AIDEN TORRES - 13 Months (2010) - Surprise/ Phoenix AZ
A Surprise mother faces murder and child abuse charges more than a year after her child died from an infection that could have been treated, authorities said.
Phoenix police arrested Kristen Elizabeth Torres, 21, on Tuesday.
Maricopa County prosecutors charged Torres with second-degree murder and felony child abuse for the death of her 13-month-old son Aiden Torres.
Aiden died on Nov. 2, 2010 from acute peritonitis and had been suffering from fever for a few days. When the baby began vomiting bile, the parents contacted a doctor for advice, according to the the probable cause statement police filed.
The Mayo Clinic website defines peritonitis as a an infection of the peritoneum, a membrane that lines the abdominal wall. The condition requires prompt treatment, usually with antibiotics, to fight the infection, the site notes.
Both parents were told to take the baby to the emergency room, but Torres was unable to take him due to high blood pressure, according to court filing. She begged her husband to take the baby but he was too tired that evening from helping his in-laws move, the filing said.
Police contacted two pediatric specialists who said the baby likely would have survived if he had received medical attention.
Sgt. Tommy Thompson, a spokesman with the Phoenix Police Department, said he had not read the report and could not say why the baby's father was not charged.
Because Torres resided in Phoenix when her baby died, Phoenix officials are in charge of the case instead of Surprise, where she was currently living.

A Phoenix man was "too tired" -- and his wife's blood-pressure was "too high" -- to take an extremely ill 13-month-old baby to the hospital in November of 2010 -- despite having been told by doctors the baby needed medical attention.
The result: the baby died.
Now, the baby's mother, 21-year-old Kristen Torres, faces a murder charge.
According to court documents obtained by New Times, on November 8, 2010, 13-month-old Aiden Torres was found dead in his crib at his parents' Phoenix home.
An autopsy later revealed that the baby had died from acute peritonitis, an inflammation of the membrane which lines the inside of the abdomen and all of the internal organs.
Torres and her husband, Robert Torres, told police Aiden had been sick for two or three days prior to his death. They told detectives the baby had a fever and a distended stomach.
Torres called the baby's doctor, who instructed her to take the baby to a hospital immediately.
That never happened -- Robert Torres said he was "too tired" from helping his in-laws move to get the baby the medical attention that probably would have saved his life.
Kristen Torres claimed her "high blood-pressure" prevented her from bringing the baby to the hospital herself.
Torres' "high blood-pressure" prevents her from driving a car, but, as you can see in the photo below that we swiped from her Facebook page, it apparently doens't prevent her from slugging down bottles of Mike's Hard Lemonade, or working as a "piece of shit" at a Kohl's department store.

Listen first thing first no I could never be to tired for my son Aiden was the best thing that ever happened to me. Kristen never told me when I got home Sunday night at 10pm she made the call around 7pm so why didn't she do something in the 3 hours before I got home. The nurse she called stated she talked to mother not the father. But this isn't about me. What was never stated was that Aiden was born at 7months and had issues since birth NEC, broncitious and he was rushed 2 other times to the er by me and Kristen. I honestly don't Know what took place that whole weekend I was helping my I laws move as Kristen was home alone with Aiden but I know when I came home at 10pm Sunday night i saw him once to change and put him in a outfit to sleep in and when I woke up he was gone I don't know y my ex wife never told me anything but if she would have I would have taken him that's truth. I have his prior hospital records as proof of his history. And I will say due to the state of Arizona taking my exwife saying she begged me to take him I took a negligent homicide and attempted child abuse sentenced to 1 1/2 years n lifetime probation what they gave her I will not discuss cause it's her life and I will never speak to her again she ruined my life

She was sentenced to probation on count 1 and count 2 i served 1 1/2 on count 1 n life time probation on count 2

But basically my ex got off and I kno a lot of people claim there innocence but she never begged me to take him to a hospital. She lied about everything thinking they would leave her alone and haVe me go after me alone. She was wrong and she ruined my life I miss my son he was my pride and joy

There is nothing that compares to the loss of a child. I don't care how young or how old your child is, there is just no comparison to loosing one. I think the only thing worse than your child dying is having your child kidnapped and you not knowing what is happening to your child. The only thing I don't understand, and it's not my place to judge you, is why didn't you fight the charges bought up against you? Maybe you did, I just know if I was 100% innocent I would go to my death bed fighting these charges. I hope you are now divorced, if your wife made that call at 7:00pm and knew how sick her son was, why didn't she call 911?

I didn't want to risk 35 years I have an erdearly grandmother I take care of back home in another state as for divorced yes I am as for her I don't know wat went through her mind I hate her and she got off scout free and it's a same father who wasn't home since Friday 4pm got punished

I am so very sorry that you lost your baby. Personally I always wonder about the mother when I read things like what you posted about getting home at 10 PM and changing Aiden and putting his little pj's on him. IMO the mother should have had that done. Of course in this instance she should have called 911 immediately after getting off the phone with the nurse and I'll never understand why she was allowed to plea to a reduced charge because the call is documented; her not getting help asap is tragically documented. Many innocent people plead guilty because of the fear of very harsh, unfair punishment.
In Florida if an innocent person pleads guilty they get a relatively light sentence. I'm sure it is the same in other states.
A guilty person has nothing to lose. An innocent person has their life to lose.
If they refuse to plea the state's attorney throws every charge in the book at them. Most state attorneys don't give a damn about guilt or innocence, all they care about is their conviction rate.
Florida has the most men from death row being exonerated than any other state. But all other states have their own erroneous convictions.
Imagine the thousands of men languishing in prisons for crimes they didn't commit in order to avoid decades in prison.
Our justice system doesn't always mete out justice.

It's just so sad that a sweet innocent child lost his life when he could have been saved if just taken to the hospital in time. I hate to think there are innocent people in jail for crimes they didn't comment, but it's true that happens way too often.

Thank u for the kind words i have learned to deal with the pain and god has been beside me the whole way and i couldnt have done this without god behind me sucide crossed my mind many times but i over came it im at probation right now i will go home and make a few postsladibug wrote: I am so very sorry that you lost your baby.
