JUAN LUIS MALDONADO - 15 months - Riley County KS
The bodies of of a woman and a small child have been discovered in a shallow grave in Riley County, police said Tuesday.
Riley County police said a hunter discovered the victims' grave
shortly after 6 p.m. Sunday near the 6300 block of S. 32nd. Responding
officers found partially buried human remains.
Detectives and members of the Shawnee County Coroner's Office
investigated the crime scene and found the remains of two people buried
in the same shallow grave. Police said one of them is an adult female.
The second is a small male child, possibly 3 years of age or less.
Police initially said on Monday that one body had been found. On
Tuesday afternoon, authorities said the investigation revealed two
bodies.
Riley County police Lt. Herb Crosby Jr. said the bodies were
discovered in a remote rural area, about a mile southwest of Wildcat
Creek Road and the K-18 highway bypass.
"The closest house was probably a mile or two down the road," Crosby
said. "It's private property, a rural roadway with property owners on
both sides. The road leads to a dead end."
The pair haven't been identified. Further information may be released following autopsies, police said.
Crosby said there haven't been any missing person reports in Riley
County or nearby Geary County that would come close to matching the
bodies. He declined to say how long it appears the bodies had been
buried, deferring to pending results of an autopsy.
Police ask anyone with knowledge of a missing female or small male
child to contact investigators at the Riley County Police Department at
(785) 537-2112, ext. 2470.

Autopsy results on the human remains found in Riley County Sunday afteroon could come as soon as Thursday.
Lieutenant Herb Crosby with the Riley County Police Department said that it is standard procedure for bodies to be autopsied in Shawnee County.
The remains of an adult female and a male child approximately 3-years-old were discovered in a field east of Ogden buried in a shallow grave.
Crosby said the case is being investigated as a criminal case right now, until they can prove otherwise.
Police are still working to identify the victims and may turn to the public for help.
“If we can identify those individuals then we would release that information to the public,” Crosby
said. “That way someone might know if it's Bobby or Johnny or Susie or
whoever then they might say, oh yeah, they have been missing for quite
some time.”
He said there are no reported missing persons who fit the victim's descriptions in either Riley or Geary county.Anyone
who might know a missing woman and small boy are urged to call the
Riley County Police Department's criminal investigations division at
(785) 537-2112 x2470.

known address was in Ogden. He is being held in jail in Austin, Texas
on $2.5 million bond. Police say an extradition hearing is scheduled
for Wednesday, Nov. 4, and expect him to be in Kansas within one week,
pending that hearing.

Capital Murder Trial Delayed
KMAN Radio reports a Riley County District Court judge Tuesday granted the request from Luis Aguirre's attorneys to delay his trial on capital murder charges.
(KMAN) The capital murder trial is delayed for a man accused of murdering a woman and a child, then burying them in a shallow grave in Ogden.
KMAN Radio reports a Riley County District Court judge Tuesday granted the request from Luis Aguirre's attorneys. A lack of funding to hire proper experts was the main reason for their request.
The trial was set for June. A new date isn't yet set.
Aguirre is accused in the 2009 deaths of 18-year old Tanya Maldonado and her 15-month old son, Juan.

Riley Co. Double Murder Suspect Back In Court
Two hundred potential jurors are expected to be interviewed for a capital murder trial in Riley County.
RILEY COUNTY, Kan. (WIBW) -- Two hundred potential jurors are expected to be interviewed for a capital murder trial in Riley County.
Luis Aguirre, 24, is accused of killing 18-year-old Tonya Maldonado and the couple’s 15-month-old son, Juan, in 2009.
Their bodies were found months later in a shallow grave in Ogden. Aguirre had moved to Ogden within a year of the killings. His girlfriend and son were from the Chicago area.
Last month, Judge Meryl Wilson said that he would allow the state to include more than 100 emails between Aguirre and Maldonado sent between January 16, 2009-October 10, 2009. Two of the emails were sent from Aguirre to Maldonado after the killings, which authorities believe happened in September of 2009. Assistant Riley County Attorney Barry Disney says the messages reveal the “discordant relationship” that the couple had in the months leading up to the murders and establish the motive.
Riley County Attorney Barry Wilkerson says for Aguirre, Tonya and their son became an “albatross” and wouldn’t go away and Tonya continued to seek his assistance.
In late September 2009, prosecutors say Aguirre picked up his son and girlfriend from a homeless shelter where they were living in Illinois and brought them to Ogden to the house where he was living with his new girlfriend. A short time later, they both ended up dead. But while Aguirre says he did not intend to kill them, Wilkerson says the state believes their murders were premeditated.
During a motions hearing Friday in Riley County District Court, Aguirre’s attorney, Jeffrey Wicks, said that potential jurors who oppose the death penalty based on their religious beliefs should be included in the jury pool, claiming it was unconstitutional to strike them from the group being considered to determine Aguirre’s fate. Judge Wilson denied the motion, saying that if a potential juror cannot follow the laws of the court, it would be grounds for removing them from the pool.
Judge Wilson revealed that 200 potential jurors will be given a 24 page questionnaire to begin the jury selection process.
Luis Aguirre's trial is set to begin on June 12, 2012 when members of the jury will be chosen. Testimony is expected to start the following week. Several hearings are scheduled in the meantime. Aguirre is being held in the Riley County Jail on $2.5 million bond.
Authorities have not released exactly how the young mother and son were murdered. That information will come out during the trial.
