A woman admitted, as part of a plea deal, to killing a 6-month-old boy in 2005.April Rogers, 39, pleaded guilty to child abuse resulting in death. She could have received a life sentence but got 50 years.The family of victim Alex Tay agreed to the plea deal.The
parents and grandparents of Tay wiped tears from their eyes as the
Douglas County attorney recalled the events of Dec. 5, 2005.Tay was rushed to the hospital with head injuries and died a few days later.Rogers'
lawyer, Tim Burns, said Rogers snapped in a fit of anger. He says she
is getting counseling and was depressed at the time of the boy's death.
She was having her own family problems, he said, adding that "there are
no words to express how remorseful she is.""This incident so out
of her character. She has no criminal history, three kids, pregnant,
(it's) so far away from what she is and her character," Burns said.Judge Michael Coffey said in court, "If I could write an order to bring little Alex back, I would. But I can't do that."Rogers will be released from prison after 25 years, minus 3 and 1/2 years of good time already served.Rogers
had been granted a new trial that was to start next week. The Nebraska
Supreme Court ruled that investigators violated her right to remain
silent when she told them she slammed the baby's head to the floor. The
high court reversed her first conviction and ordered the new trial.Talk of the plea bargain began last week.
