San Jose man arrested in 17-month-old’s death


SAN JOSE, Calif. — A San Jose man has been arrested in the death of a 17-month-old child who has being cared for by his girlfriend, authorities said.

Authorities said paramedics were called to a home in the 2100 block of Mendota Way on Aug. 11 on a report of a 17-month-old child in distress.

Firefighter and ambulance paramedics arrived on the scene to find the toddler unresponsive. The victim was transported to Regional Medical Center, in San Jose, where he was pronounced dead

The San Jose Police Department was notified of the child's death, and the Santa Clara County Child Abuse Protocol was activated. The San Jose Police Department's Homicide Unit began a homicide investigation.

Authorities said 38-year-old Alejandro Benitez of San Jose was taken into custody on Friday.

Investigators found that the child was being cared for by his babysitter, at the babysitter's home, when the homicide occurred. They also found that Benitez was the babysitter’s boyfriend.

Benitez was booked into the Santa Clara County Main Jail on suspicion of Homicide with Special Circumstances, where he currently remains in custody on $50,000.00 bail.

The death was San Jose's 32nd homicide of the year. The case remains under investigation and no further details are being released.
