A judge Thursday sentenced a Colorado Springs woman to 40 years in
prison for her role in the child abuse
death of her daughter.
Fourth Judicial District Judge Robert L. Lowrey imposed the sentence on Chrystie
Marie Hardy for her guilty plea to child abuse in the death of her
4-year-old daughter Madyson Bogard.
“This child was abused for a long period of time. That’s what the
evidence in this case tells me,” Lowrey told Hardy.
He noted that she could have gone to get help sooner before calling
911 to summon paramedics to her apartment at 3710 Rebecca
Lane on Jan. 15, 2008, to report that her daughter had stopped breathing.
The child later died at Memorial Hospital from a closed head injury.
In August 2009, a jury convicted Hardy’s former boyfriend Mark Alton Friend of
first-degree murder in the child’s death. He is currently serving a life sentence without parole.
Under the terms of a plea bargain, Hardy could have been sentenced to
between 16 to 48 years in prison. Because of her failure to get help
sooner, Lowrey said he could not extend any mercy in his sentence.
“I do wish you luck with what life you have left,” the judge told
Hardy, who hugged her defense attorney Tina Tussay-Cooper before being led away.
“This was an emotional case,” Senior Deputy District Attorney Frederick
Stein said after the sentencing. “Ms. Hardy’s actions and her
inactions make this sentence just. She had the ultimate responsibility for the life of this little girl.”
