Cumberland County authorities say foul
play is suspected in the disappearance of Shaniya Nicole Davis. The
5-year-old girl went missing from her home, 1116-A Sleepy Hollow Drive
in Fayetteville, Tuesday morning. An Amber Alert was initiated for Shaniya just before noon, Lt. David Sportsman said.Police
responded to the home around 6:50 a.m., and Shaniya's mother told
officers that she last saw her daughter at 5:30 a.m. The mother’s
boyfriend and her sister, along with an infant and Shaniya's 7-year-old
brother were also in the home when the girl went missing.“There
is definitely something not right about the situation. Foul play is
suspected,” Fayetteville police spokeswoman Theresa Chance said Tuesday
evening. It is unclear how the child left the home."The
circumstances surrounding her disappearance are very odd. A 5-year-old
usually...(is) not awake at 5:30 a.m. normally, and they just wouldn't
leave their home," Chance said. "If she would have wandered out of her
home, she would be around here somewhere."
Chance said the family has a history with the Department of Social Services."There have been major DSS issues with this family – who has custody, switching back and forth," Chance said.Chance
said it's unknown whether the child's disappearance is related to those
issues. Police said Shaniya's father flew in from out of state Tuesday
afternoon and was talking to investigators."We're treating this as a child in danger, with the information we have," Chance said.Chance
said police have been called to the home before. This summer, officers
served a search warrant at the home and found a variety of drugs inside. The
family was not allowed inside the home Tuesday evening after it was
deemed a health hazard due to extensive sewage leaks, authorities said.Police K-9s, firefighters and sheriff's deputies searched the area throughout the day Tuesday.“We are searching for her and hoping to find her alive, but we just don't know at this point,” Chance said.Chance noted that search dogs did not pick up Shaniya's scent, which they would have if the child was wandering around outside.Shaniya
is described as 3 feet tall and 40 pounds. She has brown hair and brown
eyes. She was last seen wearing a blue T-shirt with pink underwear. She
is thin and has a scar on her foot.Fayetteville police say three
registered sex offenders live in the neighborhood. Theresa Chance said
the offenders, along with everyone else in the neighborhood, have been
interviewed. The sex offenders are not considered suspects, Chance said.Anyone with information is urged to call Fayetteville police at 910-433-1856 or call or call 911 or *HP.

Fayetteville police battled the rain
Wednesday as they continued to search for a 5-year-old girl who
disappeared from her home early Tuesday.Investigators recovered a blanket that is believed to belong to
Shaniya Nicole Davis from a neighbor's garbage can. The neighbor,
Andrea Moore, said she doesn't know how the blanket wound up in the bin
and said police told her the blanket belonged to the missing girl.Antoinette
Davis said she put Shaniya on the couch in their home, at 1116-A Sleepy
Hollow Drive in Fayetteville, at about 5:30 a.m. Tuesday. When she went
to check on her daughter about an hour later, the girl was missing,
Davis told police. An Amber Alert was initiated for Shaniya several hours later.Police
said Tuesday that they suspected foul play in the case, noting that
they doubted she would have walked off on her own at that time of day.Police
dogs searched the neighborhood and some nearby woods late Tuesday and
didn't pick up Shaniya's scent. Investigators said the dogs would have
picked up her trail if she had been walking around the area."This
case is definitely priority," said Sgt. Tracey Bass-Caine of the
Fayetteville Police Department. "Anytime you have a child of this age
(missing) or a child where the circumstances (of her disappearance) are
questionable, then of course this takes precedence."Bass-Caine
said the rain that started falling across central North Carolina late
Tuesday and continued Wednesday was hindering the search effort.
Evidence in the case could be washed away, she said."We had to close down the extensive search we were doing (Tuesday night) because of the inclement weather," she said.Antoinette
Davis spent much of Tuesday at police headquarters answering questions,
and investigators said they expected to continue questioning her
Wednesday. Shaniya's father flew in from out of state Tuesday afternoon
and also spoke with investigators.Police spokeswoman Theresa

A North Carolina man has been arrested and charged with kidnapping
in the disappearance of a 5-year-old girl, but police were still
searching for the child early Thursday - two days after she went
missing.
Clarence Coe was arrested without incident at his Fayetteville home
around 11 p.m. Wednesday and charged with first degree kidnapping,
Fayetteville police said in a statement.
Investigators were still looking for Shaniya Davis, who was reported
missing from her home in Fayetteville's Sleepy Hollow mobile home park
around 7 a.m. Tuesday, said Lt. Alex Thompson. Her mother said she last
saw Shaniya that day around 5:30 a.m.
Police have said they suspected foul play and doubted the girl would
have wandered away from her home so early in the morning. They said
police dogs didn't pick up the child's scent during a search of the
neighborhood.
Thompson said detectives have not yet said whether Coe knew the
child. Coe was being held at the Cumberland County jail, where a worker
said records didn't indicate whether Coe had an attorney or a scheduled
court appearance.
Investigators found a blanket that may have belonged to Shaniya in a
garbage can outside a neighbor's home. Fecal matter was found on the
blanket and on the railing and porch of Davis' residence, where police
wouldn't allow anyone inside because of a sewage leak.
Shaniya's mother, Antoinette Davis, and her father, who flew in from
out of state, have been speaking with investigators. Police spokeswoman
Theresa Chance told WRAL-TV on Wednesday that the family had a history
with the state Department of Social Services regarding the custody of
Shaniya and other children in the home. She told the Fayetteville
Observer that Shaniya's father wasn't considered a suspect.

