Scott City woman pleads no contest in murder case
Published 8/2/2011
A Scott City woman has pleaded no contest to second-degree intentional murder and one count of child abuse in connection with the death of her 3-month-old son.
A trial had been scheduled for Marilyn Hoffman, 26, but it was canceled after she entered her no contest plea on July 12. A no contest plea is not an admission of guilt, but the defendant does not contest the charges against her. The plea authorizes the court to punish the defendant but does not establish guilt for any other purpose.
Sentencing has been set for 1 p.m. Nov. 7.
Hoffman initially had pleaded not guilty in November 2010 to first-degree murder and child abuse in connection with the death of her 3-month-old son, Xavier.
Xavier was flown to Via Christi-St. Francis in Wichita on July 10, 2010, after Hoffman and a neighbor initially took the infant to the Scott County Hospital. Hospital officials testified at a preliminary hearing that Hoffman had brought Xavier to the Scott County Hospital after his cries were abnormal, he had difficulty breathing and his pupils were fixed and dilated.
He died in Wichita after being taken off a ventilator, according to KBI agents. Hoffman was arrested the next day in Wichita. She told investigators she never had time for herself and felt she didn't have support from her family, and that she sometimes wished to harm her children, according to testimony from special agents with the KBI.
According to testimony from Dr. Kerri Meyer, a specialist in child abuse and neglect cases who assessed Xavier's injuries at Via Christi, the boy suffered retinal hemorrhages, which can be caused by shaking or an abusive head injury, a skull fracture, global swelling of the brain, or rib fractures that are in various stages of healing. Xavier ultimately died from lack of oxygen due to the swelling of his brain, Meyer testified.
