MESA COUNTY, Colo. — A 2-year-old boy died and his 4-year-old brother was in critical condition after their mother admitted to leaving them inside an SUV for 90 minutes with its engine running.
The Grand Junction Daily Sentinel reports an affidavit written by a Mesa County Sheriff’s office investigator shows she left her boys while she met a man near the Powderhorn Mountain Resort east of Grand Junction Tuesday night.
Heather Jensen, 24, called 911 saying her youngest son was unconscious and not breathing. William Jensen was pronounced dead at the scene.
His brother, Tyler, is in critical condition at Children’s Hospital in Aurora. The boys’ step-grandfather, Robert Mathena, says Tyler is improving.
“He’s starting to respond a little bit, he’s opening his eyes, looking around. I guess he has some kind of liver damage, too,” Mathena says. He believes the boys had carbon monoxide poisoning.
The boys’ mother told Mesa County Sheriff’s Office investigators she was sitting in the man’s truck next to her SUV.
She had let the boys play in the snow before putting them back in their car seats in her Toyota 4Runner.
She says she drove away and heard her 4-year-old gurgling. That’s when she stopped and realized the 2-year-old wasn’t breathing and she called 911.
The cause of William Jensen’s death has not been released. There have been no charges filed in the case so far.
The Sentinel reports this investigation comes just after the death of Heather Jensen’s husband, Eric. He was killed in a two-car crash on Oct. 10 in Garfield County.

This is a stange case. I'm interested to find out what the cause of death is because I don't understand how it could be carbon monoxide if the car was in an open area.

Abuse none the less. She left them in the vehicle 90 minutes by themselves. You don't leave a kid in a car for five minutes let alone 90.

Autopsy Report In Child Death Investigation May Take Months

GRAND JUNCTION, Colo. (CBS4)- It could take months for an autopsy report from the Mesa County Coroner to be made public in the investigation of a child death near Powderhorn Ski Area.
The mother of a toddler who died in a car this week near a Colorado ski resort told police she left the boy and his brother alone in the SUV while it was running for an hour and a half, according to court documents obtained by a Grand Junction newspaper.
The children were found Tuesday night in a Toyota 4-Runner near the Powderhorn ski area. Tyler, 4, was taken to a hospital in Grand Junction and then airlifted to Children’s Hospital in Denver. He was listed as being in critical condition on Wednesday.
The exact nature of how Tyler was injured haven’t been released, but it’s thought carbon monoxide poisoning played a role. Autopsy results also haven’t been released so far in the death of his brother William, 2.
The Daily Sentinel reports that police records show their mother, Heather Jensen, 24, of Palisade, told a Mesa County sheriff’s investigator she was in the car of a man while the children were in the SUV alone. She was also apparently the one who called 911 to report that the boys were in trouble.
The newspaper also reported that Jensen first told police she was outside the vehicle for only 10 minutes but then changed her story.
The incident happened inside a vehicle parked on the side of Powderhorn Road, just off Highway 65 at about 6:30 p.m. Tuesday. That is near the entrance to Powderhorn Ski Resort, which isn’t open for the season yet.
Jensen posted photos of the boys on her Facebook page hours after making the 911 call, saying “I miss my boys.”
The Mesa County Sheriff’s office so far hasn’t released a report to media in the case. They are calling it only a death investigation.
The Sentinel also reported that police searched Jensen’s vehicle and that an investigator wrote in that search warrant that there was probable cause to believe a crime of child abuse resulting in death had been committed.
CBS4′s request to view the same court documents the Sentinel was provided access to was rejected.
“How is this not considered a criminal investigation if a child has died?” CBS4′s Jeff Todd asked Mesa County Sheriff’s spokeswoman Heather Benjamin.
“Well it may get to that. It just depends on the coroner’s results and where that goes into our investigation,” Benjamin said. “Child abuse cases typically aren’t black or white.”
The autopsy on William is expected to provide additional information in the case. It could take two months or longer for the autopsy report to be released.
“An illness, something like that, that wasn’t discovered or wasn’t obvious on scene, compared to comparing evidence on scene or evidence gathered through the course of the investigation that may turn it into a criminal investigation,” said Benjamin.
The newspaper also reported that Jensen’s 26-year-old husband Eric died in an accident in October.

