not guilty to no contest because he faced a possible life sentence if
convicted by a jury.
"He's going home. That's all I have to say," Johnson said.
Hayes couldn't be reached for comment after the ruling.
Wilson's family and wife - the child's mother - declined to comment on the resolution.
Villapudua on Wednesday said the court finds there is no substantial risk of harm to Wilson's wife or children.

They didn't ask me but this pos needs to receive punishment for the death of this poor baby.
Once again a POS mother stands by her POS man and to hell with her baby.
I hope he doesn't beat the other children to death.
