A man charged with killing
his 7-week-old daughter is being held at the Tygart Valley Regional
Jail until a preliminary hearing next week.

Twenty-five-year-old Stewart Fernandez was arrested earlier this week and charged with the baby's December death.
County sheriff's deputies say the baby was unresponsive when she was
taken to a local hospital the week before Christmas, then transferred
to Ruby Memorial Hospital. She died four days later on Dec. 22.
Investigators say Fernandez assaulted the child, causing fatal blunt force injuries.
He was jailed earlier this week on $220,000 bond and faces up to 40 years in prison if convicted.
A preliminary hearing is set for Aug. 20.

The father of a 7-week-old infant girl who died in December as a result
of blunt force trauma remains in the Tygart Valley Regional Jail on
$225,000 bond after being arrested for her death.

Stewart Michael Fernandez, 25, is facing charges stemming from the
death of Alivia Ann Fernandez on Monday, December 22, 2008. Fernandez
was watching his daughter between 4 and 9 p.m. on December 18, 2008
when he allegedly assaulted her causing multiple blunt force injuries
that directly resulted in her death, according to the file in the
magistrate clerk’s office.

Alivia was taken to St. Joseph’s Hospital and later transferred to WVU
Children’s Hospital with life threatening injuries, according to a
press release. She remained at the WVU hospital on life support until
her death on December 22, 2008.

Fernandez was arrested by lead investigator Deputy First Class Dewaine
Linger, of the Upshur County Sheriff’s Department. He was assisted in
the investigation by Lt. Mark Davis.

Magistrate Mike Coffman arraigned Fernandez Tuesday.

Fernandez’s attorney has filed a motion to reduce bond, with that
hearing scheduled for Friday. A preliminary hearing will be held August
20.

If convicted, Fernandez faces 10 to 40 years in prison.

The trial for an Upshur County man accused of causing injuries resulting in the
death of his seven week old daughter is continued.
Stewart Fernandez was supposed to head to trial April 15. Instead, his
attorney asked for a continuance because he needs more time to get ready for the
trial. It's now set to start on August 17.
Fernandez was arrested on charges of death of a child by parent or guardian
in August of 2009, following an investigation into the baby's death. The
incident happened back in December of 2008, when his daughter was taken to the
hospital and died four days later.
The Upshur County Sheriff's Department is investigating the case.

BUCKHANNON -- An Upshur County man pleaded guilty to child neglect resulting in death on Thursday.
Stewart Michael Fernandez, 26, appeared before Circuit Court Judge Thomas Keadle.

Fernandez admitted he injured his six week old daughter, and caused her death in December 2008.

Fernandez remains at the Tygart Valley Regional Jail.

He'll be sentenced on Jan. 4, 2011, and could face 3-15 years in prison.

The Buckhannon man accused of shaking his 7 week-old daughter to death, will spend the next 3-15 years behind bars.

Stewart Michael Fernandez, 26, pleaded guilty to child neglect resulting in death, in December. Tuesday morning he was sentenced to 3-15 years behind bars, with credit for the 1 1/2 he already served.

Police say his daughter died from injuries in December of 2008.
