This child died because he dropped a toy on his uncle's foot! How sad that a man can't take a little pain but must end a little life just because he was mad. He should burn in Hell!!!!

Davis hearing postponed again
Published 12:00am Friday, October 8, 2010
The Thursday preliminary hearing for the Opp man accused of murdering his 4-year-old nephew has been postponed until November.
John Curtis Davis, 25, confessed to shooting Curtis Alex-ander Ruede point-blank in the chest with a .177 caliber, 4.5 mm air rifle at a West Cummings Avenue home in Opp, where the two lived with Davis’ mother. Witness reports said Davis shot Ruede when the child dropped a toy on Davis’ foot.
Davis is now charged with capital murder in the boy’s death.
During the preliminary hearing, the state is required to establish probable cause that the case should be bound over for grand jury presentment.
District Attorney Greg Gambril said the postponement came after officers involved in the investigation were scheduled for training sessions out of town.
There has been no order issued setting the November date, he said.

John C. Davis, 28, of Opp, pled guilty before specially appointed Circuit Court Judge, David Baker, to Murder and was sentenced to life in prison. Davis was charged for the July 16, 2010 killing of his nephew, Curtis A Ruede, age four. Davis was represented by Andalusia Attorneys Rod Sylvester and Mark Christensen. District Attorney Walt Merrell, III handled the prosecution for the State of Alabama.
In addition to his life sentence, Davis was ordered to pay restitution for the burial expenses of the victim and $5,000 to the Crime Victims’ Compensation Fund, in the event he is ever released from prison. He was also required to submit a DNA sample for the State DNA Data Base.
Davis was originally charged with Capital Murder because the victim was under the age of 14. After the guilty plea, Merrell had this to say: "The death of a child is something that a family never gets over. Even though – in time – this family may be able to accept that Curtis is gone, the sense of loss will be with them forever. Such a tragic situation becomes even more emotional because the person responsible was Curtis’s uncle. It was hard for this family to come to terms with the way to resolve the case, but after several conversations, all of the family representatives agreed that this life sentence was the best acceptable result to all of them."
For additional information or if you have further questions, please call Walt Merrell, III at 222-2513.
