Evansville IN ---- An Evansville mother's arrested for child neglect.
The child is now in a Cincinnati hospital.
Investigators said the arrest of Kim Hoeflinger followed a two week
investigation that determined her 5-year-old daughter was malnourished
and the girl had her head shaven and was forced to take cold showers.
The mother's boyfriend, 31-year-old Jason McReynolds, is charged with
child neglect and battery in the case.
Police said the girl is showing steady improvement at the Cincinnati hospital.

Kimberly Sue-Ann Butler Hoeflinger, the mother of a 5-year-old girl
allegedly battered by Hoeflinger’s boyfriend on April 28, has been
arrested on a preliminary charged with felony child neglect.

Hoeflinger’s boyfriend, Jason Wayne McReynolds, has been formally
charged with battery resulting in serious bodily injury of a person less
than 14 years of age, a felony.

Police have said Hoeflinger, 23, and McReynolds, 31, were living in
the basement of a house at 1402 E. Illinois St. McReynolds had a
previous child abuse conviction.

The girl — identified as Nevaeh Almond — had to be flown to the
Cincinnati Children’s Hospital with life-threatening injuries, according
to an affidavit of probable cause supporting Hoeflinger’s arrest.

Medical personnel there reported she had a severe skull fracture,
bleeding of the brain, multiple bruises and a bruised pancreas, the
affidavit said, and that the injuries appeared to be nonaccidental and
not self-inflicted.

In addition, according to the affidavit, it was discovered that
Nevaeh had lost several pounds since her last medical checkup two years
earlier and that she had the bone density of a three-year-old.

She was not listed as a patient at the hospital Tuesday and police
declined to comment about her condition.

Evansville Police Department Det. Todd Seibert said he went to the
Cincinnati hospital twice to interview Hoeflinger and the girl.

“I found out they were depriving her of food and water and giving her
cold showers. They shaved her head and made her do military-style
calisthenics,” he said.

According to the affidavit, prepared by Seibert, Hoeflinger told him
and other detectives that at times she felt that the disciplinary
methods used by McReynolds were too harsh and that he should stop.
However, the affidavit said she continued to allow McReynolds to take
primary control for caring for Nevaeh, including determining when and
where she slept, watching her while Hoeflinger worked, as well as
bathing, dressing and punishing her.

The affidavit states: “By doing so, Ms. Hoeflinger said she had not
seen Nevaeh’s body for weeks and so was unaware of any bruising she may
have had. Ms. Hoeflinger was aware that McReynolds had been recently
released from prison but said she was unaware that he was serving a
sentence for physically abusing a 7-year-old boy in his previous
residence.”

Police said Hoeflinger told them she was at work April 28 and had
left her daughter with McReynolds and that the little girl was normal
when she left that morning.

According to a police report, besides some bruises and scrapes, what
appeared to be burn marks were observed on the child. The child was not
breathing when paramedics arrived, according to the report.

McReynolds has a previous child abuse conviction. On Oct. 12, 2006,
he was arrested for beating a 7-year-old boy. He was convicted of a
class D charge of battery, rather than the charge he originally faced:
battery resulting in serious bodily injury of a person less than 14
years of age.

He served 18 months in prison and was released on Jan. 29, according
to the Indiana Department of Correction.

Felony neglect filed in child abuse case
The mother of a 5-year-old alleged abuse victim has been charged with a felony in the case.
Kimberly Sue-Ann Butler Hoeflinger, 23, was advised of her charge, neglect of a dependent, a class D felony, during her court appearance Wednesday in Vanderburgh Superior Court.
Hoeflinger's boyfriend, Jason Wayne McReynolds, 31, has been charged with battery resulting in serious bodily injury of a person less than 14 years of age, a class B felony.
Hoeflinger was found to be indigent and was appointed a public defender. She ordered to remain on a $2,500 cash bond.
She is scheduled to return to court on June 16.

A young girl involved in what Evansville Police say was one of the worst
cases of child abuse they have seen, is making a miraculous recovery
while her mom considers pleading guilty. Police say Kimberly Hoeflinger
knew her boyfriend was abusing her daughter, but she did nothing to stop
it. She faces one count of neglect.

Hoeflinger was in court to
plead guilty in the case. But when she found out she could be sentenced
to 6 to 20 years, she changed her mind. The child's paternal
great-grandparents were also in court saying while the child is doing
much better, Hoeflinger is just as guilty as her boyfriend. After
Hoeflinger changed her mind about pleading guilty, the judge recused
himself from the case.

"It wasn't done becasue the judge had done
anything improper," said Deputy Prosecutor Michael Perry, "but I think
it was more for his benefit than not. The judge agreed to recuse himself
from the case. There'll be a panel of 3 judges selected from which the
parties may strike a judge, and the remaining judge will be the judge to
handle the case."

Hoeflinger's boyfriend, Jason McReynolds, is
serving a 13 year sentence in the case. Police say he had shaved the
child's head, made her do military exercises, and take cold showers.

Judge denies attorney swap to mom in abuse case

EVANSVILLE — A judge denied a request for a new public defender from a woman who withdrew her guilty plea to a child neglect charge last month when it looked like she would receive a harsher sentence then she had hoped.