A North Carolina man charged with kidnapping a 5-year-old girl told a
judge he is not guilty Thursday as investigators scoured the town for
any sign of the missing child and said they assume she is in danger.
Cumberland County Judge Tal Baggett asked Clarence Coe, 30, during an
afternoon hearing if he understood why he was in court.
"No,
but I'm not guilty, sir," Coe said. He did not enter a formal plea and
Baggett said the court would appoint an attorney.
Baggett also
said Coe was also accused of "terrorizing" the child's mother, although
he did not elaborate. Coe has been formally charged only with
kidnapping.
Fayetteville Police spokeswoman Theresa Chance said
a witness spotted Coe taking Shaniya Davis out of the trailer park
where she was reported missing around 7 a.m. Tuesday.
"I think it's safe to say this is not a random occurrence," Chance said.
Barbara Davenport, property manager at Sleepy Hollow Mobile Home Park,
said Coe is dating Shaniya's mother, Antoinette Davis, and has visited
the trailer park several times.
Investigators said police dogs did not pick up the child's scent during a search of the neighborhood.
"Our hopes are that she's close by," Chance said.
Coe was being held at the Cumberland County jail. He has several
criminal charges on his state record, including an April conviction for
misdemeanor breaking and entering, and he was released from prison in
mid-August, according to Department of Correction records.
Coe
was previously convicted of assault on a female, felony breaking and
entering, larceny, robbery and other charges dating back to 2001.

A man charged in the Tuesday
disappearance of a 5-year-old Fayetteville girl was seen driving off
with her, police said Thursday.Fayetteville police arrested
Clarence Darriel Coe, 30, of 211 Brookwood Ave. in Fayetteville, at
about 11 p.m. Wednesday and charged him with first-degree kidnapping in
the disappearance of Shaniya Nicole Davis. The girl is still missing, and police provided no information Thursday morning on her possible whereabouts."She's
in danger. She was abducted. We're taking this of the utmost importance
and seriousness, so we're aggressively looking for her," said Theresa
Chance, spokeswoman for the Fayetteville Police Department. The girl's mother, Antoinette Davis, said she put Shaniya on the
couch in their home, at 1116-A Sleepy Hollow Drive in Fayetteville, at
about 5:30 a.m. Tuesday. When she went to check on her daughter about
an hour later, the girl was missing, Davis told police. An Amber Alert was initiated for Shaniya several hours later.A
witness saw a man police believe to be Coe driving away from the Sleepy
Hollow Mobile Home Park on Tuesday with the girl in his car, police
said. Chance declined to identify the witness or say what time the
abduction occurred.A neighbor of the Davis family, Andrea Moore, said she was awakened at about 3 a.m. Tuesday by a banging noise outside her home. The
kidnapping wasn't random, Chance said, noting Coe knows the Davis
family. She declined to elaborate on how he knows the family."His relationship to that family ... is part of the investigation," she said.Coe's home on Brookwood Avenue is about 4 miles from the girl's house. He
was previously convicted of assault on a female, breaking and entering,
larceny and other charges, according to state Department of Correction
records.Investigators focused on Coe as a suspect in Shaniya's
disappearance early on and questioned him Tuesday and Wednesday, Chance
said.Antoinette Davis also was questioned for much of Tuesday
and Wednesday, and Shaniya's father flew in from out of state Tuesday
afternoon and also spoke with investigators."We're dealing with
getting very differing stories constantly, so we're trying to piece
together the truth and what was going on at the time," Chance said.Coe showed little emotion during a brief court appearance Thursday afternoon."I'm not guilty, sir. That's all I've got to say about it," he told District Judge Tal Bagette. She
confirmed that police pulled a blanket from a garbage can near the
Davis house that they believe belongs to Shaniya. She wouldn't discuss
how the evidence fits in to the investigation.Police dogs
searched the neighborhood and some nearby woods late Tuesday and didn't
pick up Shaniya's scent. Investigators said the dogs would have picked
up her trail if she had been walking around the area, prompting them to
suspect foul play in the case.Heavy rains since late Tuesday have hindered further search efforts."There's
a lot of information we're following up on," Chance said. "We have a
lot of people calling now, giving us tips and leads. We're
re-interviewing people at the mobile home park that we talked to
previously."Shaniya is described as 3 feet tall and 40 pounds.

disappearance of a 5-year-old Fayetteville girl was seen driving off
with her, police said Thursday.Fayetteville police arrested
She has brown hair and brown eyes. She was last seen wearing a blue

