Jackson County prosecutors have accused a Kansas City mother of
involuntary manslaughter in the death of one of her twin 3-year-old
boys last year.Kimberly Ervin, 44, also is charged with child endangerment
related to injuries suffered by the surviving twin.Authorities
allege that Ervin allowed both boys access to prescription drugs and
therefore is guilty of recklessly causing Joshua Moss’ death and
endangering the life of his brother, Jeremiah. According to
court records, Joshua and Jeremiah were admitted to a hospital in
January 2009 after Ervin called 911 to report breathing problems with
Joshua. He had vomited in his bed and would not wake up.
He was taken to Children’s Mercy Hospital, where he was pronounced dead.Jeremiah,
meanwhile, was described as extremely lethargic. Medical tests showed
he had cyclobenzaprine in his system. Hospital staff reportedly
overheard Ervin’s 14-year-old son accuse her of drugging the boys to
keep them quiet. An autopsy on Joshua found that he died of
acute oxycodone, alprazolam and cyclobenzaprine toxicity. Partly
digested pills were found in his stomach. Hair samples showed that he
previously had been exposed to various prescription, over-the-counter
and illegal drugs.When questioned, Ervin said the boys must have gotten into her medicine box while she was sleeping, records show.

I know we're not supposed to comment in these news threads, but geeez, this is the third case like this we've got. I think it might even be the fourth because since the arrests of Misty and Ron for dealing in prescription drugs I'm wondering if something like this didn't happen to Haleigh.

KANSAS CITY, Mo. -- Jackson County Prosecutor Jim Kanatzar has filed charges against a woman who is accused of giving pills to her son that resulted in his death.
Kimberly E. Ervin has been charged with first-degree involuntary manslaughter and two counts of first-degree endangering the welfare of a child.
Court records said Kansas City police went to 3439 E. Sixth St. on Jan. 30, 2009, on a report of a child who was having trouble breathing. Ervin told police that her 3-year-old son, Joshua Moss, was having problems breathing related to asthma. She said he had vomited on his bedding and would not wake up.
Moss was taken to Children's Mercy Hospital, where he was pronounced dead.
During the investigation, police discovered that there was a second victim -- Joshua Moss's twin brother, Jeremiah Moss. He was also admitted to the hospital. Medical tests showed he had Flexeril in his system. He was treated and released.
Court records said that while at the hospital, staff members took a report from Ervin's 14-year-old son, who said she had drugged the two victims to keep them quiet so she wouldn't have to care for them while she was getting high.
Results of Joshua Moss's autopsy showed he died as a result of acute oxycodone, alprazolam and cyclobenzaprine toxicity. Partially digested pills were found in his stomach. He also showed signs of previous exposure to prescription drugs.
Ervin admitted to police that she went to sleep and when she woke up, Joshua had vomited and was unresponsive, so she called 911.
