York mother disputes events leading up to child's death




A York woman was charged recently with endangering the welfare of children after her 2-year-old was beaten to death while in someone else's care.

A York woman who left her 2-year-old son in the care of a man accused of killing him disputes some of the events police cited in charging her recently with endangering the welfare of her children.

York City Police allege Jaques Twinn died Nov. 7 after being beaten to death by Aric Shayne Woodard, 39. Last week, police charged Jaques' mother, Hayley Amanda Twinn with two counts of endangering the welfare of her children, for leaving them in Woodard's care.

Police say Twinn refused to put her kids in childcare, and left them with Woodard knowing Jaques had been injured twice before in his care.

Twinn said Saturday that Woodard was a family friend who once or twice a week would watch Jaques and his now 2-year-old sister for a few hours.

Twice, Jaques came home with bruises, and Twinn said Woodard told her one was the result of him falling at the park, the other was when he slipped in the bathroom. Police noted Jaques suffered two injuries -- to his face and head -- while in Woodard's care.

"Everyone's saying I knew," Twinn said. "Nothing ever showed as though it was a sign."

York City Police Lt. Tim Utley couldn't be immediately reached for comment.

Twinn left her kids with Woodard on Nov. 6 because she was having medical issues. She said it was the only time the kids stayed with him overnight.

When she returned home after going to the doctor, her roommate told her Jaques had drowned.

An autopsy would later reveal he was beaten to death.

According to charging documents, Twinn knew that Woodard was squatting in what was essentially an abandoned house that was owned by his mother. Detective Alan Clarkson wrote in the affidavit that she had been in the house numerous times and knew it was in poor condition, was dirty, had no food and "devoid of any child-appropriate furniture."

But Twinn said there was food, because she got her food stamps a few days before.

Police also said Twinn refused "quality childcare," and that the woman who was caring for Jaques prior to October, came by the house the day of Jaques' death to check on him.

They said she was worried about the kids since they were pulled out of her care, and she wanted to ask Twinn about the injuries she saw on Jaques.

Twinn said the woman never asked about bruises, and that she pulled them out because fees related to childcare were too expensive.

"I had to pay rent," she said. "Make sure the kids had food, shoes."

Police also allege that Jaques failed to make it to scheduled doctor appointments for his eczema.

Twinn said he never missed appointments, and that before his death, his skin condition was under control.

"I'm 20 years old," Twinn said. "I'm trying to do everything by myself."

Since Jaques' death, Twinn said, she's started counseling and parenting classes.

Her mother took Jaques' sister in voluntarily, Twinn said, and she's been visiting often. After charges were filed, Twinn said, her mother was given custody.

"All I was trying to do was get better so I could take care of my kids," she said.

Police said Woodard believed he was in a relationship with Twinn, but she said he was a family friend who used to date her sister. Her sister lived with him for seven months and he often cared for her kids without incident, she said.

Ever since Jaques' death, Twinn said it's hard to concentrate. She's used to being with both kids 24-7.

Every time it's brought up in the news -- her recent charges, or the district attorney's office opting to seek the death penalty against Woodard -- people stare at her on the street and yell at her.

"It's like it's happening all over," she said. "I can't handle it no more. I just want my son to rest in peace."

Speaking through tears, Twinn said her son was the "greatest little boy ever."

He loved dancing, dressing himself -- even if he put his clothes on backward -- and he said hi to everyone they passed on the sidewalk when they'd walk somewhere.

"He was my first child, my son," she said. "He was a momma's boy."

An autopsy later revealed the boy had been beaten to death. The cause of death was multiple blunt force trauma and the manner was homicide, according to the coroner report.

Woodard has been charged with criminal homicide, and prosecutors are seeking a first-degree murder conviction.

In May, the York County District Attorney's Office said it would seek the death penalty.

The prosecution said it is seeking the death penalty because the victim died by means of torture and was younger than 12.

Woodard, 39, remains in county prison without bail.