Re: SHANIYA DAVIS - 5 yo (2009)- Fayetteville NC
A missing 5-year-old North Carolina girl was seen with a man at a
hotel, but not the same person charged in her kidnapping, police said
late Thursday.
Shaniya Davis was spotted in Sanford with a man identified as Mario
Andrette McNeill, said Fayetteville Police spokeswoman Teresa Chance.
She was seen with him Tuesday, about an hour after she disappeared from
her home in Fayetteville, about 40 miles away.
Late Wednesday night, police arrested and charged 30-year-old
Clarence Coe, who told a judge at his first court appearance that he is
not guilty of kidnapping the girl. Police did not comment on any
possible link between Coe and McNeill.
Chance said a hotel worker called police to report seeing a child
matching Shaniya's description, but by the time police got there,
McNeill had left. Authorities reviewed surveillance video and, after
speaking with family members, confirmed the child's identity.
Chance said authorities are uncertain of the connection between
McNeill and the child. Her father, Bradley Lockhart, made a tearful
appeal for his daughter's safe return.
"We just ask that they bring her home safe. We all miss her and love
her very much," Lockhart said. "Shaniya, if you're listening to daddy,
I miss you so much, honey. I'm waiting for you. I'm not going to give
up. You don't give up either, honey."
In court on Thursday, Cumberland County Judge Tal Baggett asked Coe if he understood why he was there.
"No, but I'm not guilty, sir," Coe said. He did not enter a formal
plea to the kidnapping charge, and Baggett said the court would appoint
an attorney.
Baggett also said Coe was also accused of "terrorizing" the child's mother, although he did not elaborate.
Chance said a witness spotted Coe taking Shaniya Davis out of the trailer park where she was reported missing.
"I think it's safe to say this is not a random occurrence," Chance said.
Chance also said authorities believe the girl is alive.
"We believe she's safe. We just want him to return her. We have no
reason to believe that he would harm her, none at all," Chance said.
Barbara Davenport, property manager at Sleepy Hollow Mobile Home
Park, said Coe is dating Shaniya's mother, Antoinette Davis, and has
visited several times.
Coe was previously convicted of assault on a female, felony breaking
and entering, larceny, robbery and other charges dating to 2001.
Investigators found a blanket that may have belonged to Shaniya in a
garbage can outside a neighbor's home. Lt. Alex Thompson said
investigators also found other items Shaniya may have been wearing.

Re: SHANIYA DAVIS - 5 yo (2009)- Fayetteville NC
Police in Fayetteville say a missing 5-year-old
who's the focus of a nationwide Amber Alert has been spotted alive in
the company of a 29-year-old man.
Fayetteville Police Department spokesperson Theresa Chance told
reporters authorities got the tip from a hotel in Sanford. That's about
40 miles north of Fayetteville. After reviewing surveillance video at
the hotel, police identified the man with Shaniya Davis as 29-year-old
Mario Andrette McNeill. Chance said the pair checked into the hotel at 6:11 a.m. Tuesday morning, apparently before Davis' mother reported her missing.Authorities said the connection between the girl and McNeill is unknown at this time. Police
said they want to reunite the child with her family and believe she is
still alive. Davis' father pleaded at a Thursday night news conference
for his daughter's safe return. "Shaniya, if you are listening to daddy ... I miss you so much ... I'm not going to give up," Bradley Lockhart said. Thursday,
the Fayetteville Police Department announced an arrest in the case.
Clarence Coe, 30, of Brookwood Avenue in Fayetteville was charged with
first-degree kidnapping after a witness told investigators they saw him
leaving the mobile home park where Davis lives with her in his car.
Police didn't elaborate on how Coe and McNeill could be associated. Coe remains in the Cumberland County Detention Center without bond. Chance
also did not say how Coe knows the child or the Davis family, but the
manager of the Sleepy Hollow Mobile Home Park, where the Davis family
lives, claims that Coe is the boyfriend of
Antoinette Davis, Shaniya's mother. According to state
records, Coe was recently released from prison after serving four
months behind bars for assaulting a woman earlier this year. Coe also
has previous breaking and entering and larceny convictions dating back
several years. Police say Coe was a person of interest early on in the investigation. They haven't said if he is cooperating with detectives. McNeill
also has an extensive criminal background. Records checks
turned up convictions for selling illegal drugs, assault, shooting into
an occupied home, and more. Anyone having any information on
the current whereabouts of Mario McNeill or Shaniya Davis is urged to
contact the Fayetteville Police Department at (910) 433-1856. To leave

A North Carolina man has admitted to kidnapping a 5-year-old girl,
authorities said Friday, but investigators still have not found the
child more than three days after she disappeared from a mobile home
park.
However, the attorney for Mario Andrette McNeill, 29, said Friday that
his client would plead not guilty to kidnapping Shaniya Davis.
Fayetteville Police Department spokeswoman Theresa Chance said McNeill
admitted to taking the girl.
McNeill was charged with kidnapping while authorities dropped
charges against another man, Clarence Coe, who was initially arrested
in the case.
"We're hoping we find her alive," Chance said at a news conference. "We found Mr. McNeill, and Miss Davis was not with him."
McNeill had a first court appearance Friday. Attorney Allen Rogers
said he only spoke briefly with his client, adding that he did not know
what connection McNeill may have had with Shaniya or her mother. He
also did not comment on the child's whereabouts.
Surveillance footage had showed McNeill carrying Shaniya into a
hotel room on Tuesday morning, when she was reported missing from a
mobile home park. A hotel worker called police to report seeing a child
matching Shaniya's description, but by the time police got there,