Kimberly Sue Hoeflinger appeared in Vanderburgh Superior Court on Wednesday with defense attorney David Shaw and asked Judge Robert Pigman to appoint a new defender.

Mike Perry, chief trial deputy of the Vanderburgh County Prosecutor's Office, didn't object to the request but Pigman denied it.

A new trial date of 8 a.m. March 19 also was set for Hoeflinger.

She was arrested after her daughter, who was 5 years old at the time, was hospitalized with life-threatening injuries in April 2010. Jason McReynolds, Hoeflinger's boyfriend at the time, was sentenced in May to 13 years in prison for neglect of a dependent causing serious bodily injury after being found guilty at trial.

In August, Hoeflinger, 25, had offered to plead guilty to one count of neglect of a dependent resulting in serious bodily injury, a class B felony punishable by six to 20 years in prison.

However, during a sentencing hearing last month before Vanderburgh Superior Court Judge Robert Tornatta, she became confused and tearful when he explained that because there was no plea agreement he could impose a range of sentencing options that included prison.

After a lengthy delay, the hearing continued.

Hoeflinger withdrew her guilty plea when it appeared that Tornatta might not give her a light sentence after an letter was read by one of the girl's grandmothers.

Tornatta then recused himself from the case to avoid any appearance of bias in future court proceedings such as a trial.

Perry and defense attorney David Shaw chose Pigman to replace him from a panel of three possible judges.

Each attorney was allowed to strike one of the judges from the list.

Shaw struck Judge Richard D'Amour and Perry chose to strike Judge David Kiely, who had sentenced McReynolds.

This mother should serve more than her boyfriend as she knew about the abuse and allowed it. I hope she gets more than she deserves.

Kimberly Hoeflinger's mother told a judge Wednesday that her daughter
was innocent of the child neglect charge to which she had already pleaded guilty.

However, Vanderburgh Superior Court Judge Robert Pigman
told Hoeflinger she committed a crime of omission by not reporting the
abuse inflicted by her former boyfriend Jason McReynolds on her
daughter, who was 5 years old at the time.

"You brought this man to her. It was a huge moral failure on your part," he said.

He accepted a plea agreement that sentenced Hoeflinger to eight years
of probation for her role in the nearly fatal abuse of her daughter by
McReynolds, who is serving a 13-year prison sentence for the abuse.

When emergency workers arrived at the home on April 28, 2010, the
girl was not breathing and unresponsive and her skull fractured,
according to an Evansville Police Department report.

Pigman said Wednesday that despite his deep reservations about it, he
was reluctantly accepting the plea agreement because he believed it was
in the best interest of the girl.

"This is wrong your honor. My daughter is pleading guilty to a felony
that will destroy the rest of her life," Cynthia Tirey said to Pigman
in court. "No matter what this court does to her, I am still extremely
proud of her because I know these things aren't true."

However, Pigman left no doubt about his thoughts on Hoeflinger's guilt.
"You are here today because you are guilty. You have pleaded guilty,"
he said. "You let into your life, for all intents and purposes, a man
who murdered your daughter."

He told Hoeflinger it was right that her family should speak up for her "but the cold, brutal truth is you are guilty."

He said he was accepting the agreement because he thought it was best
for the girl, who has already been removed from Hoeflinger's custody,
and because the prosecutor's had assured him there was no evidence
Hoeflinger directly abused her daughter.

The agreement prevented a trial at which the girl may have been required to testify.

Pigman also ordered Hoeflinger to report it to probation if she
became pregnant so the court could order her participation in social services and counseling.

Phylliss Hedge, the girl's great-grandmother and court-ordered legal
guardian, testified that the girl, Nevaeh Almond, was found to weigh 27
pounds and have the bone density of a three-year-old when she was hospitalized.

Among the abuse and injuries inflicted on Nevaeh, according to Hedge,
were cigarette burns, cold baths, withholding of food and liquids,
forced military style calisthenics, having her head shaved and being
tied to a stairwell in a dark basement.


She said the now 7-year-old girl has made a remarkable physical
recovery, nearly doubling her weight, and has completed physical
therapy. Other healing may take longer, said Hedge and other
grandparents who testified.


"When anyone plays rough with her it scares her. We still do not know
why," Hedge said. "Nevaeh cried for a long time because of her bald
head. People thought she was a boy."

She said the girl may have learning disabilities brought on by brain
injury and still needs visual and speech therapy and counseling.

"Now Nevaeh will have a life of scars and memories that no child
should have," said Becky Miller, who identified herself as Nevaeh's paternal grandmother.

But Tirey testified that Hoeflinger left her daughter with McReynolds
because she was out working to support her, and that she always kept her clean and well fed.

"If I had thought she was in any danger I would have flown over and said Nevaeh is coming with me," Tirey said.

This is unbelievable. I can't believe this POS mother got off with only probation. That child was systematically starved and abused and the mother had to know. Sheesh, what a travesty. Kimberly Hoeflinger should be in jail and instead she'll walk the streets and probably have more kids that will be abused. What a shame.
