"Jane Doe" - teen (2004) - Sandy OR
A Sandy man accused of sexual misconduct
with a teen-age girl pleaded no contest to five felony counts before
Clackamas County Circuit Court Judge Robert D. Herndon Wednesday, Aug.
19.
Mikel B. Fair, 41, 17550 Bluff Road, was first
arrested Dec. 17, 2008, and later indicted by a Clackamas County grand
jury on 12 criminal counts, including nine felonies.
The incidents are alleged to have occurred between April 10, 2004 and April 9, 2007.
After hearing the evidence Deputy District
Attorney Scott Healy would have brought forward in a trial, Herndon
found Fair guilty on the five counts for which he had pleaded no
contest.
The seven counts that Healy proposed to dismiss
included one count of third-degree rape, two counts of third-degree
sodomy, two counts of endangering the welfare of a minor, unlawful
delivery of marijuana to a minor and furnishing alcohol to a person
under 21.
The Post is not identifying the female victim or
her relationship with Fair, even though she is now over 18, because she
was a teen-ager in school at the time of the alleged sexual episodes.
Fair’s trial, delayed several months because
witnesses weren’t available, was scheduled to begin at 9 a.m.
Wednesday, Aug. 19, but last-minute negotiations — between Healy and
Fair’s attorney, David Hall, as well as Fair and his family members —
postponed the court appearance until 10:45 a.m., when Fair entered his
pleas without any comment or explanation.