Police in Fayetteville say they've arrested the mother of a missing 5-year-old who's
the focus of a nationwide Amber Alert.
Shaniya Davis has been missing since Tuesday. Late
Saturday night, Fayetteville police Sgt. John Somerindyke announced in
a news release that Antoinette Davis has been charged with human
trafficking, felony child abuse, prostitution, filing a false police
report, and resisting, delaying, or obstructing police. Somerindyke says detectives
have not found the little girl. Antoinette Davis is charged in her daughter Shaniya's disappearance.
The news came after the arrest Friday of 29-year-old Mario Andrette McNeill
in the case. Police said McNeill was taken into custody after they got
a tip from a hotel in Sanford that he had been there with Davis.
Sanford is about 40 miles north of Fayetteville. Detectives said
surveillance video at the Comfort Inn showed the man carrying the girl
towards an elevator at 6:11 a.m. Tuesday morning. Fayetteville
police spokeperson Theresa Chance said McNeill turned himself in
Thursday night and has been questioned. She said he admitted to taking
Davis. Davis' father pleaded at a Thursday night news conference for his
daughter's safe return. "Shaniya, if you are listening to daddy ... I miss you so much
... I'm not going to give up," Bradley Lockhart said. Thursday,
the Fayetteville Police Department had announced another arrest in the
case. Clarence Coe, 30, of Brookwood Avenue in Fayetteville was charged
with first-degree kidnapping after a witness told investigators they
saw him leaving the mobile home park where Davis lives with her in his
car. But at Friday's news conference, Chance said there is new evidence that shows
Coe was not involved, and said he was released. "I'm
not an idiot, I'm not stupid, but I feel like I was violated," Coe
said. "The whole time I told the detectives I wasn't guilty, they came
and talked to my family, they said my family was lying." When asked Coe
what he thought happened to Davis he said he did not know. "I've
been asked that by 13 detectives and everybody, I don't know and I tell
you like I told the detectives, I don't think the mother had anything
to do with it," he said. "Do I feel there might have been some
negligence somewhere, yes I do." Coe says Antionette Davis,
the child's mother, was his girlfriend and he says he wasn't at the
mobile home when the child disappeared. "Every day I was
there the little girl was never in the living room," Coe said. "Every
night when I slept there the little girl was never in the living room,
so all I can say is educated people figure it out." Meanwhile,
officials say McNeill has an extensive criminal background. An ABC11
check of his record turned up convictions for selling illegal drugs,
assault, shooting into an occupied home, and more. He was
arraigned on first-degree kidnapping charges Friday and was ordered
held on $100,000 bond. His lawyer said he would enter a not guilty plea. Anyone
having any information on the current whereabouts of Shaniya Davis is
urged to contact the Fayetteville Police Department at (910) 433-1856.

The father of a missing 5-year-old North Carolina girl says he never
should have allowed her to go back to her mother, who is now being
charged with human trafficking and other offenses.
It's not
clear if the charges are related to Shaniya Davis' disappearance, and
authorities say they still don't know where the girl is. The girl's
mother, Antoinette Nicole Davis, reported her missing Tuesday from a
mobile home community in Fayetteville.
Police say she's facing charges for alleged child abuse and filing a false police report.
A man believed to be on a hotel surveillance video carrying the child has been charged with kidnapping.
Shaniya's father, Bradley Lockhart, tells The Associated Press that
after raising the girl for several years, he decided to allow her to
stay with her mother last month. He says she had recently gotten a job
and her own place, and he decided to give her a chance.
Now, he says he "should've never let her go."

Authorities have suspended their search for a 5-year-old girl
reported missing by her mother, who is charged with human trafficking
and child abuse involving prostitution.Fayetteville police spokeswoman Theresa Chance said the search for Shaniya Nicole Davis will resume Monday morning.Investigators
followed up on leads Sunday, and officers conducted a ground search
between Fayetteville and Sanford for Shaniya, who hasn't been seen
since Tuesday.A state Highway Patrol helicopter assisted in the search for Shaniya, spokesman Capt. Everette Clendenin said. The
Lee County Sheriff's Office said its search focused around N.C. Highway
87 and Walker Road, near the Carolina Trace subdivision. The area has
woods crisscrossed by open fields.Sky 5 footage of the scene
showed Walker Road blocked off and law enforcement vehicles parked
along the road. K-9 units were at the scene, and officers searched a
kudzu-covered ravine off the highway.Area residents also joined in the search for Shaniya throughout the day.“I
have five kids, and to me, no child deserves something like this,”
searcher Belinda Gaona said. “If it was one of mine, I would hope for
someone to help me.”“I couldn't even fathom my daughter missing
at this point. I don't even think I’d be able to take it,” searcher
Randall Fore said. “That's hard to deal with when you've got kids.”Late
Saturday, Shaniya's mother, Antoinette Nicole Davis, was charged with
human trafficking, felony child abuse – prostitution, filing a false
police report and resist, delay or obstruct an officer. She is being
held in the Cumberland County Detention Center under a $51,000 bond.Chance

