Hoosick Falls NY ---- Police continue to investigate Joseph McElheny in
connection with death of his 4-month-old daughter two weeks ago, and law
enforcement sources say an arrest or indictment against him is likely
to come — potentially on a charge of murder.
While no charges have yet been filed, State Police and Hoosick Falls Police believe Ina
Jane McElheny suffered repeated abuse at the hands of her father, with
one particular incident leading to her death, according to police sources.
“That baby was suffering quite a bit,” one official said.
The girl had sustained a broken leg and several internal
injuries before medics responded to an emergency call around 1 a.m. on
May 12. The death was later ruled a homicide by the medical examiner.
“It’s still an ongoing investigation,” village Police Chief Robert Ashe said.
A State Police spokeswoman voiced similar comments.
Inquiries to McElheny, 30, through the Hoosick Falls computer-oriented business he
operates out of a home on River Street, Wolf Pack Media Technology
Solutions, were directed to his lawyers. Public Defender Jerome Frost
said it was too early to comment on the case in any specifics.
“It’s one thing to say someone is guilty of something,” he said. “It’s
another thing to prove it.”
He said police will “do what they think they should do,” as will McElheny’s defense team.
“That doesn’t mean my client did anything. He’s entitled to a presumption of
innocence, and as far as I know he’s innocent,” Frost said.
Rensselaer County District Attorney Richard McNally had no comment on any possible
forthcoming grand jury action. Those proceedings, during which the
grand jury hears testimony and decides whether there is enough evidence
to substantiate a criminal indictment, are conducted in relative secrecy.
Police are basing their case on medical evidence, and
several tests have been conducted over the course of the ongoing
investigation. McElheny did not indicate guilt when questioned by
police, a source said.
A page that appears to have been created
by McElheny on the social networking site MySpace indicates he attended
high school in Lockport, near Buffalo. He has not logged into the
page in nearly three years; it lists his place of residence as Bennington, Vt.
The website for his company, www.wmpts.com, has a memorial dedicated
to the infant. A slew of photos posted to online photo albums by Joseph
McElheny depict the big blue-eyed girl from her birth until late April.

HOOSICK FALLS — Joseph McElheny’s infant daughter Ina Jane, who died recently under circumstances police ruled a homicide, was his “entire world” and was neither murdered nor abused, a close relative said.
The relative, who asked that her name or relation to McElheny not be mentioned, said the grieving family does not understand how police could be eyeing the 30-year-old for allegedly killing his daughter when relatives have received few answers about what caused the 4-month-old’s death on May 12. Police have not interviewed McElheny’s closest family members, she said, and have shared little information.
“There was no abuse whatsoever — none that was being hidden, none that was covered up,” the woman said. “I saw that baby on a regular basis, and she was never abused. No one murdered this baby.”
McElheny and the girl’s mother, Melinda, were “neurotic” about keeping Ina Jane safe and healthy, she said.
Police sources have suggested a history of abuse, pointing to a broken leg and numerous internal injuries uncovered during an autopsy as indicative of serious trauma. State Police went public with a press release a few days after the infant’s death labeling it a homicide, and police have said quietly that they expect Joseph McElheny will face serious criminal charges once the investigation is complete.
His relative said the family has ordered its own investigation into what killed the child, and the results of a multitude of tests performed in Topeka, Kan. — where she was buried — will be forwarded to the Rensselaer County Public Defender’s Office, which is representing McElheny on the matter.
Public Defender Jerome Frost, who is handling the case with assistant public defender John Turi, previously said his client is entitled to a presumption of innocence and said accusing McElheny and proving responsibility for his daughter’s death are very different from one another. On Wednesday, Turi reiterated Frost’s comments and declined to discuss specifics of the case.
Frost has experience in defending cases of child death, most recently as part of the team that represented Adrian Thomas, a 28-year-old Troy man convicted in October of murdering his infant son despite extensive medical testimony from the defense that suggested a blood infection may have killed 4-month-old Matthew.
Ina Jane McElheny had been ill with digestive problems for at least a day before she stopped breathing, the relative said, and had received five vaccines just days before her death.
“As far as we know, this was anaphylactic shock,” she said, caused by a reaction to a vaccine. “… No one’s trying to hide anything; we just want to know what made this baby sick and die. We’re devastated. It’s not like we’re going on with life, this is what destroys families.”

