Charges against a babysitter have been upgraded
following the death of a one-year-old girl who was being watched by the
daycare provider.
Julie Kalberg, 32, now faces murder and misdemeanor child abuse
charges. Authorities said Kalberg was watching Caitlyn Jolley
Friday morning at her home in Eastvale. At some point the toddler
suffered a severe head injury and was taken to a local medical center. Investigators said they arrested Kalberg on Saturday after examining
the nature of the child's injuries. Jolley was later transferred
to Loma Linda University Medical Center after doctors decided she
needed specialized care. The toddler died at the hospital on Tuesday. "Ms. Kalberg was the day-care provider for the young child. She was a
friend of the family and had been taking care of the child since January
of this year," said Sgt. Joe Borja of the Riverside County Sheriff's
Department. "She was supposed to be taking care of this child but she in
fact caused injury," Kalberg is scheduled to be arraigned on
May 17. She is being held in lieu of $1 million bail.

RIVERSIDE - An Eastvale daycare provider accused in the beating death of a year-old girl pleaded not guilty today to first-degree murder and misdemeanor child abuse charges.
Julie Kalberg, 32, allegedly inflicted ultimately fatal injuries on Caitlyn Jolley while the tot was in her residence in the 6300 block of Elias Street, near Sumner Avenue, according to the Riverside County Sheriff's Department. .
Kalberg was arraigned today before Superior Court Judge James T. Warren, who set a felony settlement conference in the case for June 4.
The defendant is being held in lieu of $1 million bail at the Robert Presley jail in Riverside.
According to sheriff's Sgt. Dean Spivacke, Caitlyn suffered unexplained head injuries on April 30 and was taken to Corona Regional Medical Center.
Spivacke said doctors there decided she required specialized care, and the girl was transported to the children's hospital at Loma Linda University Medical Center, where she remained in intensive care until being declared brain- dead May 4.
Kalberg was taken into custody without incident three days earlier based on the evidence of alleged abuse, according to Spivacke.

An Eastvale woman was convicted Tuesday, Feb. 13, of involuntary manslaughter for the 2010 death of a 1-year-old girl she was babysitting.
Julie Kalberg, 34, was charged in 2010 with murder and assault on a child resulting in death after the baby, Caitlyn Jolley, died from head injuries.
Jurors deliberated for two days before finding Kalberg guilty of the lesser manslaughter charge and a second count of felony abuse and child endangerment.
Kalberg was babysitting the girl April 30, 2010, at a home in the 6300 block of Elias Street in Eastvale when Caitlyn was injured and taken to the hospital. She died four days later.
Caitlyn suffered major head trauma and showed signs of shaken-baby syndrome, homicide detectives said.
A brain surgeon who performed surgery to try to save Caitlyn’s life testified during the trial, and put the girl’s brain swelling toward the top of 1,000 brain surgeries he had performed, Riverside County district attorney’s spokesman John Hall said.
Prosecutors said they filed the murder charge based on the evidence and because Kalberg changed the story she told police several times.
“The jury’s verdict still shows they believed she caused the fatal injuries. They just didn’t find for murder,” Hall said.
Kalberg’s attorney, Jeff Moore, did not respond to a request for comment Thursday.
The baby’s parents were not charged.
Kalberg a family friend, not a licensed child care provider.
She has been held at the Robert Presley Detention Center without bail since her arrest May 1, 2010.
She is scheduled to be sentenced Feb. 28 and could face a maximum term of four years in prison — but could be given credit for time served that would almost equal that sentence.

Knowing that the killer of an 18-month-old girl would face no prison time, family members lashed out about the Eastvale baby sitter during her sentencing Friday.
A jury found Julie Kalberg, 34, guilty of involuntary manslaughter and misdemeanor child abuse, rejecting a murder charged filed by prosecutors in the 2010 death.
Kalberg had spent nearly four years in a Riverside jail while awaiting trial. She was freed after the verdict Feb. 13 and sat with her attorneys in court Friday.
The jury found Kalberg responsible for the death of Caitlyn Jolley, who she was babysitting at an Eastvale home April 30, 2010. Caitlyn suffered major head trauma and showed signs of shaken baby syndrome.
Kalberg maintained through the trial and through her attorneys that the death was accidental.
Her defense attorney Virginia Blumenthal said outside court that Kalberg “plopped” Caitlyn on the floor after she got poop on her hand. She said the baby had a prior head injury and it was enough to cause the initial injury to spread.
“This was not violent,” Blumenthal said. “It was tragic no doubt. But I have never believed she was guilty of murder.”
The maximum sentence Kalberg faced for the manslaughter charge was up to four years in prison. She was credited with time already served, and the court could not impose any additional jail time.
Deputy District Attorney Hunter Taylor said prosecutors would ask for more time if they could, but understood the court’s limitations.
Before her sentence was announced, Caitlyn’s father and uncle read statements to the court while Kalberg faced forward.
Caitlyn’s father, Allen Jolley, said Kalberg threw his baby to the ground and watched as her head bounced on the floor. He said the baby suffered a seizure for four minutes before she called 911. He said Caitlyn helped three other children live through organ donation.
“Julie will forever be known as a child abuser and a child killer. I know I can’t influence her sentence,” Jolley said. “She killed my baby and took away my ray of sunshine. Just because she was found not guilty, doesn’t mean she is innocent.”
Riverside Superior Court Judge Michael Donner gave Kalberg the maximum four-year sentence, but said any sentence imposed would have already been served through the state’s prison realignment program. With good behavior credits, she was given credit for more than seven years of time served.
“The one thing that shocked my conscience was that you have not shown one scintilla of emotion, not through the trial or how you sat here today with a flat expression,” Donner said. “The only other punishment you have is to live with this on your conscience. You know exactly what you did.”