Re: SHANIYA DAVIS - 5 yo (2009)- Fayetteville NC
Monday police found the body of missing 5-year-old who has been the focus of a nationwide Amber Alert .
The child's remains were located in an area bordered by Highway 87
south and Walker Road - just south of Sanford - during a second day of
searching. Fayetteville
police spokesperson Theresa Chance said the body of a child was located
about 100 feet off the road. She said Shaniya Davis' family would be
called on to make a positive identification, but detectives were
waiting for the FBI and State Bureau of Investigation to finish work at
the crime scene. The discovery wrapped up a search conducted by some 250 law
enforcement officers and volunteers who used dogs, horses, and a
helicopter to scour the woods after police got information about where
to find the body. Sandi Mundt - who's the mother of a 15-year-old who lives nearby - came out to help. "It
just breaks my heart it does. I'm thankful that our community is coming
together like they are. There's been so many volunteers," she said. "Like
most people you have children or relatives that are young aged and you
just want the best outcome. It's unfortunate that ended like it did,"
offered another volunteer Derrick Murchison. Davis was
last seen alive at a Comfort Suites hotel in Sanford last week - the
same morning her mother reported her missing from her Fayetteville
home. Police say a surveillance video from the hotel showed the child
with 29-year-old Mario McNeill. The area where police found the body is about 7 miles from the hotel.McNeill turned himself in Thursday night and police say he confessed
to taking the 5-year-old. However, McNeill's attorney told reporters
his client would plead not guilty. Police arrested the
child's mother, Antoinette Davis, Saturday. She is accused of human
trafficking, prostitution and felony child abuse. Warrants say she
provided her daughter with intent that the girl be held in sexual
servitude. Antoinette Davis showed no emotion during a court
appearance in Fayetteville Monday afternoon. District Court Judge Tal
Baggett made sure she understood the charges against her. "The
State of North Carolina alleges that on or about the date of November
10, 2009, that you did get engaged in human trafficking with a child as
the victim," he told her. "The other charge of felony child abuse for
prostitution is a class E felony. That is 98 months in prison. Do you
understand that?" Antoinette Davis' aunt Yvonne Mitchell was in
the courtroom. She and other family members don't believe she is guilty
of the charges. Mitchell said there were no signs Shaniya was in danger
with her mother. "I didn't see any. Every time I seen her, the
kids were happy. She seemed happy. If there was anything wrong, it was
being hid very good because I didn't notice it," she said. Chance
said detectives have been working to find Shaniya 24-hours-a-day since
she was reported missing and were in shock at the news that a body had
been discovered. "You always hold out hope," said Chance. Meanwhile, a Facebook page was set up Monday for people to leave messages for the family and talk about the tragedy. "You are in a safe place Shaniya and no one is gonna hurt u anymore. GOD BLESS," wrote Reva McPhaul. Volunteers planned a candlelight vigil for the dead girl at 8 p.m. Monday night on Walker Road near where she was found.

Reports have confirmed that the
mother of 5-year-old Shaniya Davis is pregnant. Jail officials in
Cumberland County said for that reason, Antoinette Davis, 25, was being

