CHLOE ROBINSON - 2 yo (2010) Accused: Samson Loynachan - Fort Worth TX
FORT WORTH -- Less than two hours after little Chloe Robinson was
picked up from day care with a fever, the 2-year-old child was in the
emergency room with head trauma so severe that it killed her, witnesses
testified Tuesday.
Samson Loynachan, 32, who was then the
boyfriend of Chloe's mother, is standing trial on a capital murder
charge in state District Judge Louis Sturns' court in the death of
Chloe. She died Aug. 26, 2010, after undergoing emergency surgery to
relieve swelling in her brain.
Prosecutors Alana Minton and Eric
Nickols presented evidence Tuesday that Chloe died of blunt trauma to
the head while Loynachan was watching the child that afternoon.
Defense
attorney Fred Cummings has said that the head injury could have
occurred earlier in the day, while she was at day care, but that
symptoms didn't develop until later.
Tearful child-care worker
Raquel Davila testified Tuesday that Loynachan brought Chloe to the
day-care center for the first time Aug. 25, 2010, and seemed "rushed,
hurried, needing to get somewhere in a hurry."
The child developed
a fever later that day, and Loynachan returned to pick her up about
4:30 p.m., Davila, the center's preschool manager, told jurors.
At
that time, he was so abrupt with the child that Davila and another
preschool manager discussed whether they should report his behavior.
"We
discussed it amongst ourselves," she said. "We weren't sure at that
point if he was just being [unpleasant] or if he was being unfatherly.
... Who is this man and why is he being like this?"
Within an
hour, Loynachan was at a neighbor's house with an unconscious Chloe in
his arms. She was breathing irregularly and appeared to have a seizure,
according to a 16-year-old neighbor who called 911. A tape of the 911
call was played for jurors.
"It's an emergency! She's not responsive!" the girl told the 911 dispatcher. "She's not breathing!"
The
girl testified that Loynachan seemed "panicked," and appeared to try to
give the child mouth-to-mouth resuscitation. He can be heard shouting,
"Hurry, hurry!" on the 911 call but does not follow the instructions
that the girl relays from the dispatcher. After paramedics arrived,
Loynachan pointed out a large, soft bump on the child's head and said
that she may have gotten it from falling out of her toddler bed.
"I
found it hard to believe," the girl testified. "I didn't understand how
you could fall out of a toddler bed ... and get an injury that size."
Paramedics
took the child to Cook Children's Medical Center in Fort Worth. She was
unconscious when she arrived about 6 p.m. and had brain swelling so
severe that it was life-threatening, pediatric nurse practitioner
Kristin Milota testified. A CT scan revealed a large bruise inside her
skull, and she was taken to emergency surgery.
Pediatric
ophthalmologist Ann Ranelle told jurors that she checked the child's
eyes the next day in the intensive care unit and found bleeding
consistent with nonaccidental head trauma or shaking. The damage to
Chloe's eyes was more severe than the damage she saw in a child who had
been kicked by a bull, she testified. The sort of damage to Chloe's eyes
is "very, very suspicious for abusive head trauma," she testified.

FORT WORTH, Texas (AP) - A North Texas man who testified he never meant to hurt his fiancee's 2-year-old daughter has been sentenced to life in prison for the girl's death.
Jurors in Fort Worth took about 30 minutes Tuesday to decide the penalty for 32-year-old Samson Loynachan.
The Fort Worth man was convicted Friday of murder in the death of Chloe Robinson. She died last August of a head injury.
Prosecutors say the child got sick at day care. Her mother, who was on the first day of a new job, asked Loynachan to pick up the girl.
Daycare workers told investigators that Loynachan appeared annoyed while retrieving the tot. Authorities say Loynachan, less than an hour later, carried the girl to a neighbor's home and said the child was unresponsive and call 911.
