Fairview NJ ---- A Fairview man severely beat his girlfriend’s 1-year-old daughter, hitting her,
slamming her head against a hard surface and then trying to drown her in a
bathtub, authorities said Tuesday.
Yopher Andres Jimenez, 23, was arrested after police received a 911 call on
Sunday night about a baby who had stopped breathing, Bergen County prosecutors
said.
“How’s the baby?” Jimenez asked Tuesday in Superior Court in Hackensack,
where he was arraigned on charges of attempted murder, aggravated assault and
child endangerment.
Johanna Montoya, the baby’s godmother who attended the hearing, said the girl
is on life-support with a fractured skull at St. Joseph’s Regional Medical
Center in Paterson.
The baby also had several rib fractures at various stages of healing, Bergen
County Prosecutor John L. Molinelli said in a Tuesday press release. She was
listed in serious condition Tuesday afternoon, he said.Jimenez, who did not have an attorney, told Judge Harry G. Carroll that he
would like to get in touch with his family in Florida and hire a public defender
to represent him.
Carroll ordered him held on $750,000 bail at the Bergen County Jail, where he

since last year and moved in February from Florida to Hasbrouck Heights.
“She wanted to be close to her family in New Jersey after she had the baby,”
Montoya said of Jakeline Jimenez, who is her cousin.
Yopher Jimenez and Jakeline Jimenez were not married and have the same last
name by coincidence, she said.
The couple moved to a Harding Place apartment in Fairview the day before the
incident, Montoya said.
She said the 26-year-old Jakeline Jimenez, who was her cousin, worked at a
call center.
“She was very hard-working and trusted him with babysitting the child,”
Montoya said.
Yopher Jimenez worked a temp agency, Montoya said.
“He was quiet and didn’t pay much attention to the baby, but I didn’t think
he was abusive to her,” she said.
The baby is Jakeline Jimenez’s only child, Montoya said.

his apartment on Harding Place in Fairview. Authorities responded to find the
girl, Victoria Jimenez, unresponsive and not breathing.
Authorities said Yopher Jimenez struck the infant, slammed her head on a hard
surface and then tried to drown her in a bathtub. Victoria, who celebrated her
first birthday in March, was taken to Palisades Medical Center in North Bergen
and placed on a ventilator. She later was taken to St. Joseph’s Regional Medical
Center in Paterson, where she remained until relatives decided to take her off
life support on Thursday.
An autopsy performed Saturday revealed that Victoria suffered a fractured
skull and several rib fractures.
Jimenez’s girlfriend, Jakeline Jimenez, who is not related to the defendant,
told The Record last week that the girl was her child from a previous
relationship. She said the couple moved to Hasbrouck Heights from Florida in
February to be closer to relatives. The couple moved to Fairview the day before
the incident, she said.
Jimenez initially was charged with attempted murder, aggravated assault and
child endangerment, and was being held at the Bergen County Jail in Hackensack
on $75,000 bail. A charge of murder was added on Monday, and his bail was raised
to $1 million.
Assistant Prosecutor Catherine M. Fantuzzi said the case will be presented to
a grand jury, though she said it was not clear Tuesday how soon that would
happen.

I hope she rots in prison as long as he does. She knew this man was severely beating her infant. This baby would have screamed when she was picked up. Hopefully, after her current pregnancy, the baby will be given to a loving family.

The beginning of a Fairview man’s trial in the death of his girlfriend’s baby daughter has been delayed while a forensics expert hired by his lawyer can review medical evidence.
Presiding Superior Court Judge Liliana DeAvila-Silebi granted a lawyer for Yoher Jiminez more time today for the physician to obtain and review MRIs and CT scans conducted at Palisades and St. Joseph’s medical centers on 1-year-old baby Victoria.
Jimenez and his girlfriend had just moved from a relative’s house in Hasbrouck Heights to Harding Place in Fairview when she went shopping, leaving Victoria with him.
(The couple began dating in Florida soon after the child was born of a different father, authorities said.)
Prosecutors said Jimenez hit the child with his hands, held her head under water in a bathtub and also beat her head against the side of the tub.
Police found Victoria unresponsive. She was first taken to Palisades and then transferred to St. Joe’s, where it was discovered that she had a skull fracture and several rib fractures.
Victoria died a few days later.
Jimenez, a Colombian national, denied killing her.
“The baby was in the crib and [I] heard the baby coughing and gave her water,” Yoher Andres Jimenez told CLIFFVIEW PILOT through a relative at the time. “Then [I] came back to check on her and she was pale and her lips were purple.”
Family members took to Facebook and other social networks, insisting that Jimenez was innocent.
A cousin told CLIFFVIEW PILOT that Jimenez was “an honorable young man, hardworking person, responsible and with full integrity. He’s being accuse[d] and charged unfairly.”
The mother, Jakeline Jimenez, was charged with child endangerment after investigators determined that she knew enough not to leave her alone with her boyfriend because of “past abuse at [his] hands,” Bergen County Prosecutor John L. Molinelli said at the time.
The INS also sought to detain her. After a month in the county jail, she was released.

In a case marked by repeated delays, Jimenez contends, among other things, that medical reports ordered by First Assistant Bergen County Prosecutor John Higgins prove that he couldn’t have caused the April 2010 death of 1-year-old Baby Victoria.

“I would like to encourage Mr. Jimenez to refrain from mentioning any facts of the case on the record,” Silvera said. “He should let me represent him and filter his remarks before he puts them on the record.”
DeAvila-Silebi reinforced the attorney’s advice, telling Jimenez: “Everything you are saying, Mr. Silvera has already taken care of.”