her daughter's disappearance. Warrants say she provided her daughter

Re: SHANIYA DAVIS - 5 yo (2009)- Fayetteville NC
The father of a 5-year-old girl whose body was found off a rural
North Carolina road regrets giving the girl's mother a chance to raise
their daughter, even though she seemed to be getting her life together.
The girl's father, Bradley Lockhart, said he had a one-night stand with Antoinette Davis and mostly brought up their daughter before
letting Davis take care of her.A month later, Shaniya Davis was dead, her body dumped off a rural road and her mother accused of selling her for sex."Lord, I come to you with open arms and it is hard. It is hard," Lockhart said
Monday night as he stood among a crowd of about 500 gathered in a store
parking lot for a vigil. "Don't give up on me and don't give up on
Shaniya. She's right there with you."When Shaniya was reported
missing, suspicion initially turned to a man described as her mother's
boyfriend. As he was let go, police targeted another man spotted on
hotel surveillance footage holding the child. Then, authorities
arrested the girl's mother and accused her of offering her daughter for
prostitution. The arrests offered a glimmer of hope Shaniya would
be found alive. But on Monday, searchers discovered the girl's body off
a rural road, nearly a week after her mother reported her missing from
a mobile home park in Fayetteville. At a second memorial about 40 miles away in Sanford, where Shaniya's body was found, dozens of people attended a Baptist church."We
have kids and it just hit so close to home. It's unbelievable how
somebody can just do something that horrible to something so precious,"
said organizer Crystal Godfrey.Hundreds of volunteers who helped
look for Shaniya left the search area dejected, unable to bring her
home to her father, 7-year-old brother and the dolls she so loved."I
still feel kind of sick to my stomach," said Angela Jackson, 27, of
Sanford, who has a 2-month-old daughter and searched for consecutive
days.Particularly disturbing were the accusations against
Shaniya's mother, 25-year-old Antoinette Davis. Police charged Davis
with human trafficking and felony child abuse, saying Shaniya was
offered for sex.Davis was calm and quiet during a court
appearance. She provided one-word answers to the judge's questions. She
requested a court-appointed attorney and did not enter a plea. Her sister, Brenda Davis, 20, said she does not believe the charges."I
don't believe she could hurt her children," said Brenda Davis, who
spoke with her sister at the jail Sunday. Davis' aunt, Yvonne Mitchell,
said the mother had two jobs and would never harm the child.Authorities
also charged Mario Andrette McNeill, 29, with kidnapping after they
said surveillance footage from a Sanford hotel showed him carrying
Shaniya. Authorities said McNeill admitted taking the girl, though his
attorney said he will plead not guilty.Fayetteville police
spokeswoman Theresa Chance declined to talk about additional charges.
She also wouldn't comment on a cause of death or the condition of
Shaniya's body, except to say that investigators planned to retrieve it
about 100 feet off the road."Detectives have been running off
adrenaline to find this little girl and to bring her home alive,"
Chance said. "You have a lot of people in shock right now."Davis
reported Shaniya missing from a mobile home park Nov. 10. Authorities
first arrested Clarence Coe, but charges against him were dropped a day
later when investigators tracked down McNeill after receiving a tip
from a hotel employee.Additional information led investigators
to a search site near Sanford on Sunday. They continued searching
Monday, scouring miles of landscape, roads, ravines and fields on four-wheelers and with helicopters."We
were hoping that someone could carry her home," said Syd Severe, 42,
who came from Raleigh to help with the search. "It's just sick."A
cluster of emergency vehicles and law enforcement gathered where
Shaniya's body was found. Authorities blocked access to the road, a
rural area popular with hunters that is less than a mile from a
lakeside community.Shaniya's father said he raised his daughter
for several years but last month decided to let her stay with her
mother. He had pleaded for her safe return.Lockhart told The
Associated Press on Saturday that he and Davis never argued about him
raising Shaniya, and Cumberland County courts had no record of a
custody dispute. He said he did not know McNeill.Davis struggled
financially over the years, but she recently got a job and her own
place, so Lockhart said he decided to give her a chance with their
daughter."I should've never let her go over there," he said Saturday night.

Re: SHANIYA DAVIS - 5 yo (2009)- Fayetteville NC
A week after a 5-year-old Fayetteville
girl disappeared and a day after her body was found near Sanford,
police are still trying to sort out the evidence in the case to
determine who to charge in her death.Shaniya Nicole Davis was
reported missing from her home, at 1116-A Sleepy Hollow Drive, by her
mother last Tuesday morning. Volunteer searchers found a body Monday
afternoon in some woods off N.C. Highway 87 near the Lee-Harnett county
line.On Tuesday, the State Medical Examiner's Office confirmed that the body was Shaniya's. No cause of death has been released. Two
people have been arrested in Shaniya's disappearance – charges against
a third person were dropped – but no one has been charged with killing
her.Police said one issue holding up any charges is the question
of jurisdiction in the murder case. Prosecutors must prove where a
slaying occurred.Lee County authorities have referred all
questions to the Fayetteville Police Department. The department plans
to address the media at 10 a.m. Wednesday, but it's unclear whether new
charges will be announced then. Two held in disappearance
Police
arrested Mario Andrette McNeill, 29, on Friday and charged him with
first-degree kidnapping in the case. Investigators said McNeill has
admitted to taking Shaniya from her home, and hotel security video from
a Comfort Suites in Sanford last Tuesday appears to show him carrying
her.Shaniya's mother, Antoinette Nicole Davis, 25, was arrested
late Saturday and charged with human trafficking, felony child
abuse–prostitution, filing a false police report and obstructing a
police investigation. Arrest warrants state that Davis "did knowingly
provide Shaniya with the intent that she be held in sexual servitude"
and she "did permit an act of prostitution with Shaniya."In a 911 call released Tuesday, Davis was hysterical when she told a dispatcher that her daughter was missing."I
woke up this morning, and my daughter was not in the house. I don't
know if she walked out. I don't know what going on, but she's not
here," Davis said.Later in the nearly three-minute call, her
voice is completely calm as she noted twice that Shaniya knew how to
unlock the front door."I'm telling you she knows how to unlock it. I'm hoping that she didn't unlock it and walk out," Davis told the dispatcher. Both
McNeill and Davis are being held in isolation at the Cumberland County
Detention Center for their protection, authorities said.Authorities confirmed Tuesday that Davis is pregnant and that Clarence Coe is the father of the child.Davis
initially accused Coe of kidnapping Shaniya, but police dismissed the
charge and released him from jail after determining the information to
be false and then arresting McNeill.Father, aunt: End violence against children
Shaniya's
father, Bradley Lockhart, thanked everyone Tuesday afternoon for their
prayers and support and thanked the Fayetteville police, other law
enforcement officers and volunteers who helped find his daughter."It's
not the result I wanted. It's not the result any father or family would
want for their children," Lockhart said. "My heart hopes and bleeds and
prays that this community (and) this country can possibly unite as one
to prevent something like this from happening again to another special
angel."As he stood amid a shrine of flowers and teddy bears in
his front yard, he said he was "appalled and disgusted" about the
possibility that his daughter was sold as a sex slave.Lockhart's sister, Carey Lockhart-Davis, urged people to help any child they see who might be in danger."Don't
let another innocent bystander go unnoticed because we, as adults, fail
to realize that they depend on us for safety and trust," Lockhart-Davis
said as she choked back tears. "To every pedophile, every person who
thinks of taking a child, please beware . I'll be watching."She
said she felt "robbed" because her special bond with her niece has been
broken. She recalled helping Shaniya learn how to tie her shoes and
color pictures."She had such a wonderful, kind soul, and her spirit and smile brightened every day of everyone she touched," she said.Shaniya's
death is the second family tragedy for Lockhart. Eleven years ago, his
former wife, Vicki Lockhart, was one of three people killed in a home
invasion in Cumberland County.Although Lockhart said he would
try to forgive Davis for Shaniya's disappearance and death, his sister
said she never cared for Davis and how she cared for her children."Never have I allowed my children to live in an environment that was unsafe," Lockhart-Davis said.Lockhart said he didn't want to blame anyone for Shaniya's death, saying he could have done things differently himself."Every parent would blame themselves. We all look within ourselves to see what we could have done differently," he said.DSS, police probes detailed
He
said, though, that he wished the Cumberland County Department of Social
Services had notified him about any problems in Davis' home.DSS
looked at Davis with regard to her 7-year-old son, not Shaniya,
according to her uncle, Michael Davis. The case was closed, and
Antoinette Davis was able to retain custody of the boy, her uncle said.DSS
Director Brenda Jackson declined to comment on her agency's involvement
with the Davis family, citing the criminal investigation into Shaniya's
death as well as confidentiality rules for child protective services
cases.A
search of court records turned up no previous criminal charges against
Davis, but she lived at a home on Wall Street in July that police
raided. Officers found "narcotics manufacturing materials" in the
house, but no one was charged, according to an incident report.Residents
said they had seen Shaniya running around the neighborhood unattended,
but Davis' family maintains she was a good parent."I know she’s a great mom. She’s a great mom. Antoinette really loved her children,” said Davis' uncle, Arthur Cromartie.Cumberland
County Schools officials said Shaniya was a kindergarten student at
Morganton Road Elementary School until mid-October, when she was taken
out of the school and wasn't enrolled elsewhere."We have no
knowledge of what the reason was for her being withdrawn from school,"
Morganton Road Principal Charlotte McLaurin said.Lockhart said he allowed Shaniya to move in with her mother on Oct. 9.During a Monday morning interview
on CBS' "Early Show," he said Davis had worked to get her life together
and had been working for at least six months and gotten a place of her
own."She had asked if she could be a mother, and I felt she was sincere in asking, and I figured to give her a chance," he said.According
to court records, Lockhart has five other children with three women. He
has had custody and child support disputes involving several of the