Capital trial starts Monday for York man accused of killing toddler

The capital murder trial of a York City man accused of fatally beating a toddler he regularly baby-sat is set to begin at 9 a.m. Monday with opening statements.

On Thursday afternoon, prosecutors and defense attorneys finished seating a 12-person jury and four alternates, according to Dawn Cutaia. She and fellow attorney Joanne Floyd represent defendant Aric Shayne Woodard.

Woodard, 40, of West Jackson Street, remains in county prison without bail, charged with first-degree murder and related offenses in the Nov. 7, 2011, death of 2-year-old Jaques Twinn.

York City Police allege Woodard, who goes by Shayne, beat Jaques to death while baby-sitting him in a home in the 100 block of West Boundary Avenue.

In seeking the death penalty, prosecutors have cited two aggravating factors: Jaques' young age and that his death allegedly amounted to torture.

The background: Woodard was baby-sitting Jaques and his 1-year-old sister when he ran to neighbors and had them call 911, police said.

An ambulance rushed Jaques to York Hospital, where hospital personnel were told that Woodard reported the tot nearly drowned, according to preliminary hearing testimony.

But an autopsy determined Jaques was beaten to death, police said, and suffered wounds to his brain, face, ears, stomach, back, buttocks and legs. He also suffered internal abdominal injuries, officials have said.

Mess made: Woodard told police he left the children alone to go to a nearby store.
When he returned, he found Jaques sitting on the kitchen floor, smearing feces all over himself, according to York City Detective Al Clarkson.

Woodard told investigators he became frustrated and smacked the boy, then "snatched him up by the ear" and ordered him to go upstairs and clean himself, Clarkson said.

Woodard told detectives that when he checked on Jaques, the boy was sitting in the bathtub, slumped over and unresponsive, according to Clarkson.

Clarkson said he determined Woodard was the only adult with Jaques between about 8 p.m. Nov. 6, 2011, and when 911 was called about 2:30 p.m. Nov. 7, 2011.

Frustrated? According to Clarkson, Woodard had feelings for Jaques' mother, Hayley Twinn, but she did not feel the same. He also said Woodard considered the children his own.

"(Woodard) became frustrated that day," Clarkson has said. "He knew she was out with somebody else, and he realized she was using him to watch her kids while she was out with another guy. Whether that's the reason he snapped and did this? Well, that's something we're going to have to try to prove."

Defense attorney Floyd has said there's no definitive answer as to when the injuries were inflicted on Jaques, or who inflicted them.

Mom charged: York City Police charged Twinn, 21, of East King Street, with two counts of child endangerment, alleging she put her two children in danger by leaving them with Woodard.

Police allege Twinn knew Woodard was basically squatting in what essentially was an abandoned house in poor condition, but that she regularly allowed him to watch her 1- and 2-year-old children there anyway.

Defendant cries upon seeing autopsy photos in murder of toddler

Aric Shayne Woodard put his head down on the defense table and cried when autopsy photos of 2-year-old Jaques Omari Twinn's body were shown to the jury Tuesday.

Many of the people sitting on the defense side of the York County courtroom also avoided looking at the pictures, lowering their heads or covering their eyes.

Woodard, 40, is on trial in the beating death of Jaques, the son of a friend, who he was baby-sitting. The toddler died Nov. 7, 2011.

Dr. Samuel Land, a forensic pathologist who performed the autopsy, testified that Jaques died of blunt force trauma to the head and torso. The boy's injuries included fatal lacerations to his liver and brain trauma, he said, adding they are the types of injuries he usually only sees in victims of vehicle crashes.

Land testified that some of the toddler's injuries were days older than the injuries that killed him and that he found newer injuries on top of older healing ones.

The boy also had a hugely distended belly in the autopsy photos. Land said that was because his abdomen and kidney-area were filled with half of a liter of blood. Jaques' skin had a mottled appearance in the photos because of the all-over bruising.

"I can't tell how many times this child was injured," Land said.