DENVER — A four-year-old Palisade boy suffering from brain damage at Children’s Hospital was taken off life support and died Monday night, the family said.
Tyler Jensen was put on life support after being left in a running car for an hour and a half last week. His two-year-old brother William, who was also in the car, died on the scene.
Some of his family members went to Grand Junction to try to gain custody of the boys from their mother, 24-year-old Heather Jensen, when it was discovered that the two had been left inside a running Toyota 4Runner for 90 minutes.
Heather told police she left her boys inside the SUV while she sat in a man’s truck that was parked next to the vehicle.
When she drove away, she told police she heard Tyler gurgling. That’s when she stopped and realized William wasn’t breathing. She called 911.
Emergency workers speculated the boys were poisoned by carbon monoxide, but friends of the family say that possibility has been ruled out.
Tyler’s step-grandfather Robert Mathena said the four-year-old had an MRI on Nov. 29 that showed he had severe liver and kidney damage. A medical expert said the gurgling sounds he made trying to breathe could be a sign of fluid in the lungs.
What got Tyler so sick is still not completely known, and the Mesa County Corner still hasn’t released a cause of William’s death.
Authorities have said they are not yet sure if they will file criminal charges against Heather.
“Tyler was a 4-year-old little boy, full of life,” Mathena, said. ”He loved fishing, hiking, playing. He was a great kid. We all love him and we’re all devastated about this.”
The death of both boys came just weeks after their father, Eric, died in a head-on collision Oct. 10.

LITTLETON, Colo. — In the darkness of a park in Littleton, candles bring much needed light to a family’s darkness.
“The candles to me symbolize hope that we’ll heal,” said the boy’s aunt Tressa Norberg.
Family and friends want answers surrounding the deaths of brothers William and Tyler Mathena.
Two-year-old William was found unresponsive in a car three days after Thanksgiving near Powderhorn ski resort in Mesa County. His 4-year-old brother who was next to him, died Monday.
The boys’ mother said she left them alone in her running vehicle for 90 minutes while she was with a man in a vehicle right next to hers.
“We want to know what happened so we can move forward and honor their memories,” said Norberg.
The family says police have ruled out carbon monoxide poisoning as a cause of death leaving many questions. Their mother has not been ruled out as a suspect.

Judge blocks Jensen cremations

Mesa County District Judge Thomas Deister on Thursday granted an emergency injunction to block plans to cremate the bodies of Tyler and William Jensen, now in the care of a Grand Junction funeral home.
The judge, however, said the boys’ grandparents first must post $5,000.
“The court finds that the preliminary injunction should be issued without notice to respondent (mother Heather Jensen),” Deister wrote in his order.
Attorney Greg Leavitt, who’s representing the boys’ grandmother, Diane Mathena of Clifton, wrote in an application for an emergency injunction that he had attempted unsuccessfully to communicate with Heather Jensen’s attorney, Ed Nugent, about the status of the bodies.
“Because the cremations are arranged and imminent, the court finds that further delay in attempting to reach (Jensen) or (Nugent) should not be required,” the ruling reads.
Deister’s order, however, says the Mathenas must post a $5,000 security bond in order for the injunction to issue, consistent with Colorado legal rules. That had not happened as of early Thursday evening.
“This is why my clients are working to raise money,” Leavitt said.
“... Because (Heather Jensen) is likely to incur attorney fees and costs in response to the actions taken herein, and because Callahan-Edfast Mortuary is likely to incur costs to maintain the boys’ remains until decisions are made in this matter, the court finds that security of $5,000 is necessary,” Deister wrote in the order.
Heather Jensen has asked Callahan-Edfast to cremate the bodies.
Mesa County Chief Deputy Coroner Kim Hollingshead said autopsies were completed for both boys and the bodies were turned over to Callahan-Edfast, consistent with a request from Heather Jensen. Per coroner’s office policy, Hollingshead said remains can be transferred after next-of-kin have been identified, a request has been made for transfer and the coroner’s office has confirmation of a contractual relationship between next-of-kin and a funeral home.
Daryl Pridy, Callahan-Edfast funeral director and assistant manager, confirmed the mortuary has the remains and cremation was “pending but on hold” until the legal issues surrounding the bodies are resolved.
“We want to do what’s best for the boys, as well as the legal representative,” Pridy said.
Aside from the short-term injunction, Diane Mathena is separately requesting that Deister make a final determination of her legal rights to bury her grandchildren, as opposed to the mother. Mathena argues she’s in a much better position to do just that and wants her grandchildren buried next to their father, Eric Jensen, in Palisade.
“The petitioner (Diane Mathena) bases this assertion on the current circumstances surrounding the death of William and Tyler and that those circumstances reflect an uncaring and potential criminal culpable respondent (Heather Jensen),” the filing reads.
Deister noted in his order Heather Jensen would be barred under Colorado law from directing final disposition of the remains if she’s arrested or charged with a felony in connection with the boys’ death. Heather Jensen has not responded to requests for comment from The Daily Sentinel. Nugent has said she’s been advised against making any such statements.
The Mesa County Sheriff’s Department continues to investigate the Nov. 27 incident which started with a 911 phone call from Heather Jensen at 6:31 p.m., who reported she was at Powderhorn Mountain Resort, according to a search warrant affidavit. She told dispatchers her youngest, William, 2, was unconscious, not breathing and had no pulse. He was pronounced dead when authorities arrived.
The affidavit said she reported around 6:50 p.m. that Tyler, 4, was having trouble breathing. Tyler died Monday after being removed from life support.

