SAN ANTONIO — Warrants have been issued for a man accused of using
incomplete Mexican court documents and Texas law officers to flee with
his 10-year-old son.
Prosecutors in San Antonio on Monday obtained kidnapping and aggravated perjury warrants for 41-year-old Jean Philippe Lacombe.
Lacombe, also charged with interference with child custody, and his son are missing.
Attorneys for Berenice Diaz say she has legal custody of the boy, Jean Paul.
The
San Antonio Express-News reports Lacombe on Oct. 15 presented
misleading Mexican documents to a judge in San Antonio wrongfully
indicating he had custody, not his ex-wife.
Deputy constables removed the boy from a school bus stop on Oct. 16 and returned him to his father.
Diaz attorney Miguel Ortiz says Lacombe, who is from France, is wealthy and could go anywhere with the boy.

Re: JEAN PAUL LaCOMBE - 10yo - San Antonio TX
The 10-year-old Jean Paul Lacombe Diaz school bus video has been
released by his mother, Berenice Diaz. Jean Paul Lacombe Diaz appeared
scared, frantic, as he warns the investigator not to lead him into the
hands of a man that calls himself father. We must warn you, this video
is not easy to view. I will not add a link but you can catch it on HLN.
What does Jean Paul Lacombe Diaz say to the investigator on the school bus?
"He's not my dad. No, no, he's not my dad. Please help me he's not my dad. I don't want to live with him."
The investigator questions the young boy's claims.
Jean Paul Lacombe Diaz responded, "Because he hits me lots of times."
Then the investigator suggests that they will not allow anything to
happen to the child as they escort him off of the bus to continue his
good byes to his mother and younger brother before carting him away in
police vehicles towards Jean Philippe Lacombe's location.
The mother, Berenice Diaz, was the legal guardian until on October 16,
2009 Jean Philippe Lacombe presented Texas District Judge Sol Casseb
manipulated documents from the Mexican judicial authorities. The Judge
decided to grant Jean Philippe Lacombe legal guardianship of Jean Paul
Lacombe despite the fact that Jean Philippe Lacombe has illegally
abducted his son a couple of years ago. It took Diaz up to two years
to get her son back.
Bexar County authorities are investigating as felony charges await Mr. Lacombe once in custody.
San Antonio Attorney Miquel Ortiz represents the mother as he calls this a "government-assisted kidnapping."
When Diaz and Lacombe's marriage dissolved in Mexico in 2005 Lacombe
was given custody of his son until he fell short after taking Jean Paul
Lacombe to France against the rules surrounding the guardianship.
Custody was then given to Diaz.
On October 15, 2009, one day before the Judge granted him custody,
attorneys for Lacombe claimed that Jean Paul Lacombe was abducted by
him. International Child Abduction Remedies Act once allowed the
mother to gain custody of her son, but it is the same angle Lacombe
used the Child Abduction Remedies Act against the Texas judicial system
in regaining Jean Paul Lacombe, a double-edged low blow by attorneys.
Now both prominent San Antonio attorneys for Lacombe have an attorney
of their own.
James Monnig and John Mead's attorney is H.E. Mendez who claims that they did nothing wrong.
After the bus incident Berenice Diaz was sent her son's cell phone
postmarked from San Antonio, Texas. Diaz admits that Jean Philippe
Lacombe was now married to a Russian woman, but could be returning to
either Mexico, France or even Russia. She stated that she thought her
and her children would be together and safe in America as this latest
kidnapping proved her wrong.

Re: JEAN PAUL LaCOMBE - 10yo - San Antonio TX
The calls finally started coming in on Berenice Diaz's cell phone on Wednesday.
None of them were the one she’s been waiting for — word that her
son, who was taken by his father two months ago, had been found. But
they were a good step forward, she said Thursday between discussions
with producers at CNN, “Good Morning America” and other national news
organizations.
“The media is the best (hope) we can have,” Diaz said. “Someone is
going to see my son. Now I have the hope, 100 percent, that I'm going
to get my son back.”
Diaz has been seeking help in finding Jean Paul Lacombe, 10, since
her ex-husband Jean Philippe Lacombe used misleading Mexican court
documents in October to convince a judge at the Bexar County Courthouse
to give him emergency custody.
The father and son were supposed to show up in court three days
after deputy constables helped him retrieve the screaming, pleading boy
from a school bus on Oct. 16. They haven't been seen since.
Diaz's plight attracted local media attention, including a widely
distributed Express-News story last month that spurred the district
attorney's office to open an investigation. But it wasn't until this
week, after felony kidnapping charges were filed and dramatic video
taken inside the boy's school bus was made public, that Diaz's story
began attracting national TV coverage.
“Someone help me, please!” Jean Paul can be heard yelling repeatedly
as the video shows him backing away from deputies, his voice tinged
with fear.
Reliving the incident on screen is akin to watching a horror movie,
Diaz said. But if it's necessary to generate interest in finding her
son, she doesn't mind.
“They are running it everywhere. Thank God,” she said. “If I had that video two months ago, by now I would have my son back.”
Certainly, keeping the story in the media spotlight can't hurt
Diaz's chances of finding her son again, said District Attorney Susan
Reed. It also focuses attention on what may end up being a deficiency
in the court system regarding emergency orders in child custody suits,
she said.
“I just think it needs to have a thorough vetting,” she said of the
process, suggesting that a panel of experts should be assembled before
Texas' next legislative session.
So far, no one is willing to guess how long it will take authorities
to find Jean Paul and his millionaire father, Jean Philippe Lacombe,
who is a dual citizen of France and Mexico. But now that national
authorities are on the case, it's only a matter of time, said Tom
Smith, a supervisory deputy U.S. marshal.
“The world gets a whole lot smaller when we go after these guys,
because everybody leaves a trail,” Smith said Thursday, after fielding
an interview request from “America's Most Wanted” concerning the case.
“It's not a matter of if you get caught but when.”