At York Hospital, while waiting on word of Jaques' condition, Woodard told a chaplain, according to police, that he had spanked the boy when he soiled himself and sent him upstairs to the bathroom.

Woodard went on to say he checked on the boy minutes later and found him seated in the bathtub with his head between his legs and his face in the water.

Land said Jaques did not drown. He added a "neurologically intact" 2-year-old would have been able to lift his head from the water.

Land said the autopsy revealed "the wiring" between the two halves of Jaques' brain had been torn. He said that, coupled with the other injuries, would have made it apparent to any caregiver that the boy needed immediate medical attention.

On Monday, Jaques' mother, Hayley Twinn, testified she could not afford to take her children to day care and trusted Woodard to watch them. Twinn is charged with endangering the welfare of a child and remains subject to recall by the defense.

The prosecution has one remaining witness who will be called today. He is lead investigator Detective Alan Clarkson.

York baby sitter guilty of first-degree murder, faces death penalty

Despite screaming and cursing for at least an hour as he waited in a courtroom holding cell, Aric Shayne Woodard remained calm -- though not quiet -- after being brought to the courtroom, even as jurors announced they'd found him guilty of first-degree murder.

The same jury will have to decide whether to sentence Woodard to death or to life in prison without the possibility of parole. Jurors deliberated about 4-1/2 hours before reaching their verdict.

The trial's penalty phase is set to begin Monday morning.

Jurors also had the option of finding Woodard guilty of either third-degree murder or involuntary manslaughter, but rejected those choices.

Prior to the verdict being read, 13 sheriff's deputies positioned themselves throughout the courtroom -- something Woodard did not fail to notice.

"All this for me?" he asked as he was led to the defense table. He laughed and smiled.

"Everybody be scared."

Woodard remained calm and never lost the smile on his face as he listened to the jury's verdict.

Mocked prosecution: After jurors left the courtroom, Woodard faced York City Detective Al Clarkson and first assistant district attorney Jennifer Russell and clapped his hands at them, still smiling.

"Good job, good job," he said mockingly.

Woodard also mildly chided his own defense attorneys, then turned around to console his family and friends, some of whom were crying.

He made eye contact with The York Dispatch reporter and asked, "You writing all this down?"

Earlier this week, during a break in trial, Woodard told Clarkson he hated him, according to Clarkson.

"He can hate me all he wants," the detective said after the verdict. "He's going to jail for the rest of his life -- at least."

The case: Russell convinced jurors that Woodard, 40, of West Jackson Street, fatally beat 2-year-old Jaques Twinn on Nov. 7, 2011, while baby-sitting the boy and his 1-year-old sister.

Clarkson said Woodard, who goes by Shayne, left the children alone to go to a nearby store and that when he returned, he assaulted the child after realizing Jaques had smeared feces on the kitchen carpet.

Woodard had feelings for the children's mother, Hayley Twinn, but she did not reciprocate, Clarkson said.

"(Woodard) became frustrated that day," the detective has said. "He knew she was out with somebody else, and he realized she was using him to watch her kids while she was out with another guy."

Earlier this week, forensic pathologist Dr. Samuel Land testified at length to the numerous injuries he documented while performing an autopsy on Jaques.

They included injuries to the child's brain, face, ear, stomach, back, buttocks and legs, as well as internal abdominal injuries that included a badly lacerated liver.

Alternate theory: Trial defense attorney Joanne Floyd argued Jaques drowned in the bathtub, and that the injuries he suffered were primarily from aggressive, prolonged CPR.

A forensic pathologist for the defense testified that was his medical opinion.

The other half of the defense team, Dawn Cutaia, will now take over for the penalty phase.

'Distraught': Cutaia said Woodard has instructed her not to present any mitigating evidence at the penalty phase, which increases the chance he will receive the death penalty.

"My client is emotionally distraught ... and I'm not going to rely on his ability to make a decision right now," she said.

Cutaia said she will discuss the issue with Woodard, but said no matter what he decides, she still believes she must try to save his life.