girl disappeared and a day after her body was found near Sanford,
police are still trying to sort out the evidence in the case to
determine who to charge in her death.Shaniya Nicole Davis was
reported missing from her home, at 1116-A Sleepy Hollow Drive, by her
mother last Tuesday morning.
He
has had custody and child support disputes involving several of the
children, but there was no record of any disputes involving Shaniya or
Antoinette Davis.Davis worked in the kitchen at Carolina Inn at Village Green, an assisted living facility in Fayetteville.CES,

Re: SHANIYA DAVIS - 5 yo (2009)- Fayetteville NC
Authorities in North Carolina said Wednesday that they will need to
determine where the killing of a 5-year-old girl occurred before
additional charges are filed in the case. The body of Shaniya
Davis, who was reported missing in Fayetteville last week, was found
Monday beside a road near Sanford, which is about 30 miles northwest of
Fayetteville, police said. The girl's mother, Antoinette Nicole
Davis, has been charged with human trafficking and other offenses, and
another suspect, Mario Andrette McNeill, has been charged with
kidnapping in the case. A Tuesday statement from the
Fayetteville police says that jurisdiction is "governed by where the
criminal conduct occurred. Right now, this is an ongoing investigation
and as such we are still determining the details surrounding the death
of the child." On Wednesday, Fayetteville Police Chief Tom Bergamine said jurisdiction will need to be determined before other charges are filed. He did not elaborate on what charges might be pending. "Several
of the details regarding the investigation have a direct impact on
which county will assume jurisdiction and prosecute this case,"
Bergamine told reporters at a news conference. "The district
attorneys from the involved jurisdictions are discussing the matter and
ultimately will make that decision," he said. Fayetteville is in
Cumberland County, while Sanford is in Lee County. The district
attorneys from those counties did not immediately return phone calls
seeking comment Wednesday. Davis reported her daughter missing
last week from their home in a mobile home park. According to police,
surveillance video taken November 10 from a hotel in Sanford shows
Shaniya in the company of McNeill. "The investigation at this point indicates that Shaniya Davis was alive at the time she left the Sanford hotel," police said. Following Davis' arrest over the weekend, police spokeswoman Teresa Chance said Davis had been "prostituting her child."
Shaniya's
father, Bradley Lockhart, made a tearful appeal before reporters
Tuesday afternoon, asking that "everybody makes it a point not to
ignore, to look past a situation where a person, a child, or anybody
might be in danger ... so that we don't have another tragedy like
Shaniya."