I would love to find more information somehow.. I was a member of Babycenter, where Ina's mom was also a member and this lady was CRAZY IMO... If anyone needs to be looked at it's the mother. She always expressed how she couldn't handle things that would be pretty simple for a new mother and Ina's father kept her at work with him all day.. I'm pretty sure Ina's mother did not work, so I found this kind of strange. I believe someone on Babycenter.com also said after all this happened that she had mentioned once how her husband didn't trust her with the baby. Why is she not being looked at as a suspect?? I don't understand this, but this little Angel deserves Justice. I guess this story breaks my heart so badly because I feel like it hits so close to home, with us both on the same website throughout our entire pregnancy and she stayed a member until this happened... :(

my dd had this happen to her - the autopsy would have easily identified a closed airway - the lungs and airway swell from the inside out - it takes 4 diff meds to stop it and thank god we got to the hospital in time - she had eaten cashews and they caused the severe allergic reaction - she also had hives, and her face was swollen.

I'd like to know more about the mother too. Like was she home etc. Was the baby's leg broken before that day?
It sounds like he worked from home and looked after the baby. Perhaps her mother worked. Terribly sad.

I heard that her broken leg was a previous injury that was never acknowleged or treated.. and that they found this out either after the autopsy, or when she was taken to the hospital.

I also read that she was sick with a stomach virus before this happened.. I wish they would get their info straight on Ina! A woman in WV is getting 3-5 yrs in prison for breaking her baby's legs because he wouldn't stop squirming while she was changing his diaper..she was mad at her boyfriend supposedly and she slammed him into the floor by his feet... I'll see if I can find some info on it.. People make me sick.

I am also a member of babycenter, and read the mother's posts shortly after this poor baby died. She has since deleted all her posts, but I remember that the mother (Melinda) went back to work. The father (Joseph) worked from home and was the baby's primary caretaker. The mother had a post about how the father always tried to keep her from the baby. The mother barely got to see Ina when she was home from work. One post was about how the father fed Ina a bottle in another room. Then he brought Ina out for the mother to hold or burp. Ina burped, spit up, and started crying. Then the father quickly took the baby back, and went back into the other room. It certainly sounded like he was trying to keep the mother from discovering signs of abuse. The whole case is just tragic.

There is a lot of misinformation and speculation running around this string. However, the original posts that have been mentioned repeatedly from the babycenter boards should be put in the hands of both the District Attorney's office, as well as the Public Defender for the father recently arrested. It is also ABSOLUTELY VITAL that the mother receive support and assistance from this point forward in order to prevent a future tragedy. Does anyone on this board still have access to the original babycenter posts, or know who could be contacted?

Let's start here. Has anyone noticed that the article states the POLICE showed up to an EMS call at 1am. Not EMS. EMS stands for Emergency Medical Services. When they got there, the father was attempting CPR on the baby, and had been for quite some time. They stood there, and watched him. How's that for an emergency response? There is little to no EMS service in Hoosick Falls. EVENTUALLY she was transported to Southwestern Vermont Medical Center by ambulance. Want to know why she got airlifted to Albany? Because there was NO EMERGENCY ROOM DOCTOR ON CALL at Southwestern Vermont Medical Center. She went for 25 minutes with no oxygen. And she died.
And later that night they dragged both grieving parents out of their bed and pulled them in to separate rooms at the police station and tried to berate them into confessing, then tried to berate them into ratting each other out, and basically permanently traumatized two people facing the worst crisis of their lives. So there's the part that keeps getting left out of the news reports. (Let's speculate for a moment, that they are both actually completely guilty. This would still be justifiably described as the worst crisis of their lives.)
Now let's back up. Yes, Melinda, the mother, worked full time. (Keep in mind, that means roughly eight hour days. There are still 16 other hours unaccounted for.) Joe, as the primary caregiver, HAD noticed that one of her legs did not seem to work like the other. HE took her into the pediatrician, and was asked if they had a johnny jumper, which they did. The doctor told him she was too young to be in it, and that it often caused leg injuries in babies when they weren't strong enough to fully support themselves.
He also took her in for what seemed to be serious problems with gassy issues and fussy issues. He'd just been in again to the doctor the week that she died. He was SEARCHING FOR ANSWERS. He didn't get any from the pediatrician. He was told to observe her, and watch. And she died.
(His sister almost died as an infant when her intestines ruptured, but since their mother was a nurse, she disagreed with their doctor and took the sister in to the ER. She had emergency surgery and lost a good portion of her intestine anyway - but SHE survived.)
I'm not exonerating either of them. The mother's babycenter posts have been widely discussed around the internet, including on comment boards after news reports, and as far as I can tell at least a few babycenter moms took it upon themselves to call the police about them. (**I would really, really like to have that confirmed. Sometimes people say they are going to report something, but assume it's already been taken care of or reported by someone else, and that isn't necessarily the case.**) Her posts seem to reek of postpartum depression. As did her blog. As did her speech at the memorial service. They also admitted to inadequacy as a mother and accused the father of a wide variety of things including pot smoking and playing video games all day. None of these things indicate effective parenting happening on any level, if they are fully true and not just the ranting of a woman at the end of her rope. SOMEONE IN THE AREA NEEDS TO REACH OUT TO HER. PLEASE.
If this board is truly a voice for those who have no voice, I hope the discussion surrounding Ina's death can lead to as many proactive steps as possible. First of all - I would be very happy to hear from "the regulars" around here about how much of this case sounds typical, versus atypical.
Second of all, consider that this may not be the only child that comes along. What then? How do you stop this from happening again, when you don't have the basic questions answered in the first place?
Third - can any babycenter moms confirm an actual report was made to the police dept? Could those same people - especially those claiming to have saved screen shots of her posts before they were taken down by babycenter - please also give that same information to both the Public Defender and District Attorney's Office? Can someone make that happen?

