"Toddler Jane Doe" - 4 yo (2010)/ Accused: Linda Davis - Albuquerque NM

An Albuquerque grandmother accused of using her own
granddaughter to make child pornography wants to get out of jail until her
trial— and Thursday, a judge lowered her bond.

Before Thursday's hearing, 51-year-old Linda Davis was being
held on a $75,000 bond. A judge lowered that to $25,000 cash or surety, shocking
prosecutors and the victim's family.






Davis was arrested in 2008 for making child pornography using
her 4-year-old granddaughter.
Davis' boyfriend, Christopher Gurule,
posed in the pictures with the young girl.

The Bernalillo County District Attorney's office says Gurule
is still awaiting trial.

Linda Davis has AIDS, which is the main reason she asked to
be released until her trial.

On Thursday afternoon, Judge Charles Brown lowered Davis'
bond to $25,000 cash or surety, meaning $2,500 could release her on bail.

The decision shocked and angered the victim's family as well
as prosecutors.

Lynn Southard, a spokeswoman for the AG's office said, "We
are disappointed, but this is not over. We are not finished— this is just
another piece of the puzzle."

Under Judge Brown's orders, Davis can not have contact with
anyone under the age of 18. She will be required to live with her mother, and
cannot consume alcohol or drugs or use a computer.

She will also be supervised by the state.

There is no date for the start of her trial because it is
currently being appealed.

Three years ago a FBI agent can to the home of my best friend and her husband. She first showed them a picture of their four year old daughter in a swimsuit at the pool (used as advertisement) and then proceed to show then sexually explicit photos of their daughter and a man recognizable as Chris Gurule. He was a boyfriend to my friends mother who was most likely was the one taking the pictures of her grand daughter. So they fought, Christopher Gurule and Linda Sandoval were arrested. They fought and they had the bond on these two monsters raised to a million dollars so they had to face for their actions. They had the pictures and other child pornography from his camera and computer. Open and shut right, they got the bad guys. No. Now three years later this family and the New Mexico DA’s lost there final appeal before having to take the case to the NM supreme court. A ridiculous man named Judge Charles Brown decided that the pictures could not be used as evidence. COULD NOT BE USED AS EVIDENCE THAT HE SEXUALLY ASSUALTED A CHILD, WHILE IN THE PICTURES HE IS SEXUALLY ASSULTING A CHILD. So he threw it out, the whole case dissolved. A lot of these cases do not get to be a clear as look at this picture and see what this evil has done. So I can only imagine the DA really dropped the ball. Regardless of how much everyone has fought, these two monsters are going to be released. Linda Sandoval who has AIDS and most likely did at the time of the assault will be free in weeks. She will not have to register as a sex offender. Christopher Gurule will be released in mid May. He is also know to be a forger, thief and drug trafficker. He will be released, with HIV as well, to prey upon the children that he will be allowed to be around for he will not have to register as a sex offender. Pictures….absolute proof that this man is a pedophile, but he sits in a Santa Fe prison with drug trafficking charges. I am outraged and I want everyone who reads this to be outraged too. To be angry enough to stop this from happening. So we don’t have to look at our children and let them we know have failed them. Having a chance to protect our children, who would choose not to?
I ask only that this young girl’s voice be heard through ours as we band together to fight for what we know, without doubt, is right. Keep them locked up. But if we fail, keep your children away from Sandoval Rd in Tijeras New Mexico because they will not even have to register as sex offenders.

I have heard further news on this case that the judge said he "did not like the wording on the warrent," for it to include the camera that was found, as a computer device or attachment. Disregarding what those pictures intailed. On verbage......

Does anyone know how to get the word out on this atrosidy? How to you put these acts before people, in ther face so that they act on them. It is something that continues to happen because people refuse to talk about it. They protest at furenals for gods sake and they can't rally together for something as aweful and harmful and disgracefull to our society as this............ I am fustrated

I read the appeal decision above.
The censure of this photo images from the digital camera was formulated around the fact that it is not a "computer accessory". The warrant was for computers and accessories. It could be considered an accessory if it was attached to the computer at the time, alas; it was not. It was found in a closet down the hall.
Oddly, no connecting cords for the transfer of photos from the camera to the computer were located. The appeals court said that if they had, it may have made the difference.

Surely something happened that instigated the request for a warrant in the first place. If that sick couple were distributing photos then those pix should be allowed. How did someone know what was going on in the first place? This is horrible. And her own granddaughter.

If the female pervert has AIDS, it is likely the B/F does also. This makes me think the poor victim might have contacted it. I pray she is tested.

Other courts have held that if it could be attached to a computer it is an attachment.

This is disgusting and disturbing. Hard to believe. I hope the judge isn't a pervert. Many of them are. IMO.

If he found this was a flaw, it is a flaw that could have been corrected. Sounds like he was paid for his decision. That happens every day in our judicial system.

I think the state will be able to have his piss poor decision overturned. Maybe he thinks he is the cartoon character, Charlie Brown.

I hope you have written both your state and federal senators and representatives, your state's bar, your newspaper, and local TV stations. The only way to put a stop to this crap is to give it publicity. Make it known to the average person. We must fight for our children, they cannot fight for themselves.

This baby girl was raped. The rape was filmed. There is a law, but it appears there ain't no justice.