Per coroner’s office policy, Hollingshead said remains can be transferred after next-of-kin have been identified, a request has been made for transfer and the coroner’s office has confirmation of a contractual relationship between next-of-kin and a funeral home.
Daryl Pridy, Callahan-Edfast funeral director and assistant manager, confirmed the mortuary has the remains and cremation was “pending but on hold” until the legal issues surrounding the bodies are resolved.
“We want to do what’s best for the boys, as well as the legal representative,” Pridy said.
Aside from the short-term injunction, Diane Mathena is separately requesting that Deister make a final determination of her legal rights to bury her grandchildren, as opposed to the mother. Mathena argues she’s in a much better position to do just that and wants her grandchildren buried next to their father, Eric Jensen, in Palisade.
“The petitioner (Diane Mathena) bases this assertion on the current circumstances surrounding the death of William and Tyler and that those circumstances reflect an uncaring and potential criminal culpable respondent (Heather Jensen),” the filing reads.
Deister noted in his order Heather Jensen would be barred under Colorado law from directing final disposition of the remains if she’s arrested or charged with a felony in connection with the boys’ death. Heather Jensen has not responded to requests for comment from The Daily Sentinel. Nugent has said she’s been advised against making any such statements.
The Mesa County Sheriff’s Department continues to investigate the Nov. 27 incident which started with a 911 phone call from Heather Jensen at 6:31 p.m., who reported she was at Powderhorn Mountain Resort, according to a search warrant affidavit. She told dispatchers her youngest, William, 2, was unconscious, not breathing and had no pulse. He was pronounced dead when authorities arrived.
The affidavit said she reported around 6:50 p.m. that Tyler, 4, was having trouble breathing. Tyler died Monday after being removed from life support.

Agreed!! And I also don't understand the Mother's request to have her little dears cremated; unless there is something else she doesn't want found. This is really a tragedy and if innocent of premeditated murder my heart goes out to this young woman who so recently lost her husband - she may have just gone over the edge. Have they interviewed the man in whose truck "parked next to the SUV" she was in? Those poor little guys.

I find it appalling that the grandparents have to put up a bond to get a stay order on the cremation. They have enough to deal with the loss of their son and now their grandchildren.
This is heartbreaking and they shouldn't have to be fighting the legal system.

we honestly agree... this is new for Colorado they say they have never seem a case like this, the bond is to block cremation, in the hopes that "Heather Jensen" is arrested soon, then the grandparents are automatic next of kin... it always comes down to money..... we are fundraising and have set up a website for people to help, this is far from over put the community hopes to help the family with a small piece of closure, they haven't even had time to breathe let alone grieve, this has all happened so fast, media follows them everywhere, it's crazy.twinkletoes wrote:I find it appalling that the grandparents have to put up a bond to get a stay order on the cremation. Surprising Autopsy Report On Brothers Has Relative Concerned