"Whether he wants me to or not, I believe I have an ethical obligation to put on mitigating evidence," she said.

The recorded voice of 2-year-old murder victim Jaques Omari Twinn filled Courtroom 10 on Monday during the penalty phase of his convicted killer's capital trial.

"Choo-choo train goes choo-choo! ... I be cool ... because I'm JaJa! ... I'm a big boy," the toddler repeated in a sing-song voice at the urging of Aric Shayne Woodard, the baby sitter found guilty last week of beating Jaques to death.

Woodard smiled as he listened to the recording from the witness stand. He had the recorded exchange on his cell phone, which he held up to a microphone in court for jurors to hear.

"I'm innocent," he then told the jury. "You didn't make me guilty -- you found me guilty. ... I sit in my cell every day and ask God, 'Why am I here?'"

Death imposed: But jurors weren't swayed.

It took them two hours to unanimously agree to sentence Woodard, 40, to death.That happened about 5:30 p.m. Monday, after 16 sheriff's deputies took their places around the courtroom.

Woodard did not visibly react, though several of his family members and friends gasped.

Presiding Common Pleas Judge Michael E. Bortner set sentencing for Nov. 21, but it is merely a formality.

First assistant district attorney Jennifer Russell said the jury did the right thing.

"Obviously we feel the jury returned the just verdict in this case, based on the evidence," she said.

Defense attorneys Dawn Cutaia and Joanne Floyd said all death-penalty convictions are automatically appealed to the state Supreme Court.

"It's mandatory," said Floyd, who admitted she was stunned the jury voted for death.

Cutaia said it was hard to overcome the prosecution's argument that Jaques' death amounted to torture.

Not for money: On the stand, Woodard told jurors "the full story was not presented because of legalities," and said if all he knew about the case was what he'd heard during trial, "I would have found me guilty."

Woodard told jurors he never took payment for watching Jaques and the boy's 1-year-old sister, Janiyah, because it was never about money.
"I miss Janiyah and Jaques so much ... I pretty much feel like dying," he said. "There was nothing better in my entire life than spending time with (them)."
'His' kids: Woodard repeatedly testified he considered the children his own, despite the fact that he and the children's mother, Hayley Twinn, were not romantically involved.
Woodard said he fed them, cared for them, and did what he could to "enrich" their lives.

The convicted murderer said he believes Jaques is "looking down" at him and saying, "Yeah, Daddy, get your chin up off your chest."

Woodard never said the words aloud from the witness stand, but insinuated he would rather receive the death penalty than life in prison. From the stand, he addressed Bortner directly, saying he knows the judge is aware of his preference for death.

Woodard also told jurors he holds no animosity toward them. He thanked them for apparently keeping him out of trouble.

"I was so angry at (lead Detective Al Clarkson) ... and his cohorts," Woodard said. "If you guys would've let me out the other day, I might've done something stupid."

The hearing: Prosecutors Russell and Duane Ramseur presented no testimony, instead relying on testimony from the trial's guilt phase to prove the two aggravating circumstances they say warrant the death penalty -- the victim's young age and that his beating death amounted to torture.
Cutaia called eight character witnesses on Woodard's behalf, including his mother, brother, other family members, an acquaintance he knows from church and a co-worker who worked with Woodard at a York City barbershop.

Cutaia confirmed it was initially difficult to get the family to agree.

"Lots of people want to testify on his behalf. ... (But) he has repeatedly said he does not want to put them through that, and it would be hard for him to listen to them saying good things about him," Cutaia said. "(Co-counsel) Joanne Floyd and I were able to convince them, even though Shayne didn't want them to."

'Kind, gentle': All eight character witnesses spoke about Woodard's way with children. All eight described Woodard as kind, loving and gentle.

"We used to call him the Pied Piper," his mother, Barbara Woodard, testified. "My son Shayne is one of the nicest, kindest people you will ever meet in your life."

