A man faces two counts of second-degree manslaughter after police
said he swung a child by her ankles and then delayed medical attention
when she was hurt, which resulted in her death. Justin David
Lake, 29, formerly of Cannon Falls, now living with his parents in
Wisconsin, was initially charged with first-degree assault and neglect
or endangerment of a child in Goodhue District Court. On Friday, the
assault charge was replaced with the two manslaughter charges while the
negligence charge remains. The charges stem from the July 5
death of Jazmyn M. Weiker-Hanson, who was nearly 3 years old. She was
unresponsive when EMTs arrived at her mother's apartment July 1. She
was taken to Saint Marys Hospital in Rochester, where she was taken off
life support July 5. Lake was in court for an omnibus hearing
Friday; another one on the new charges was set for Dec. 18. He remains
free on bail of $100,000 with conditions. At the hearing,
Assistant Goodhue County Attorney Erin Kuester asked Goodhue District
Court Judge Kevin Mark to require that Lake give a DNA sample. His
attorney protested but the judge ruled he must give the sample. According
to the complaint, Cannon Falls police were called to the apartment the
evening of July 1 because the girl had fallen from her bed and was
unconscious. Lake was there outside the residence. He told an
officer he was watching his girlfriend's daughter and she fell off the
bed. The EMT said the girl was unconscious and not responding to
stimuli; she had a large bump on her forehead. The officer was told the
injury "was consistent with some type of blunt trauma."Lake told
the officer that he was in the living room of the apartment and could
hear the girl jumping on her bed. He later heard her fall. When he
found her, he said she held her arms out to him "just laid down on me
and kinda went to sleep."But a doctor at Cannon Falls Hospital said
the injuries were not consistent with a fall. Lake
later said he was in the bedroom and was swinging her around by her

Babysitting boyfriend's story, charges changed in July death case
Goodhue County prosecutors increased charges to second degree manslaughter October 9 against Justin Lake for the July death of his girlfriend's toddler daughter.
A criminal complaint filed with the upgraded charges states Lake told investigators he was swinging the girl by her ankles and that the girl's head hit a door.
The new complaint also reveals that Lake may have smoked marijuana four times that day with the girl's mother, Tabitha Hanson, including just before Hanson went shopping and left him alone with the girl.
Lake, 29, originally told Cannon Falls police responding to a 911 call at his 302 Cedar Street duplex apartment on July 1 around 8:00 p.m. that Jazmyn Weiker-Hanson, about to turn three years old, had injured herself while jumping on a bed. Cannon Falls police and a responding emergency medical technician immediately doubted Lake's story.
After the unconscious girl was taken to the Cannon Falls hospital and then to St. Mary's Hospital in Rochester, medical authorities at both places told police the girl's injuries were more severe than would occur from a fall from a bed.The girl underwent surgery in Rochester to relieve pressure from internal bleeding on her brain. Following her surgery, she suffered a stroke on her brain and was removed from life support on July 5, 2009, and pronounced dead.
In the original criminal complaint filed in July, Cannon Falls police said they were told by Mayo Clinic professionals that the injuries were consistent with the child being forcibly shoved into a door frame or being hit in the head with another hard object similar to a baseball bat.
Lake was arrested in Rochester the night of the incident and was originally charged with assault in the first degree and malicious punishment of a child.
Lake's story began to evolve the next day when interviewed by investigators with the Goodhue County Sheriff's Department.
Lake originally told the investigators the jumping on the bed story. He then speculated that Jazmyn may have been injured by his two year old son. Lake has three children with estranged wife Jessica Lake. Jessica picked the children up around noon from Lake's apartment the day of the incident.
Lake also added he knew that Jazmyn had a platelet disorder and could not be sure that she wasn't already injured when she arrived at his house with her mother for a visit around 1:30 a.m. that day. (Tabitha Hanson was living near LaCrosse at the time of the incident.)
Lake eventually changed his version of events during the interview with the investigators, adding in the spinning of the girl by the ankles element. At one point, Lake stated that he was spinning her around "pretty good" and that he freaked out after she hit her head on the door. At another point, he states the spinning lasted for five minutes and built up a lot of momentum.
The final autopsy report indicates the manner of death "cannot be determined" and that Jazmyn's death was caused by a "traumatic closed head injury" and "likely assault" at Lake's apartment. The autopsy report further indicated that a significant condition that contributed to Jazmyn's death but was not the cause of her death was "idiopathic thrombocytopenic purpura," a bleeding disorder.
Prosecutors are highlighting in the manslaughter charges Lake's delay in seeking emergency medical care. During his July 2 interview with Goodhue County investigators, Lake stated that after the girl hit her head on the door he picked her up and put her on a couch in the apartment.Lake stated that he felt her head and that it felt soft.
According to Lake, the girl was semi-conscious. Lake stated he knew she was hurting and planned to give her some children's Tylenol. He changed his mind
about the Tylenol after he heard Jazmyn make a funny noise about fifteen minutes after she hit her head on the door. Lake described the funny noise as being "like an exhale somebody would make on their last breath so to speak."
Lake stated that he did not want to call 911 if it was not necessary, so he called Tabitha Hanson twice but did not get a response. Lake stated he then called his mother, the Cannon Falls hospital and finally 911.
Tabitha Hanson states she left Lake at around 6:30 p.m. to go shopping at Wal-Mart in Red Wing and returned about 8:30 to find police at the apartment. She says she left her cell phone at the apartment. Hanson also states that after Lake was arrested in Rochester she returned to his apartment. While at the apartment, Jessica Lake arrived and removed a tackle box filled with drug paraphernalia, martial arts weapons and a safe.
Lake is out on bail and staying with his parents in Wisconsin. His next court date is December 18.

Seek tougher sentence in '09 toddler death
Goodhue County prosecutors have filed notice of their intent to seek an aggravated sentence in the manslaughter case against Justin Lake.
Lake was babysitting at his apartment in Cannon Falls on July, 1, 2009 for a visiting girlfriend, Tabitha Hanson, of the LaCrosse area, when the girlfriend's daughter, Jazmyn Weiker-Hanson, who was due to soon turn 3 years old, sustained severe head injuries that led to her death on July 5.
After a number of different accounts, Lake maintained that the girl injured her head when he was swinging her around by the ankles. The case is still in pre-trial hearings, but Goodhue County assistant attorney Erin Kuester filed notice that the prosecution will seek a tougher sentence than a regular accidental manslaughter charge in part due to the "extreme delay" it took Lake to call for emergency help after the alleged accident.
Kuester says Lake made a series of four or five calls before dialing 911, although all evidence pointed to the fact that the girl was seriously injured, not just crying or upset from a less severe injury. Kuester thinks the delay may have totaled half an hour.
Lake has been residing with family in Warren, WI while the case has worked its way through the pre-trial motions and hearings. He has been free on bail but missed a scheduled Friday, June 4 court hearing. Goodhue County issued a warrant for his arrest and he turned himself in on June 5.
He appeared in court June 7 and was released on his own recognizance. He is scheduled for a court hearing on July 9.