Thanks for the info Reeling. I'll try to answer in the order of your post. This is all just my opinion but as a regular here I can draw on what has been most common.
Firstly, re the EMS. Reading the first news reports it seems that baby Ina had been deceased for a while when they got there. Perhaps the father was indeed still trying to resuscitate his daughter and EMS responders could see it was futile, hence they didn't take over.
You say the parents went to sleep later and LE dragged them out of bed to question them. I assume it would have been ascertained through x-ray straight away at the hospital that Ina had suffered a broken leg at some stage. So LE have got a dead baby with signs of previous abuse. Naturally they haul the parents in for questioning and it's important they are questioned separately. I'm surprised the parents were in bed asleep actually. I wouldn't have been, I would have been with my daughters body at the hospital harassing doctors for answers if I was innocent.
Now, you say the father took Ina to the pediatrician because her leg didn't seem to be working properly and there was discussion that she injured it in the jolly jumper. I've never heard of anyone putting a baby 4 months old or less in one of those. They'd have to be pretty clueless parents IMO. Most importantly, the moment that Ina's leg was broken she would have been immediately extremely distressed and in great pain but they did not rush her to Accident & Emergency at the time. That tells me it was no accident.
I've snipped this next comment from an earlier article;

This raises a red flag for me. Sometimes people will try to cover up abuse by being over effusive about the state of the baby. They do it to try and nip any concerns others might have in the bud. It can also be a manifestation of subconcious guilt.
As to your question about what is typical, there is a definite trend for the male being the primary caregiver while the mother works which seems to be a problem. Nurturing babies is not a normal role for the 'hunters and gatherers' and men are more easily prone to violence than woman. That being said I think the cases of fathers V mothers injuring a child is about even, however it is hugely different when the male caregiver is not related to the child and mother's boyfriends abusing the child is depressingly common.
As to what can be done to prevent any future babies from being harmed - are you worried about the mother? If so we'll have to wait and see what happens there. There may be charges still to come. In the meantime I hope she is getting help to deal with everything. I hope this helps. Do you know why the father wasn't working? Was he laid off work and looking for a job or is he a stay at home drug dealer or what? Did he leave his job to care for the baby because the mother wasn't looking after the baby properly?

We have lost our sweet Ina Jane. Her death was a shock and I have no words to express what torture the past week has been.
We are waiting for answers regarding the science of her passing. I
can tell you that I have a message for all new parents out there,
regardless of what lawyers and others advise, or what is smart for me to
say publicly. It is important to me that no one else suffer the same
pain we are experiencing right now.
--DO NOT ignore behavior in your baby that is unusual. That new
behavior may be a symptom of a pressing health issue. When in doubt,
whether you are a parent who never freaks out or you don't want to be a
bother...CALL THE DOCTOR. My friend, a pediatrician, NOW advises me
that when babies crash, they crash hard.
--TAKE A SECOND LOOK at information regarding vaccines before you
allow your child to be immunized, especially a bunch at once. Talk to
your families--parents, siblings, etc--to find out if they have any
allergic reactions to vaccines in their history.
--Know your parents/siblings medical histories and write it down, any
surgeries they've had or stuff that happened when they were babies.
I don't know what is to come, but I know that if I can help even one
parent out there to avoid what is happening to us, it is worth the risk
in speaking out.
