Cause of death determined for 23-month-old
By Jessica Bruha and Hannah Cruz
The Norman Transcript
NORMAN — The cause of death of 23-month-old Kiyla Rose Hosler was determined Wednesday by the State Medical Examiner’s Office to be homicide.
Chief Administrative Officer Amy Elliott said the cause was blunt force trauma to the head.
Jeremy Robert Howard, 25, is facing a first-degree murder charge.
He was determined to be the sole care taker of Hosler. He was arrested and booked into Cleveland County Detention Center on April 12.
Investigators said the girl sustained a variety of injuries while under Howard’s care. It is believed that Howard is in a relationship with Hosler’s mother, Amanda Hosler. Court records show Howard and Amanda residing at the same address.
“What this man has done is wrong on so many levels,” Amanda Hosler said. “She was not abused nor in an abusive home at all. I want to help other families that have to face anything close to this.”
Amanda said her little girl was “amazing and could brighten anyone’s day.”
Officers responded to a report of an unresponsive child at 1917 Twisted Oak Drive, Apartment C, at 8:40 p.m. April 11. Hosler died after being transported to Norman Regional Hospital.
During an interview with police at the hospital, Howard admitted to throwing Hosler in the air, striking the back of her head with his steel-toed boot and throwing her face-down into the corner of a couch.
He then went without checking her welfare for 30 minutes, stated the affidavit filed with the charge.
“After he found her in distress, he attempted to resuscitate her by pouring water in her mouth, attempted to call the child’s mother and then eventually called 911,” the affidavit reads.
Hosler was found to have numerous abrasions to the front of her head, water in her lungs and blood in her stomach.
She also was diagnosed with a possible skull fracture as well as having a month-old broken leg in a cast, the affidavit stated.
Howard was previously charged with domestic abuse assault and battery in January the same time his ex-wife filed a protective order against him. The charge was deferred after a guilty plea in February.
Hosler’s mother also filed a protective order against Howard after Kiyla’s death.
Howard may receive one of three punishments, life with parole, life without parole or death, District Attorney Greg Mashburn said. The sought form of punishment will be determined after more evidence is reviewed and after speaking with the family.
Mashburn said it is undetermined if any other parties will be charged with Kiyla’s death.
To those suspicious that a child is being abused, call the police or the DHS hotline at 1-800-522-3511.

Jeremy Howard, on trial for the first-degree murder of a Norman toddler, was found guilty by a Cleveland County jury Friday evening and given a recommended prison sentence of life without parole.
Jurors deliberated for approximately an hour and a half before returning their verdict. Tears spilled on both sides of the courtroom Friday from both Howard's family and the little girl's.
Formal sentencing for Howard was set for 1:30 p.m. Feb. 18, 2015 in District Judge Tracy Schumacher's courtroom.
Despite a power outage that affected the courthouse, the jury heard closing statements and were sequestered around 4 p.m. The power returned at 4:30 p.m., Schumacher said.
Howard told his final story to jurors Friday afternoon when he testified.
Kiyla Rose Hosler, 22-months-old, died April 11, 2013 due to blunt force trauma to the head. Howard told the court, while under oath, he was trying to calm down the fussy toddler by throwing her up in the air.
He didn't catch her on her way down though. She ended up hitting her head on the floor — a carpeted, padded living room floor — and he heard a crack, he said. The little girl immediately was unconscious and after failed attempts to wake her, he took her to the kitchen.
Howard said he stuck her head under cold water to "revive" her or wake her. To account for the marks on the child's forehead that her mother said were not there before she left that night, he said he could have possibly hit her head on the faucet twice.
The water didn't wake Kiyla so he took her back into the living room, laid her on the floor in front of the couch and called her mom. The mother, Amanda, didn't answer so he called 911, he said.
Dispatch told him how to perform CPR, which he said he then did to try to resuscitate the child. When police officer Chad Radgowski arrived he testified earlier this week he found Howard hunched over the child appearing to be poking the girl with his finger.
Howard testified Friday the officer lied.
According to phone records, the events that unfolded that night all happened within two minutes. Howard had been on the phone with Amanda that night after she left their apartment to go to Little Axe to feed her dogs.
Their second phone conversation ended at 8:37 p.m. when Howard said he hung up because he had to go to the bathroom. He told prosecutors he thought he was in the bathroom for approximately five minutes.
That's when he came out and Kiyla was fussy and everything unfolded. Phone records show he called Amanda back to tell her Kiyla was unconscious at 8:39 p.m.
When prosecutor Christy Miller asked Howard if all of those events happened in that two minute time frame — going to the bathroom, finding Kiyla fussy, throwing her in the air, dropping her, trying to wake her, taking her to the kitchen, putting her under the faucet and then taking her back to the living room — he said, yes.
Furthermore, he said he lied to Detective David Freudiger about everything. Every story he told prior to the one he told jurors Friday, he said was a lie.
Assistant District Attorney Jennifer Austin said during closing statements Howard has historically shown the jury he changes his story a little more each time he tells it.
"This is a man who's trying —last ditch effort — not to go to prison for the rest of his life," Austin said.
After sitting in court for a week, seeing all the evidence and hearing everyone's testimony, Miller said he changed his story again Friday to try to account for the injuries Kiyla sustained.
However, both prosecutors reiterated his story wasn't enough. There were too many injuries unaccounted for.
"She did not die from one accidental fall," Austin said. "There were multiple impact sites. Multiple blows to the head."
The only story he told that even came close to what might have happened that night was the story Howard told Freudiger during his last interview that was audio recorded, Austin said.
He told the detective he threw her up in the air, struck her in the back of her head with his steel-toed work boot and then threw her face-down into the couch where she was so far wedged in between the cushions the only part of her body visible was from her shoulders down, prosecutors said.
Doctors from the Medical Examiner's Office testified Thursday there were 14 total injuries on her head; 12 of which occurred within three hours of the toddler's death.
It's possible that the child only received six blows to the head because one blow can cause two injuries due to initial contact and the initial contact causing her to hit the ground or another surface, prosecutors said.
"The defendant's story today in no way corroborates all these injuries," Austin said. "We still don't have the full story today."
