Infant declared brain dead after alleged abuse; family battles hospital

LOUISVILLE, Ky. (WHAS11) -- A court battle is brewing after a 2-month-old allegedly abused by his father was declared brain dead.

Juan Lopez Rosales is charged with criminal abuse and police said he is responsible for severe injuries to his infant son Isaac Lopez.

Police said Rosales hit the boy's head on a wall and the bathtub several days before his arrest.

Isaac Lopez was admitted to the hospital Sunday with a skull fracture and a hematoma. The 8-week-old was declared brain dead and is on life support at Kosair Children's Hospital.

Leslie Bates, the attorney for Isaac Lopez’s family, went to court Thursday morning asking for Kosair to keep the child on life support for at least 30 more days.

“What the family is requesting is time and another evaluation. This is really about time to give this child an opportunity to recover,” Bates said.

Kosair filed a court motion asking to remove the infant from life support.

In a statement a representative from Kosair said the following:

“The patient has been under our care for several days, remains unresponsive to all resuscitation efforts and is clinically brain dead.  Medically there is no chance of recovery.  We will continue to provide the best care possible as we await guidance from the court on how to proceed.  Kosair Children's Hospital is interested in doing only one thing--what is in the best interest of this patient.”

Rosales is also being looked at by immigration; that agency has put a hold on him at Metro Corrections.

Rosales has pleaded not guilty and is being held on a $100,000 bond.