DENVER (CBS4) – The autopsy report on two young brothers completed in Mesa County this week has an uncle of those boys feeling skeptical.
Rodger Mathena, uncle of William and Tyler Jensen, told CBS4 in Littleton on Tuesday he has trouble believing overheating is the cause of death in the case.
“I don’t see how a 2 year old and a 4 year old sitting in an SUV with no jackets or even socks on can die from hyperthermia,” said Mathena, a Littleton resident.
Earlier in the day the coroner in Mesa County released a report stating that the boys died from hyperthermia (not hypothermia) and that the deaths were accidental. It was a surprising development in the case, which investigators have been tight lipped about for weeks
“We are looking into a second opinion and are asking that they reopen it and maybe have another coroner look at it,” said Jessica Howard, a family friend.
The youngest boy, William, died on Nov. 27 in the vehicle, which was parked on a rural road in Mesa County near Powderhorn resort. His brother, Tyler, had also been in the car and ended up being transferred to a hospital in Denver where he died a week later.
Heather Jensen, the mother of the boys, allegedly told investigators she left them in the SUV — which was running — for more than an hour while she met with someone.
Mathena and Howard told CBS4 they are seeking justice.
“She left her children in a vehicle for over an hour and a half. I’m a mother, I would never leave my child in a car for an hour and a half,” Howard said.
CBS4 legal analyst Karen Steinhauser said just because the deaths of the boys was described as an accident by the coroner, that doesn’t mean charges won’t be filed.
“If the district attorney believes there is sufficient evidence she allowed those children to be placed in that situation then the DA can charge her with felonies,” Steinhauser said.
Mathena took part in a candlelit vigil in Littleton for the boys last month. He says the boys were “playful, normal and happy” and always had a smile on their face.
“There’s not a day that goes by that we don’t think about them,” he said on Tuesday.

Heather Jensen called 911 on Nov. 27 when she discovered that her sons Tyler, 4, and William, 2, were unconscious in the overheated Toyota 4Runner that idled near Powderhorn Mountain Resort.
William was dead on the scene. His brother was airlifted to a children's hospital, succumbing a week later, CBS Denver reported.
A Mesa County coroner ruled that the boys died accidentally from hyperthermia, station KJCT reported. But their 24-year-old mother was charged with two counts of child abuse resulting in death, two counts of criminally negligent homicide, and one count of false reporting to authorities, according to the sheriff's office.
Jensen initially told deputies that she left her sons in the car for 10 minutes when a friend who drove by stopped to talk, the Grand Junction Daily Sentinel reported. She later allegedly admitted that her children were unattended for 90 minutes after she climbed into the truck of a male friend.
The arrest Wednesday happened in North Fort Myers, Fla., where Jensen was staying with family members.
Her bond is set at $150,000.

In alleged violations of the terms of her probation, Heather Jensen failed three court-ordered drug tests in the months before the Nov. 27 incident on Grand Mesa that led to the deaths of her young sons, according to records obtained by The Daily Sentinel.
Steps to revoke Jensen’s deferred judgment—potentially jailing her for an unknown period of time—started in December and resulted in a court filing earlier this month.
“Ms. Jensen has produced urinalysis tests which tested positive for THC on the following dates: March 21, 2012, October 8, 2012, and October 26, 2012,” reads a summons and complaint filed by Mesa County Criminal Justice Services caseworkers, signed on Dec. 31.
THC is the primary intoxicant in marijuana.
The complaint said Jensen must appear in Mesa County court today, Jan. 18, to “show cause” why her deferred judgment shouldn’t be revoked.
“She did not report to produce a (urine) sample in the month of November 2012,” a caseworker wrote in the complaint. “On December 13, Ms. Jensen produced another urinalysis which tested positive for THC.”
The complaint was filed at the Mesa County Justice Center on Jan. 3.
Aside from the drugs, the filing suggests Jensen had trouble showing up to meetings with county officials. Caseworkers wrote in the filing she missed three scheduled check-ins since March 21, 2012.
The no-show dates aren’t specified, but they constituted more alleged violations.
Jensen, 24, waived extradition during a first court appearance Thursday in Lee County, Fla. She was ordered held without bond, while the Mesa County Sheriff’s Department has said it won’t release information on the timing of Jensen’s return.
Jensen was arrested Wednesday leaving her mother’s home in North Fort Myers, Fla., on a Mesa County warrant listing two counts of criminally negligent homicide, two counts of child abuse resulting in death while acting with negligence, and one count of false reporting.
The Palisade mother was charged by District Attorney Pete Hautzinger in connection with a Nov. 27 incident on Grand Mesa that led to the deaths of sons, William, 2, and Tyler, 4. The boys died of hyperthermia, or overheating, after they were left in their mother’s running Toyota 4Runner.
‘Isn’t unusual’
Mesa County Criminal Justice Services Director Dennis Berry, who reviewed Jensen’s file, said the handling of the probation appeared consistent with most deferred-sentence clients in Mesa County.
“Generally, on the first positive (for pot), we’ll deal with it internally, but a second we won’t,” he said. “This isn’t unusual for the kind of process for folks on a deferred judgment.”
Jensen was arrested March 13, 2012, for domestic violence after her husband, Eric, told Palisade police that a fight escalated after he confronted her about hanging out with friends she received medications from. Eric Jensen told officers his wife used Vicodin and Percocet, while she’d punched him during the fight.
She pleaded guilty to third-degree assault and received an 18-month deferred judgment. The agreement with the District Attorney’s Office gave Jensen a chance to erase the conviction if she stayed out of trouble, while complying with a host of terms and conditions.
Berry said the first positive drug test in Jensen’s case March 21 reflects marijuana in her system on the day she was first evaluated by Criminal Justice Services, after her sentencing. She also tested positive for opiates, according to court records.
The positive marijuana test on Oct. 8 likely would have led to discussions with Jensen and her treatment provider, among other steps, Berry said.
“The test from Oct. 26 we considered to be residual use (leftover THC from Oct. 8 test),” he said.
The Dec. 13 test, however, was deemed to reflect “new use,” which Berry said set wheels in motion for Criminal Justice Services staff to start the process for a possible revocation of probation.
Berry said Jensen missed “check-ins” with her case manager, for the third time, on Nov. 30.
Despite passage of Amendment 64 and medical marijuana in Colorado, Criminal Justice Services clients are generally prohibited from using any drugs, including marijuana, among terms and conditions of their probation. There are rare exceptions, Berry said.
A boyfriend of Heather Jensen’s told Mesa County sheriff’s investigators that Jensen allegedly admitted using marijuana on the night of Nov. 27 on Grand Mesa, when she allegedly met a man and had sex as her children were overheating in her nearby 4Runner.
‘Move on with my life’
In a hand-written letter addressed to Mesa County Court Judge Bruce Raaum, Jensen asked permission from the judge to leave Colorado, saying she’d “changed in a very good way” after completing court- ordered domestic violence counseling. The letter was dated Dec. 11.
“I believe it would be a great opportunity for me to start my life over again in Florida, and being surrounded by all my family who loves me to help me get through the losses I’ve had in this past month,” Jensen wrote in the letter. “And I would greatly appreciate it if you will let me move on with my life in Florida.”
The terms of Jensen’s deferred judgment said she had to remain in Colorado, absent prior court approval to leave. The sentence runs through September of this year.
Jensen apparently left anyway.
“The defendant’s request (to leave state) was not referred to the District Attorney’s Office for a response,” Deputy District Attorney Danielle Lewis wrote, objecting to Jensen’s request, despite the fact Jensen had already left Colorado. “The court did not rule on the defendant’s request to leave the jurisdiction, but rather stated that it had reviewed the defendant’s documentation.”
“Defendant does not have permission to leave the state,” Raaum wrote in a hand-written ruling.
The judge signed his ruling on Jan. 7.

