For the second time in less than two weeks, a Polk County dad has been accused of causing the death of his own baby.

In the newest case, Jacob David Hartley, 20, of Lakeland was arrested
by Polk County Sheriff's detectives Friday and charged with
manslaughter of a child and aggravated child abuse in the death of his
3-week-old infant son.


Detectives said the infant’s mother, Amber Newton, found the infant
unresponsive and bleeding from his nose and mouth just before 6 a.m.
Friday. The infant, Colton Hartley, was transported to Bartow Memorial
Hospital, where he was pronounced dead.


An autopsy determined Colton died of a head injury. The manner of death was ruled homicide.

Newton told detectives Hartley woke up at 10 a.m. Thursday and played
Xbox until leaving for work at 2:30 p.m. She said Hartley held Colton
for a half-hour while playing the game and at one point shook him and
cursed him for not going to sleep, allegedly saying, "[expletive] you,
Colton, please got to [expletive] sleep."


According to detectives, Hartley admitted to shaking the infant approximately one week ago and again Thursday.

Last Wednesday, Christopher Ryon, of Winter Haven, was charged with
aggravated manslaughter in the death of his 3-month-old daughter, Riley
Ryon, a day earlier. Detectives said the father admitted to hitting the
baby in the head because she wouldn't stop crying when he wanted to take
a nap.

Dad killed three-week-old son because he CRIED too much during Xbox marathon

A father has confessed to killed his newborn baby boy because the
three-week-old’s crying was disturbing him as he played on a games
console, police said.

Jacob David Hartley, of Lakeland, Florida,
had baby Colton sitting on him for around 30 minutes out of an almost
five hour video game session on Thursday.

During his gaming
marathon the 20-year-old became so frustrated with his son that he took
hold of the boy with both hands and shook him.

'Damn you Colton, please go to f***ing sleep’, he said, according to the boy’s mother Amber Newton.

At that point, she told police, she stepped in and took her baby away from Hartley.

Taking a break from the Xbox Hartley went to work at Sam's Club, where he stocked produce.

Upon his return home he resumed the gaming, playing until about 4am on Friday when he went to bed.

Around that time baby Colton awoke hungry and Amber gave him to Hartley while she prepared a bottle.

Hartley claims he fell asleep and woke to find Amber holding their unresponsive son, who was bleeding from the mouth and nose.

Colton died at around 7am at Bartow Memorial Hospital from head injuries, which doctors said were consistent with being shaken.

Hartley admitted shaking his son on Thursday morning and another time about a week prior.

He being held at the Polk County Jail charged with aggravated manslaughter of a child and aggravated child abuse.

LAKELAND - Neighbors say the birth of baby boy Colton Hartley appeared
to change his father Jacob Hartley's demeanor.
The 20-year-old Lakeland man was more out-going.
“I ran into the gentleman before, he didn't seem very friendly,” said one
neighbor who did not want to be identified. “Then one other time I ran
into him and he was very friendly. That's when he told me he had just
had a baby boy and he was real friendly and excited.”
That excitement apparently didn't last very long.
Hartley is now in big trouble, accused of killing his three-week-old son
apparently because the newborn wouldn't go to sleep while his dad played video games.
“It’s very disturbing to know what happened,” said Richard Eijo
who lives just down the street.
Hartley is facing one count of aggravated manslaughter and one count of
aggravated child abuse in Colton’s death.
Investigators say Thursday he shook the baby and cursed at him
while playing with his Xbox in his Lakeland home.
The shock from the toddler’s death caught Eijo and others off guard.
“It's really scary, I mean, I just had a baby two months ago and I can't
imagine somebody doing that to their own child,” he said. “I can’t even
wrap my brain around that. People these days they're just so addicted to
those Xbox games that they put the priorities in the wrong place.”
One neighbor said Hartley and his family into the area months ago.
“They moved in and they seemed like a happy family," said Eijo. "When they
had the baby they had a sign in the yard saying a new baby coming home
that kind of thing."
The baby's mother – who is mentioned in the suspect’s arrest report -
declined comment Saturday afternoon.
Investigators with the Polk County Sheriff’s Office say Hartley confessed to shaking
the baby during an interview. It was not the first time it had happened.
The arrest reports say Hartley shook the infant a few days earlier because he would not stop crying.

What? This is unbelievable. The monster beats his baby to death and gets to walk free on bail? I wonder if it would be the same if it was an adult he killed.
