A 24-year-old man is behind bars, accused in the death of an
8-month-old boy who likely suffered from shaken-baby syndrome, Monterey
police said.
About 3:30 a.m. Monday, officials with Lucile Packard Children's Hospital in Palo Alto
notified Monterey police investigators that "Baby Doe" had died from
his injuries, less than three days after he was admitted, said Lt.
Leslie Sonnà. Police said it was the first homicide in Monterey this
year. They first learned of the boy's injuries a little past 6 p.m.
Friday, Sonnà said, when they received a call reporting that a child
had fallen and was unconscious in a room at the Casa Verde Inn, 2113 N.
Fremont St.At the motel, officers found William Aguirre-Fajardo of Monterey alone in
a room with the baby, police said. The baby's mother was not present.Although
Aguirre-Fajardo told officers that the child had fallen, Sonnà said,
officers found that the boy's injuries were consistent with shaken-baby
syndrome. The condition results from intense shaking of a child,
according to the National Center on Shaken Baby Syndrome Web site."We
determined [Friday night] that the injuries were not consistent with
what he was saying and were consistent with the form of child abuse,"
Sonnà said of the boy's head injuries. The baby's name will not be disclosed at this time, she said.Sonnà
said Aguirre-Fajardo was arrested and taken into custody Friday night
on suspicion of corporal injury to a child, oral copulation with a
17-year-old and unlawful sexual intercourse with a minor. When
investigators were notified of the toddler's death early Monday
morning, she said, they additionally booked Aguirre-Fajardo on
suspicion of homicide and assault resulting in the death of a child
younger than 8 years. He's being held on $1.5 million bail.Sonnà said investigators are uncertain whether Aguirre-Fajardo is the biological father of the child. An autopsy on the toddler was scheduled on Monday afternoon.

WILLIAM AGUIRRE FAJARDO ORDERED TO STAND TRIAL, FACES LIFE FOR BABY'S DEATH
http://robocaster.com/sgvtribune/podcast-episode-home/california-ci_14525017/man-faces-life-for-babys-death-sex-with-teen-mom.aspx
A Monterey man was ordered to stand trial Friday on charges that he killed his girlfriend's 8-month-old baby.
William Aguirre Fajardo, 25, is charged with assault causing the death of a child, as well as a felony count of having unlawful sex with the child's mother, who was 17 at the time. If convicted, he faces a sentence of 25 years to life in prison. He will be arraigned and a trial date set March 19.
According to testimony at a preliminary hearing Friday, Aguirre Fajardo and the girl called 911 on July 24 from the office of the Casa Verde Inn in Monterey to report that the baby had fallen and was unconscious.
The girl, identified only as Jane Doe, said she and the defendant were at the motel for a weekly sexual rendezvous. Both were from El Salvador, which is where the baby's father resided. She had gone to the store and later to a restaurant to get food. When she returned, Aguirre Fajardo told her the baby had fallen off the bed.
The defendant told police his attention had been diverted by a cell phone when the infant rolled off the bed onto his face. He picked the baby boy up under the arms and saw he was bleeding around the nose and mouth and appeared "dazed." He said he shook the child "medium to hard" for two to three seconds in an effort to rouse the baby, then laid his head on his shoulder.
The boy's mother returned to the motel room, he said, and he handed her the crying baby. Aguirre Fajardo said she calmed the infant down and he fell asleep on the bed. Fajardo and the mother then had sex. When they realized the baby was unconscious, they ran to the office to call 911.
"Baby Doe" was rushed to Community Hospital of the Monterey Peninsula, then airlifted to Stanford's Lucille Packard Children's Hospital, where he died three days later.
District Attorney Investigator Christina Gunter testified that autopsies were performed by pathologists John Hain of Salinas and Stephany Fione of Sacramento Read Full Article...

Monterey man pleads guilty in baby death case
UPDATED 5:33 PM PDT Mar 14, 2012
MONTEREY, Calif. —William Aguirre Fajardo, 28, of Monterey, pleaded guilty on Wednesday to involuntary manslaughter in the death of an 8-month-old boy.
Fajardo also pleaded guilty to felony child endangerment causing great bodily injury and having unlawful sexual intercourse with the baby's underage 17-year-old mother. He will be sentenced to 11 years in prison.
In July 2009, Fajardo was baby sitting the 8-month-old, named "Baby Doe" in court documents, while the baby's mother was away.
Fajardo saw the baby fall off a bed and suffer a minor fracture to his head, prosecutor Rolando Mazariegos said.
Fajardo picked the baby up off the floor and shook him. Fajardo told police that Baby Doe looked “dazed” and he shook the infant to get him out of the daze, Mazariegos said.
When the baby's mother returned, she played with her baby and did not notice anything was wrong.
A short time later, the infant lost consciousness and struggled to breath.
Baby Doe was transported to Lucille Packard Children’s Hospital in Palo Alto, where he died on July 27, 2009.
Medical experts said Baby Doe's fatal injuries were caused by a combination of a blunt force impact and forceful shaking.
