A 26-year-old Martinsburg man is accused of abusing and neglecting a 3-month-old boy who was found with severe bruising on multiple areas of his body and a bone fracture in his left leg, according to Berkeley County Magistrate Court records.Derrick Lane Fillinger, of 50 Wagner Drive, was arraigned Saturday by Magistrate Harry L. Snow on two counts of child abuse (causing serious injury) and two counts of child neglect (creating risk of injury), according to court records.The abuse and neglect allegations were investigated by West Virginia State Police Trooper W.R. Garrett, who was contacted Oct. 13 by the Child Protective Services unit of the West Virginia Department of Health and Human Resources in Berkeley County, according to court records.A physician at Frederick (Md.) Memorial Hospital determined that the fracture of the child’s left tibia was caused by a severe amount of concentrated force that was executed in a twisting manner, according to court records.The boy had “multiple abrasions and bruises over his entire body at different stages of healing,” Garrett said in a complaint filed in magistrate court. “The pressure needed in order to cause that specific ... break in a child of that age would have to be applied by an adult human,” according to Garrett.Fillinger allegedly told police that he believed the bruises were caused by the family’s golden retriever and the mother’s 3-year-old daughter, according to court records. He later admitted that he was alone with the baby and the 3-year-old while his girlfriend was shopping Oct. 12, according to court records. The child’s mother, Jo Ann Bryan, initially said the dog was playing roughly with the child and was standing on top of the boy, but then later admitted that she had been lying, according to court records.Bryan indicated that her boyfriend told her to tell the hospital that she had been alone with the children and that he was nowhere near the house when the incident occurred, according to court records.

Stories like this really get me thinking of doing evil things to a person that harms a baby this young. There is no reason for a baby this young to have any kind of bruising or abrasion...and especially broken or fractured bones. A baby this young cannot get around by his or her self to bump into things or fall down. A baby this young is completely dependent and needs and deserves love, care and security. I have no compassion for an adult that would harm a child so young and I feel no mercy for any bad that could possibly come to this person. God forgive me for feeling this way.