“The test from Oct. 26 we considered to be residual use (leftover THC from Oct. 8 test),” he said.
The Dec. 13 test, however, was deemed to reflect “new use,” which Berry said set wheels in motion for Criminal Justice Services staff to start the process for a possible revocation of probation.
Berry said Jensen missed “check-ins” with her case manager, for the third time, on Nov. 30.
Despite passage of Amendment 64 and medical marijuana in Colorado, Criminal Justice Services clients are generally prohibited from using any drugs, including marijuana, among terms and conditions of their probation. There are rare exceptions, Berry said.
A boyfriend of Heather Jensen’s told Mesa County sheriff’s investigators that Jensen allegedly admitted using marijuana on the night of Nov. 27 on Grand Mesa, when she allegedly met a man and had sex as her children were overheating in her nearby 4Runner.
‘Move on with my life’
In a hand-written letter addressed to Mesa County Court Judge Bruce Raaum, Jensen asked permission from the judge to leave Colorado, saying she’d “changed in a very good way” after completing court- ordered domestic violence counseling. The letter was dated Dec. 11.
“I believe it would be a great opportunity for me to start my life over again in Florida, and being surrounded by all my family who loves me to help me get through the losses I’ve had in this past month,” Jensen wrote in the letter. “And I would greatly appreciate it if you will let me move on with my life in Florida.”
The terms of Jensen’s deferred judgment said she had to remain in Colorado, absent prior court approval to leave. The sentence runs through September of this year.
Jensen apparently left anyway.
“The defendant’s request (to leave state) was not referred to the District Attorney’s Office for a response,” Deputy District Attorney Danielle Lewis wrote, objecting to Jensen’s request, despite the fact Jensen had already left Colorado. “The court did not rule on the defendant’s request to leave the jurisdiction, but rather stated that it had reviewed the defendant’s documentation.”
“Defendant does not have permission to leave the state,” Raaum wrote in a hand-written ruling.
The judge signed his ruling on Jan. 7.
