Mother of 18-month-old arrested on sexual abuse charges

CHARLOTTE COUNTY: The Charlotte County Sheriff's Office arrested the mother of the 18-month-old girl who detectives say had been sexually abused repeatedly since she was born.

Thursday afternoon, Charlotte County sheriff's detectives arrested the 26-year-old mother, whose name we will not release to protect the identity of the child.

She was arrested in connection with a child sex investigation involving her 18-month-old daughter and her boyfriend, 59-year-old Glenn M. Nelson.

The mother is charged with:

• Capital Sex Battery on 18 Month Old Baby Girl
• Capital Sex Battery-Principle Lewd & Lascivious Molestation Under 12 Years Old
• Possession of Child Pornography (2 videos)
• Use of a Child in Sexual Performance
• Lewd Exhibition, Lewd or Lascivious Conduct

The detective's investigation led to obtaining a search warrant for the mother's home and confiscating her computer as well as some other items.

That investigation led to getting search warrants for Nelson's home and office. Officials say a total of
six computers were confiscated.

Charlotte County computer crimes detectives found child pornography images, chat files between the mother and Nelson discussing having sex with her baby via webcam, and other images.

Nelson was arrested Tuesday and was charged with:

• Capital Sexual Battery on an 18 Month Old Baby Girl
• Lewd & Lascivious Molestation on a Child Under 12 Years Old, and
• 20 felony counts of Possession of Child Pornography by Sex Performance by a Child.

Nelson is still at the Charlotte County Jail on no bond.

After we learned about the mother's arrest, we put in a request to speak with her in a jailhouse interview. But watch commanders at the Charlotte County Jail said that interview was not able to happen Friday night because the mother became violent with jail personnel and had to be restrained.

Detectives say this is an active, ongoing investigation and will take time to download all of the images in the confiscated computers. More charges may still be filed.

Mother on trial for allegedly molesting infant

CHARLOTTE COUNTY, FL - A jury has been seated in the trial of the woman accused of raping her 18-month-old daughter and allowing her boyfriend to do the same. Opening statements begin Tuesday.

Melissa Bailey, 29, was arrested in 2009 and charged with two counts of sexual battery on a person under the age of twelve, lewd and lascivious molestation, lewd and lascivious exhibition, possession of child pornography and use of child in sexual performance.

Charlotte County deputies said it was one of the worst cases they have ever investigated.

Detectives say Bailey let her boyfriend, 62-year-old Glenn Nelson, rape her 18-month-old daughter.

"They'd been having sex with this baby, both of them, since the child was born," said Bob Carpenter of the Charlotte County Sheriff's Office at the time of their arrest.

Bailey's attorney says they will use insanity as a defense. A doctor has already ruled her competent to stand trial.

Bailey rejected a plea deal from the state. If convicted she could face up to life in prison.

Nelson agreed to a plea deal last year and is in prison.

In an earlier interview with NBC2, Nelson denied raping the baby, but admitted to talking to Bailey about it.

"It's all in there all the time about fantasies- not reality that was happening. It was fantasizing and
talking about it," said Nelson.

The victim, who is now four years old, is living with her father according to the department of children and families.

The trial is expected to last through Thursday or Friday.

Testimony begins in rape of 18-month-old

CHARLOTTE COUNTY, FL - The trial of Melissa Bailey began Tuesday with opening statements – and an apology. Much of the testimony and evidence allegedly depicts the molestation of an 18-month-old girl.

Day two of Melissa Bailey's trial started with an apology and a warning.

"The state apologizes in advance," said prosecutor Jillian Kuykendall.

Prosecutors described some of the evidence they plan to show during the trial.

"You will be presented with evidence of how this baby was subjected to several sex acts," said Kuykendall.

Pictures, logs of online conversations and even a video are some of the graphic items detectives seized from bailey's home in 2009.

"The state is confident, after you see all the evidence and hear and listen to all the testimony, you will find the defendant guilty on all 6 counts," said Kuykendall.

The defense claims Bailey is insane and had no control over what she's accused of doing.

"She didn't understand what was happening, she didn't know what she was doing she was manipulated by this boyfriend as the state talked about," said Joe Lombardo, Bailey's attorney.

Glenn Nelson is that boyfriend. He was arrested with Bailey and is currently in prison. He says he never raped the little girl.

"What normal mother would let this happen unless there were serious problems with her, unless she was insane?" said Lombardo.

Lombardo explained Bailey had surgery as a child and part of her brain was removed.

He says she's innocent because of her mental health issues.

Prosecutors say the evidence shows Bailey did this for her own "sexual gratification."

Being "insane" and "not normal" are two very different things. Obviously, there is something wrong with anyone who even so much as fantasizes about having sex with an infant... but that doesn't mean they are legally insane. A lot of pedophiles know what they are doing is wrong and that's why they hide it. Not knowing right from wrong is the question when determing insanity and I pray like hell this bitch gets life in prison (personally I think the death penalty should be open but since the baby "survived" I guess they can't.)

I don't disagree with you. My point was that something is wrong with someone if they even just fantasize about sex with a baby. Doing it is certainly worse. And I think rape of a child of any age should warrent the death penalty.

This is true. Neither of these POSs deserve to breath. Her defense was a crock. She is evil. Her boyfriend is evil. They should be impaled on a stake and the buzzards, flies and ants should be allowed to feast on them.