Re: JEAN PAUL LaCOMBE - 10yo - San Antonio TX
An international manhunt is under way for a father accused of
falsifying court documents to obtain custody of his 10-year-old son in
Texas and then fleeing with the boy.
Jean Philippe Lacombe, 41, is wanted on charges of kidnapping,
aggravated perjury and interference with child custody after
disappearing with his son, Jean Paul Lacombe.
The boy's mother, Berenice Diaz, said she last saw the pair at an
airport on Oct. 17 — the day after Texas police took Jean Paul from her
kicking and screaming at a school bus stop."I saw Jean Phillippe at the Mexicana counter, and my son was
sitting down at the waiting area in a seat, so I took him, I grabbed
him and I said, 'Paul come, let's go,' and he said, 'No Mom, because if
I go my dad will kill you,'" Diaz told Fox News Thursday.
Diaz said she was trying to assure Jean Paul that his father wouldn't hurt her when Jean Philippe came over.
"I started shouting for the police and I showed the policeman the
paper where it said that he [Jean Paul] had to be in court on Monday,
and he said that he can't do nothing because this is a court order."
Texas authorities said they had a court order to take the boy from
his mother, but they since have issued warrants for the arrest of his
father.
"The lawyers didn't make a right investigation of what the ...
documents said, because I had the custody … so they didn't even call
the judge in Mexico or the court in Mexico … they just believed what
Jean Philippe brought to them," Diaz said.
"It is really frustrating for me," she added. "If you hear a boy
crying out loud that he is mistreated by his father, and I cried out
loud as well: 'Please don't let this happen.' They only said 'This is a
civil matter.'"
According to Diaz, it's not the first time Lacombe has taken the boy.
"Last time he took him to France for two years, he was 5-years-old
and in all that time we couldn't speak," Diaz said. "And he hit him
during that time, and he left him home alone. ... That's why he's so
scared about him."
Diaz's attorney Miguel Ortiz says Lacombe, who is from France, is wealthy and could go anywhere with the boy.

no new updates - lots of outrage at the stupidity of the judge -

Re: JEAN PAUL LaCOMBE - 10yo - San Antonio TX
actually, some are saying on blogs that there could be a payoff involved - since the document presented was in spanish (and was actually the father's arrest warrant) the judge should never have agreed to grant custody based on that alone, when he can't read spanish himself.

A Bexar County grand jury issued felony indictments Tuesday for a
Mexican millionaire who is already the focus of an international manhunt
regarding the disappearance of his son. Jean Phillipe Lacombe, 41,
faces up to 10 years in prison if found guilty of kidnapping and
aggravated perjury charges, and up to two years in a state jail if found
guilty of interference with child custody. He has been wanted on the
charges since December. Lacombe is accused of using misleading
Mexican documents to persuade a state district judge to grant him
emergency custody of his 10-year-old son, Jean Paul Lacombe. With
the court order in hand, the elder Lacombe used Bexar County constables
to pull his screaming son off a school bus on Oct. 16, 2009. The two
were supposed to show up in court the following Monday, but they haven't
been seen since. It was the second time Lacombe, who is also a
citizen of France, had been accused of absconding with the boy. Tuesday's
indictments will hopefully help persuade foreign officials that the
case amounts to more than a child custody dispute, said District
Attorney Susan Reed. Prosecutors currently believe Lacombe is in Mexico,
she said, explaining that her office has been in contact with his
attorneys.

A panel of judges in France sided with Berenice Diaz in the
international custody battle over Jean-Paul today. They granted her
custody of her son, who has been with his father, Jean-Phillipe Lacombe
for the last few months. Jean-Paul was taken off a school bus in San
Antonio and given to his father. The U.S. Marshals and Interpol had
been looking for him ever since. He and father turned up in France and
that is were the custody battle finally happened. There is no word yet
exactly when Diaz and her son will return to San Antonio.
