Leo Cisneros has been found not guilty of contributing to his daughter's shooting death by selling drugs from their home.
Ten-year-old Auralia Cisneros was shot and killed on Nov. 26, 2007 as her father exchanged shots with intruders at their door.
Jurors were forced to decide if 29-year-old Cisernos could
"reasonably foresee" that armed robbers might come to his house to rob
him of drugs or money. Deliberations in the trial began Friday and
continued Monday morning before jurors reached a verdict.
The not guilty verdict of child abuse resulting in death came down shortly before 1 p.m. on Monday.
Cisneros was found not guilty of all counts related to child abuse. He was
convicted on a felony drug charge relating to marijuana. Cisneros'
attorneys had asked the jury to convict him on the drug charge as he
had previously admitted to it.
After the verdict was announced, defense attorney Laura Menninger said she believes this to
be a first of its kind case in the nation.
Chief Deputy District Attorney George Poland did not answer questions following the verdict.
Cisneros, who declined to testify on his own behalf during the trial, did not comment after learning his fate.
The three robbers, Joshua Rojas, Trivi Trujillo and Juvencio Hernandez,
have pleaded guilty to second-degree murder and received sentences
between 16 and 24 years in prison.
Rojas and Trujillo testified during the trial.