Co-worker Bandele Ogundipe said he worked with Woodard for three or four years at the Basement Barbershop and that they became as close as brothers.

Still, he said, it made him jealous that kids only wanted Woodard to cut their hair.

"He always kept them happy," Ogundipe said.

James Woodard described his baby brother as "a gentle giant" who helped care for James Woodard's newborn son full-time because the baby's mother was bedridden.

Arguments: Russell argued to jurors that there was a different side to Shayne Woodard than his loved ones saw.

"He was taking out his frustration on that child," she said, and noted Jaques could have suffered for hours before eventually dying.
"How is that anything but cruel?" she asked.

Cutaia told jurors the prosecution didn't want the jury to see her client as "a complete person, a human being."

"Aric Shayne Woodard is more than just this terrible thing he did," she told jurors, warning them that if they impose the death penalty "you can never take it back."

She said her client is basically a good guy who deserves to live.

Cutaia also made sure jurors knew that in Pennsylvania, there is no possibility of parole for first-degree murder convictions.

Happy, friendly boy: Jaques was the son of Hayley Twinn of York and Tyrone Kemp of Baltimore.

His paternal grandmother, Brenda Dugan, described Jaques as a friendly, loving boy who was very protective of his little sister.

"He looked after Janiyah," she said, and would rush to intercede "if she was getting into something she shouldn't."

Jaques liked to sing and dance, often to theme songs of television shows such as Family Guy.

"He'd try to sing along right with them," Dugan said shortly after Woodard's arrest. "He was a beautiful little boy. I cry every day since we lost him. We all miss him so much."

Jaques liked to greet everyone he met, often repeating his greeting: "Hi! Hi! Hi," his grandmother recalled.

"That man ruined my life when he killed Jaques," Dugan said. "I loved that little guy so much."

The mother of a York City toddler murdered by his baby sitter more than two years ago has pleaded guilty to endangering her children.

Hayley Amanda Twinn, 22, of East King Street, avoided prison as part of a negotiated plea agreement.

On Wednesday, she pleaded guilty to two counts of first-degree misdemeanor child endangerment and was sentenced to five years of probation.

"She's extremely remorseful," defense attorney Heather Reiner said. "(Her son's murder) has been a life-changing experience for her."

Twinn's 2-year-old son, Jaques Omari Twinn, was fatally beaten on Nov. 7, 2011, by Aric Shayne Woodard. Jaques suffered injuries to his brain, face, ears, stomach, back, buttocks and legs, and also suffered internal abdominal injuries.

Death sentence: Woodard, 40, was convicted in October of first-degree murder. In December, he was sentenced to death. Twinn regularly left Jaques and his younger sister with Woodard, even though he watched them in a squalor-filled home and despite the fact Twinn had "quality child care" available to her, court documents state.

York City Detective Al Clarkson has said that on the day Jaques was killed, Woodard left the children alone to go to a nearby store. When he returned, he attacked Jaques after realizing the toddler had smeared feces on the kitchen carpet and himself.

Spurned: Woodard had feelings for Twinn, but she did not reciprocate, according to Clarkson.

At his murder trial, Woodard said he had no romantic interest in Twinn. But at his sentencing hearing, he professed his love for her in open court.

Twinn knew Woodard was basically squatting in an "essentially abandoned house" at 140 W. Boundary Ave., court documents state. At least twice while in Woodard's care, Jaques suffered injuries to his face and head, but Twinn continued to have Woodard watch her children, documents state.

Improved life: "It's hard for her to even talk about it," Reiner said of her client.

"I think her way of coping with it has been to try to improve herself and her life, and do the best she can for her kids now."

Since Jaques' murder, Twinn has completed parenting classes and works full time, according to Reiner.

"She's done everything asked of her," the attorney said. "I'm impressed with how she's changed her life.

"I think she was just in a bad place and not making good decisions," she said. "But she obviously didn't anticipate anything like this would happen."

First assistant district attorney Jennifer Russell, who prosecuted the case, declined comment.
