A 22-year-old Lake Wales man has been
charged with aggravated child abuse in connection with the death of a
17-year-old runaway who was in foster care.
Nathaniel Abbatoy may have contributed to the death of the girl by
providing her drugs such as cocaine, marijuana and methamphetamine,
according to Polk sheriff's arrest records. He was arrested Monday and
released Tuesday from the Polk County Jail on $17,500 bail.The
girl, Janice Moat, died early Sunday morning at Lake Wales Medical
Center, after being found unresponsive at the home Abbatoy shares with
his parents, an arrest report and child-welfare officials said.An
autopsy revealed evidence of drug use, although the official cause of
death is pending a toxicology report, an arrest report said.Moat
was a habitual runaway, and at the time of her death she was on runaway
status. Caseworkers had been working with her for some time to
establish a place of residence where she could be happy, said Ann
Berner, administrator of the state Department of Children &
Families circuit that includes Polk.Berner would not discuss
further information relating to Moat's history in foster care, citing
confidentiality laws covering juveniles.Abbatoy has a history of
arrests, mostly for petty drug charges, dating to October 1986.
According to arrest records, witnesses gave investigators the following
account that preceded Moat's death:On Saturday, Abbatoy and Moat
were seen smoking methamphetamine at a city park, and Abbatoy admitted
as much to investigators, adding that the two also used cocaine and
marijuana on the day before Moat's death.At 4:30 a.m. Sunday,
EMS arrived at Abbatoy's home, where Moat was found unconscious. She
was taken to Lake Wales Medical Center where she was pronounced dead a
short time later. Preliminary autopsy results "were consistent with the
ingestion of illegal drugs," according to a complaint affidavit.Before fleeing,
Abbatoy sprayed Moat with a garden hose and placed her into a bathtub in an attempt to render aid.

23-Year-Old Lake Wales Man Gets Three Years In Teen's Overdose Death

BARTOW | A 23-year-old Lake Wales man accepted a plea deal Friday for giving drugs to a 17-year-old runaway who fatally overdosed.

Circuit Judge James A. Yancey sentenced Nathaniel Abbatoy to three years in prison and seven years of probation.

As part of a plea deal, Abbatoy pleaded no contest to delivery of cocaine and methamphetamine to a minor.

Prosecutors dropped charges of third-degree murder, aggravated child abuse and possession of drug paraphernalia.

Janice Moat, who was in foster care, was a habitual runaway and, at the time of her death, she was on runaway status, according to the state Department of Children and Families.

Rescue workers found Moat unresponsive Aug. 9, 2009, at the home on Silver Oak Court in Lake Wales where Abbatoy lived with his parents, arrest reports state.

Abbatoy had fled the home but before doing so sprayed Moat with a garden hose and placed her into a bathtub in an attempt to render aid, reports state.

Moat was taken to Lake Wales Medical Center and pronounced dead.

One witness recalled Abbatoy had three plastic baggies the day before with various drugs, and he and Moat intended to use the drugs.

Other witnesses told investigators they saw Abbatoy and Moat later that day smoking drugs together, reports state.

Abbatoy's release date is 9-12-2012