Shame on You, Donald!
Fayetteville police have charged a Parkton man with falsely taking money as donations in the name of Shaniya Davis.
Donald Roddy Jr., 36, of the 7300 block of Hypony Trail, was
arrested this afternoon and charged with obtaining property by false
pretense.
Police had received earlier reports about a man in the area of
McPherson Church and Skibo roads holding a sign indicating he was
collecting money for Shaniya from passing motorists.
The 5-year-old Fayetteville girl disappeared from her mother's home
on Nov. 10. Her body was found Monday in woods south of Sanford.
"It's just a play on people's sympathy," said Sgt. John Somerindyke. "There's a lot of interest in the case."
A memorial trust fund in the name of Shaniya Davis has been set up
by Wachovia bank, according to a release from the Police Department.
Donations can be made to any Wachovia bank.
Roddy's bail was set at $2,000.
The search for Shaniya involved local and federal law enforcement agencies and received national attention.
Shaniya's mother, Antoinette Davis, and a Fayetteville man have been charged in her disappearance.
Antoinette Davis faces charges that include child abuse involving
prostitution. Mario Andrette McNeill, 29, is charged with first-degree
kidnapping. Police say he was seen carrying Shaniya into a Sanford
hotel after she went missing.
Other charges in the case are pending until authorities decide which law enforcement agency has jurisdiction.
"Before donating money to any cause, one should make efforts to
verify the authenticity of the organization," officials said in a
release.

Re: SHANIYA DAVIS - 5 yo (2009)- Fayetteville NC
Detectives are looking into allegations that Antoinette Davis used her 5-year-old daughter, Shaniya, to pay off a debt.
"That's an avenue of the investigation we're looking at," Fayetteville Police Chief Tom Bergamine said Wednesday.
He did not elaborate.
Davis and a Fayetteville man have been charged in Shaniya's
disappearance. No new charges will be filed until authorities decide
which law enforcement agency has jurisdiction.
Investigators have yet to say how Shaniya died. The results of an autopsy have not been released.
Shaniya's body was found Monday afternoon off Walker Road in Lee
County, just south of the Carolina Trace community. It ended a weeklong
search for the child.
Her mother reported her missing at 6:53 a.m. on Nov. 10 from her
residence in the Sleepy Hollow Mobile Home Park in Fayetteville.
Shaniya was last seen alive on surveillance video from the Comfort
Suites hotel in Sanford. The footage was time stamped 6:11 a.m.
She was with a man police have identified as 29-year-old Mario Andrette McNeill. He is charged with first-degree kidnapping.
Antoinette Davis told police she last saw the girl about 5:30 a.m. that day.
She is charged with human trafficking, child abuse involving
prostitution, filing a false police report and obstructing an
investigation.
Investigators have declined to say what prompted the trafficking
charge, an offense that has rarely been filed in Cumberland County.
"It's a highly unusual charge," Sgt. John Somerindyke said.
But it goes hand-in-hand with the child abuse involving prostitution offense, he said.
The state's human trafficking law says anyone who "knowingly
recruits, entices, harbors, transports, provides, or obtains by any
means another person with the intent that the other person be held in
involuntary servitude or sexual servitude" can be charged with that
offense.
Davis' arrest warrant alleged she allowed McNeill to take the girl "with the intent that she be held in sexual servitude."
Bergamine held a media briefing Wednesday morning at which he offered no new information.
"This is a very complex case and an ongoing investigation between
multiple law enforcement agencies," Bergamine said. "Some details will
have an impact that will determine jurisdiction."
If Shaniya died in Lee County, that investigation could be claimed
by the Lee County Sheriff's Office or the Sanford Police Department.
City police have laid claim to the death investigation since the
chain of events began, saying Shaniya's death was the result of closely
timed criminal actions starting in Fayetteville.
Prosecutors from Lee and Cumberland counties met Wednesday to discuss the venue for the case.
Cumberland County District Attorney Ed Grannis said his staff has
been meeting mornings and afternoons to get updates on the case from
the Police Department and the State Bureau of Investigation.
"We're awaiting issues involving laboratory work from the investigation," Grannis said.
Wednesday's police briefing ended abruptly after a reporter asked
Bergamine whether the criminal justice system had worked in this case.
Court records show that McNeill, who has a criminal record and
previous probation violations, had his probation terminated less than
three weeks before Shaniya disappeared.
"Let me say that the city of Fayetteville has had a couple of
horrific events over the past couple of weeks," Bergamine said,
referring to the murder-suicide deaths of prominent businessman Billy
Maxwell, his wife and two children.
"These are issues that police, the criminal justice system and the community must address,'' he said.
Bergamine left when asked if Shaniya's kidnapping and death could have been prevented.
Shaniya will be remembered today during a prayer service at the
Sleepy Hollow Mobile Home Park off Murchison Road, where she stayed
with her mother. Residents have scheduled the service for 7 p.m.
Residents will meet at 1202 Sleepy Hollow Drive, which is across the street from the Davis home.
